Retired Magistrate here: This case against President Trump in New York is not about the law; it is about getting President Trump. This judge is doing what he pleases knowing that he can.
President Trump’s attorneys will appeal it; however, the judge doesn’t care neither does the prosecutor. The whole point of all these cases is get Trump; stomp all over the Constitution and see if anyone will or wants to stop them. Don’t look at these lawsuits from a legal standpoint; look at them from an emotional standpoint from deranged individuals who will do anything to take President Trump down.

State AGs have the authority granted them by either the constitution of their state or the statutes enacted by their legislatures. Quite often that includes the authority to bring civil actions on behalf of the state against individuals or entities that, normally, find themselves in violation of some type of regulatory requirement. Sometimes there are criminal penalties for those violations, but usually there are only civil penalties, and those penalties can include traditional civil remedies like rescission (where the violation leads to the cancellation of a license to do business in the state or a contract to provide services to the state) or the imposition of a civil penalty. Here, it appears that the NYAG failed to find a violation of state law or regulation for which she could seek a criminal conviction against President Trump or his businesses, so she settled for a civil action to inflict as much pain on his ability to do business in the state as she could. Opting for a civil action also reduced her burden of proof from beyond a reasonable doubt to, likely, a mere preponderance of the evidence. Since the point of the exercise is to drain the defendant of resources, even if the prosecution of the action is unsuccessful, opting for the prosecution of a civil violation makes the prosecution of the case easier, and costs the defendant just as much as a criminal proceeding would. Plus, had she brought a criminal proceeding, President Trump would have had the rights of a criminal defendant under the Bill of Rights and the Due Process and Equal Protection Clauses of the Fourteenth Amendment, which would ultimately give the United States Supreme Court a potential say in the matter. The Supremes are much less likely to intervene in a mere civil matter predicated upon state law or regulation. We are going to see how high up the judicial chain the corruption goes in NY.

Retired Magistrate here: OK, to specifically answer your question: yes, the government can bring a civil suit against you; i.e, one example an eminent domain action. If the state, county, city, township, etc. wants your land for a “public” purpose, and you are not in agreement with that or refuse to take their outlandishly low offer, you in all probability will be sued in civil court for the taking of your land.
I put public in quotes, because more and more cases really don’t involve the public at large; they involve a big developer who wants your land.
Another example is non payment of real estate taxes. In that case the county government (or state, city, etc. depending on what state you are in) will file an action in civil court, Common Pleas Court, against you and if you can’t pay the taxes sell your house. Many counties keep the proceeds, even if they are more than the real estate tax amount due. However, I believe there was a recent ruling that states the remaining proceeds have to be returned to the former homeowner.

So, under the presumption the Trump team had a clear idea what kind of guy this judge is, why on Earth didn’t they request a jury trial? It’s incredibly easy to do, just a box to check on a form. Once a “bench trial” has started though, you don’t have the option to switch to a jury trial.

All judges have that power to issue a summary judgment. It just isn’t done very often on a high-profile case. It does happen regularly on smaller trials, to save the money it costs empaneling a jury when the judge rules the case is already proven. It’s not misconduct. Just unanticipated.
It has to be on motion of the parties, not sua sponte. It requires extensive discovery, documentation, stipulation of facts, briefing and argument. It is rarely legitimately granted by prudent judges, and certainly is not legitimized by any preconceived semblance of misconception of the facts and grossly misunderstood real estate valuation and banking practices needed to be presented by competing expert witnesses, as is demonstrated here by Engoron. With the exception of administrative cases, the resolution of competing expert witness testimony singularly belongs to a jury, the ultimate finder of fact.

When President Trump wins this case on appeal can this judge be sanctioned ? I should state the rest of this case on appeal because an appeals court has already ruled that some it expired because the statute of limitation has ran out which ” Judge” Arthur Engoron has chosen to ignore. I do not get how this judge can completely ignore another courts decision, ignore that this case should have been heard in commercial and completely overlook the fact that there are ZERO victims in this manufactured civil case. Oh, I am trying hard to look at the trial exactly as it is. That’s why I disagree with SD, and don’t think it will be reversed on appeal. The higher court didn’t issue a stay to the penalty phase. They allowed it to proceed. Though I don’t have your credentials, doesn’t that telegraph that they accept the summary judgment, the judge’s finding of fact, and will only be open to revisiting the amount/kind of penalties Trump Org. is ordered to pay?

What you’d expect from a Judge who knows nothing about real estate values but opines on them anyway, and discards Expert testimony as not “evidence.”
Likes its really hard to use zillow or realtor , to look up property values.
President Trump is what this country needed, and needs.
