The Robert Hur appointment order is interestingly worded to encompass the origination of the John Lausch “initial investigation”, we have not seen any documents associated with that initial appointment on November 14, 2022.
Additionally, the appointment order seems to limit the investigation to only records discovered in two locations, “the Penn Biden Center for Diplomacy and Global Engagement and the Wilmington, Delaware, private residence of President Joseph R Biden, Jr.” The next part “any matters that arose from the initial investigation,” again puts the emphasis on the John Laush original investigative authority as given by AG Merrick Garland.

I don’t think that it matters whether they were declassified or not. Under the FRA it is illegal to take government records. Circumstances or classification is not relevant. The FRA covers every government employee except POTUS, who is covered under the PRA. Also, unlike many crimes where intent is an element, under the FRA no intent is required. The act of taking the records is enough to violate the statute.
The media is trying to gaslight people by claiming it may have been an inadvertent error. Under the FRA it doesn’t matter. Also, even if it did matter, and even if intent was a needed element of the crime, he moved the records at least twice. That is direct evidence of intent under any analysis.

My lawyer’s read of this is that it is incorporating by reference the terms of what would presumably be the same sort of charging document for Lausch, which I haven’t seen. Then it also appears to close with saying (I paraphrase) “and anything else that comes up which is allowable to investigate under section 600.4(a).”
Here is 600.4(a), and I think the closing part I paraphrased is talking about what is in the “shall also include” part. It’s basically talking about the sorts of things Sandy Berger was caught doing red handed (and of course not punished for).

The classified documents found at the Penn Biden Center were from Biden’s time as vice president — and he left office in January 2017.
While it is not clear when Biden started using his private office at the Penn Biden Center, it was likely around the time the center opened, which means the documents weren’t originally at the Penn Biden Center.
So, where were they from January 2017 to February 2018?
Logically, this opens up the possibility that Biden may have selected the Penn Biden Center documents from among the cache in his garage for transport to his private office there, which would contradict his claim that he was unaware that he had the documents and would also cast significant doubt that he is unaware of what the documents contained.
In other words, Joe, you lied on Monday and are still lying to the American people.

Special Counsel for Biden is a DOJ attorney ( Robert Hur at DOJ).
Special Counsel for Trump is a private sector attorney (Jack Smith former US Attorney; but most recently Executive/Litigator at Hospitality Corporation of America).
Why go outside for one investigation and keep the other internal to the DOJ?

The purpose of this Special Council is to find evidence, make what they find disappear and declare that Joke Biden did nothing wrong.
