U.S. Magistrate Bruce Reinhart accepted the proposal from the U.S. Dept of Justice (DOJ) to release, in heavily redacted form, the underlying affidavit used to justify the search warrant issued by Reinhart to raid President Trump’s home in Florida. This is going to be a “process” based case, with respect to handling, access to and storage of Classified materials. The Presidential Records Act is not part of the case other than to establish WHY documents were shipped as well as establish WHY the Archivist opened Boxes.
The legal matter centers upon, Did President Trump follow the correct process in the exercise of his Presidential Authority to declassify materials. Anybody who has ever had to deal with PROPERLY marking and storing classified materials will see it in an instance as they read the affidavit. Also, the FBI is claiming that since the process was not followed, there was UNAUTHORIZED access by persons NOT CLEARED to see them.
Nowhere in this document is the President’s AUTHORITY TO ACT questioned. The document is focused on the President’s PROPER EXECUTION of that authority to link CLASSIFIED Materials discovered to his his order to declassify as well as properly designate which materials were in fact declassified.
If there are; logs, cover sheets, lists, anything to show an item was among those declassified by the President…this turns into a non-criminal set of administrative violations related to proper markings. If the President and his team were sloppy by not following the process linking materials to his decisions to declassify…this can easily be blown into a serious situation.
Also, it is important that the President and Team have packing LISTS for ALL materials sent and received between the White House, his Homes, Archives, et al, especially the 15 Boxes cited in the Affidavit.
In anything dealing with the Government, there is AUTHORITY TO ACT as well as corresponding set of regulations, processes and rules that cover PROPER EXECUTION once a decision is made TO ACT. Even the President of the US is subject to this paradigm. It is even the fundamental basis of the US Constitution.
Hopefully President Trump and his team at least followed the “process” to a minimal level to mitigate this to being technical administrative issue. Plus, they have Packing lists to battle against evidence being planted. Attention to detail is going to be critical.
How can there be a process crime if the President has plenary authority to declassify material as he sees fit?
How can the administrative processes not be mooted by the simple fact that this authority is merely delegated to the agencies for convenience of the Executive and is (supposedly) answerable to the same?

How can anyone run for ANY office while being “investigated” for a criminal case? If he schedules a rally, they will need a hearing in DC with 1 day notice.
