Former police officer Kim Potter was found guilty on two counts of manslaughter by a jury in Minneapolis, Minnesota. After four days of deliberations the jury originally came back with a deadlock. The judge instructed the jury to keep deliberating and try to resolve their differences. The jury came back today and delivered a guilty verdict:
MINNEAPOLIS (AP) — Jurors on Thursday convicted a suburban Minneapolis police officer of two manslaughter charges in the killing of Daunte Wright, a Black motorist she shot during a traffic stop after she said she confused her gun for her Taser.
The mostly white jury deliberated for about four days before finding former Brooklyn Center officer Kim Potter guilty of first-degree and second-degree manslaughter. Potter, 49, faces about seven years in prison on the most serious count under the state’s sentencing guidelines, but prosecutors said they would seek a longer term.
Potter, who testified that she “didn’t want to hurt anybody,” looked down without showing any visible reaction when the verdicts were read.
Potter, who is white, shot and killed the 20-year-old Wright during an April 11 traffic stop in Brooklyn Center as she and other officers were trying to arrest him on an outstanding warrant for a weapons possession charge. The shooting happened at a time of high tension in the area, with former Minneapolis police officer Derek Chauvin standing trial just miles away for the killing of George Floyd. Potter resigned two days later.
Jurors saw video of the shooting that was captured by police body cameras and dashcams. It showed Potter and an officer she was training, Anthony Luckey, pull over Wright for having expired license plate tags and an air freshener hanging from his rear-view mirror. During the stop, Luckey discovered there was a warrant for Wright’s arrest for not appearing in court on the weapons possession charge, and he, Potter and another officer went to take Wright into custody.
Wright obeyed Luckey’s order to get out of his car, but as Luckey tried to handcuff him, Wright pulled away and got back in. As Luckey held onto Wright, Potter said “I’ll tase ya.” The video then shows Potter holding her gun in her right hand and pointing it at Wright. Again, Potter said, “I’ll tase you,” and then two seconds later: “Taser, Taser, Taser.” One second later, she fired a single bullet into Wright’s chest.
“(Expletive)! I just shot him. … I grabbed the wrong (expletive) gun,” Potter said. A minute later, she said: “I’m going to go to prison.”

The video evidence is clear that she believed she was holding the Taser. Her failure to distinguish between the gun and Taser is certainly negligent but it must be accompanied by that conscious act in order to rise to the level of this offense.

In other words, had she used her gun she was consciously taking a risk that the felon could be killed. Reachng for what she thought was her taser would have only incapacitated the felon. No intent, end of story. She acted while the felon was resisting arrest and trying to flee. Worst case, loss of job.
The jury didn’t “get it wrong.” They wanted a mistrial. The judge didn’t want the city in flames. There was no INTENT to use her firearm.
It was determined that if she only had a gun, had shot him on purpose for his actions that day, it would have been legally justified. He was resisting arrest, trying to evade officers and put officers lives at risk. His past criminal record would be irrelevant. The three actions at the time were plenty for a justified shooting.
Fault on both sides.

It’s a thought experiment I run through occasionally. How would we split up the country? The loonies seem to be prevalent on the coasts, while the patriots are mostly in the heartland. That doesn’t seem to be a rational allocation.
Texas is in a good position. We have our own energy resources, and then some. Transportation, as relates to cargo movement, we have air, roads, rail, seaports. Oil refineries, check. We have a technology sector that rivals Silicon Valley. Infrastructure for space exploration is in place. Farming, ranching, natural resources – we got ’em. Heck, we even have our own military, the Texas State Guard, not answerable to the Feds. I’m sure there’s more that escape me at the moment. And I’m willing to bet that we could get Oklahoma to come in. They seem to have a pretty sensible Governor, and I wish some of that would rub off on our own Governor. Sometimes I like to tweak a lib by telling him, “Hey, Texas was its own country once – we can damn’ sure do it again!”
But honestly, I don’t think the thing is doable. Just too much BS to unravel. Emotionally, I’m in the “national divorce” camp, but logically I can see no path to that.

I’m friends with a retired musician. We have little in common. He told me something a few days ago about this case I find hard to refute.

This woman is genuinely remorseful and is tormented by her mistake in grabbing her service weapon and not the taser. But why destroy her? Why send her immediately to a jail cell? Why didn’t the judge allow her on bond pending sentencing – it’s Christmas – the first real holiday since MN lockdowns and social distancing.
Yet not one peep about the deceased – his criminal record, outstanding warrants, TicToc vids where he’s brandishing a Glock, his resisting arrest, resistance in being handcuffed dropping to the street half on the driver seat and legs on the street, his attempt to drive off with other officer still inside the driver’s door which he ultimately did drive off half dragging the officer even though shot. Sorry he’d dead, but he had choices as well and in my opinion majorly contributed to his fateful end. Manslaughter? Yes a just charge. Immediate jail and likely a harsh politically motivated sentence? No.

It seems strange to many, but the Taser is the best tool that has been introduced. Experience going back 40 years with other less than lethal. Blackjack, mace, 4 different nightsticks! Bean Bag Gun. Even had to use other things as a weapon, ie handcuffs. The Taser has limits, but in the old days both Perp and Officer were equally injured many times. When it ends in ground wrestling the injury of Officers goes through the roof. Tasers are used A LOT, and they prevent many Cops from getting injured. Yes, a heavy coat will stop the darts, but you have more crazy Drunks bare chested fighting you than those wearing parkas.
What really struck me about this case is why it wasn’t settled with a guilty plea on a voluntary manslaughter case, given that there was no doubt what happened here, a horrible mistake. Why the the D.A. subject the officer to a trial? Why not plea out and call it a day. Oh, that’s right, D.A. needed a scalp to hoist high. Got it. Agree with the folks suggesting police may want to take a few days off.
I would never want to be a police officer but if I did take that job, I would make sure I knew what i was doing with a gun or a taser, how to use them and the difference between them.
It really is ridiculous to put this woman in a job she was obviously not trained enough to handle. Nonetheless, she took the job and took someone’s life. I am not sure she was in the right in this situation.

That Ms Potter even saw the inside of a courtroom, let alone was convicted on homicide charges, is a gross miscarriage of justice. But were policemen not a typo: male and female; required to be six feet tall — to be athletic — to carry and to be skilled in the use of truncheons — and to be colorblind — such malicious prosecutions as was hers — and such miscarriages — would be few.

I have to agree. I don’t think she is a “bad” person but if you take a job that requires enforcement you have to know what you are doing. It may not be her fault she was there in this situation, except they gave her the job and she took on the job. I am not totally familiar with what happened. Was the suspect armed? Did he rush at her or someone else?
Fleeing arrest is obviously wrong and stupid but taking someone’s life is forever. What a mess. I would tell women, do not take this job. It is not a natural fit for your disposition or physical strength. It will not end well, you will be afraid and make a mistake.
If you don’t know the answers to these questions you need to find out the answers before judging.

Amen to that. It’s quite disheartening to see people’s hatred rise up merely because of someone’s race. Blame the individual. I’m pretty sure racists won’t make it into the Kingdom of God.

I’m always curious how a person can be found guilty of both 1st & 2nd degree manslaughter when they only kill the 1 person, 1 time. I understand the circumstance where a lesser charge is available to the jury if they can’t reach the higher bar. But to be found guilty of BOTH is, to me, seriously dorked.
I hear that the White House is going to bring in a bunch of singing Police officers to sing and dance next week….

Long story short if someone kills me accidently in a traffic stop, I’d hope they are found guilty and not walk free just because I have a criminal record, am Black, and the person who killed me has a badge.
I am thinking that while I have only read thru the first page & now just started the 2nd page, that so many here have decided to unduly berate & insult ALL Minnesota folks in the state, for the actions & behaviors of a certain group of folks who live here. ( The saying,”Judging the book by its’ cover”, comes to mind.)
I can only say , Shame on You”, for it, since I was taught Not to be overtly rude to others in most cases.
(or, as My Southern born & bred Mother(RIP) would say, “Bless your hearts.” for it.

I say , Shame on you!”, while thinking you deserve more than that, from me, at least, let alone countless others who hold the same conservative values here in MN, but I would likely get kicked off of here for saying what I “really” think of your disparaging comments.
Regardless, let me assure you that in the majority Blue( Progressive Liberal) zones of the MN larger cities & urban areas like Mnpls/St. Paul, Rochester & Duluth, that many might fit into some of the “mental picture” of what some of you think the folks in Minnesota are made up of, as far as your comments/descriptions.
I assure ya that out here in “Greater Minnesota” you are Nowhere near being correct in your Assumptions. “If”, you had more experience in knowing who lives in MN, and Where…
You would find that in the majority of the state of MN in the suburban & rural areas are CROWDS of Conservative folks in the majority, who, like myself, would likely not be so polite were you to say what some of these comments have said, to our faces, in person, rather than from a keyboard far away.
Let me end with this…
Some polite advice…
No matter the place in the world, If you do not LIVE & spend a LOT of time there, should you consider commenting/communicating like you know everything about the people & the place without that experience,
so I would recommend you should consider keeping your hands off the keyboard, and your mouth closed when & before you think about spouting your UN INFORMED opinions, as there can be consequences for making Mistakes that can be uncomfortable & embarrassing.
(Particularly directly to someone who lives there in person. Those consequences might be a lot more uncomfortable, if ya get my drift.)
I am suggesting ya “Use your head for more than a hat-rack” , THINK before you speak or act. It will keep ya more comfortable.
Now on to other, more pleasant things…
