I try not to cuss much, but I will admit when New Mexico Governor Lujan Grisham declared a “public health emergency” then issued a regional gun ban for the Albuquerque area, I was cussing quite a bit. I was cussing because this approach was instantly predictable, as the result of Americans allowing various governors to take control over free-range citizens during COVID-19 by declaring the same “public health emergencies.”
Thankfully, there was a massive backlash from citizens, local law enforcement, state law enforcement and the New Mexico Attorney General’s office. Now, fortunately, a federal judge has stepped in and blocked the unconstitutional gun ban. The blood pressure lowers a bit, but we have got to be on guard for the next test; they won’t quit.
New Mexico – A federal judge on Wednesday temporarily halted a 30-day order from New Mexico’s governor suspending the open and concealed carrying of guns in the Albuquerque area that had sparked bipartisan condemnation.

Urias, an appointee of President Joe Biden who took his seat on the bench last year, indicated that the numerous Supreme Court precedents on the Second Amendment suggested that the governor’s order would cause irreparable harm to citizens seeking to exercise their gun rights. In briefs and during Wednesday’s court session, lawyers for the various gun rights groups argued that Lujan Grisham and her administration went far beyond constitutional powers in issuing the order.
“The Second Amendment has no exception. It has no part of it that says as long as the state governor can issue an emergency, you’re allowed to take our citizens’ firearms,” Jason Bowles, an attorney representing the National Association for Gun Rights, said during the hearing. “There’s no historical evidence of that. There’s no support for it.”

They are pushing back back because they know that a Republican Governor can declare that excessive abortions are a public health emergency and will place a moratorium on abortions under the same argument.
I’ll simply say this: “no Governor should be able to ‘declare’ a ‘public [health] emergency.'” That should be the purview only of the elected Legislature. Which can convene in emergency session (if necessary) and ratify the necessary resolution within one day. But, there are several hundred people in a “Legislature,” and that is precisely the point.
The gov used her public emergency power for 3 yrs of covid. NM had some of the worst lockdowns. It was the only state to shut down car dealerships! The Dem legislature was begged by minority party legislators and the public to rein her in—-they refused the entire time. And that’s how we arrived at the diktat last Friday. The reason the backlash is bipartisan is two fold.
1. Democrats DO NOT want guns on the ballot or in the public consciousness. You can almost hear them saying “OMG, would you please SHUT UP. You’re ruining everything!” The conspiracy theorists are correct. Again.

#2 applies to ALL of our rights, not just 2A. #2 is why the lockdowns were illegal. #2 is why mask mandates, vaccine mandates, eviction moratoriums, and other actions by state and federal officials were illegal.
There is no “public health” exception to the US Constitution.
I think that’s why the Democrats want this stopped. COVID was a huge power grab, and the last thing they need is a series of rulings by Federal judges that there is no “public health” exception that invalidates the Constitution.

I have read the text of these statutes, and it is very plain to see that this is nothing like the “extreme edge-case scenario” that they were contemplating while writing it. The Governor of a State cannot – first of all – “declare” a “public health emergency,” not herself being a medical doctor. And then, a “public health emergency” cannot possibly have anything at all to do with guns. In a simple and broad statement, this is gross abuse of power: power that the Governor does not actually have.

At this point my feeling is to disable my phone that day by pulling the battery and putting it and my tablet in a faraday bag. Unplugging from the internet and the power for those few hours. Believe it or not, California has the same issues. I can’t imagine that Gavin Newsom wasn’t recalled. He had far more people angry at him than the country knows. Whatever organized criminals are running the voting machines are calling the shots here.
