When New York’s original vaccine mandate for healthcare workers was announced, it included an exemption for religious reasons. However, when the administration changed hands, Governor Hochul removed the religious exemption. A lawsuit was filed. A federal appeals court loss brought the plaintiffs to the Supreme Court requesting an injunction.
Today, the request from the 20 plaintiffs was rejected by the Supreme Court as referred by Justice Sotomayor who covers the New York region. Justices Alito, Gorsuch, and Thomas dissented and would have provide the injunctive relief. However, Chief Justice John Roberts, Amy Coney-Barrett, and Brett Kavanaugh sided with the liberal wing and denied the request. [Full pdf Decision Here]
Thomas, Alito and Gorsuch wrote in their 14-page dissent that Governor Hochul’s record in the case “practically exudes suspicion of those who hold unpopular religious beliefs,” adding, “That alone is sufficient to render the mandate unconstitutional as applied to these applicants.”
Unfortunately, the alignment of Justices Roberts, Barrett and Kavanaugh with the left wing of the court makes future constitutional appeals around the vaccine mandate look increasingly tenuous. Justice Kavanaugh and Justice Barrett have been big disappointments.

Unfortunately, the US Supreme Court has a sad and sorry history which the current justices are following. Recall: the decision in Dred Scott v. Sandford (deciding Congress had exceeded its authority in the Missouri Compromise-no power to abolish slavery and the US Supremes ruled African Americans were not and could never be citizens of the US), -Korematsu v US (US Supreme Court ruled that it was acceptable to inter Japanese Americans born in US in internment camps (like in Idaho) in the US during WW II), the Marshall Trilogy of cases wherein Native Americans only had right of “occupancy”, not title, to land and thus could not convey fee title to anyone else. Thus far, the mostly spineless Supremes have shown their true colors in their failure to address obvious constitutional issues in the election fraud cases which deprived us of our vote in the 2020 US Presidential election.
This is a defunct ruling. If this is a fault of the individual Justices
or deliberate ignorance of essential facts remains unclear. All
Justices failed to treat and incorporate the Nuremberg proceedings on
medical experimentation, either to discard these or take these in
consideration. The Justices did not consider the questionable FDA
paperwork on the “approved” COVID-19 vaccines. The Justices failed to
mention that medical definitions of pandemic, vaccine, natural immunity
and herd immunity, as they were valid at the time when e.g. the
smallpox vaccine was administered, have in recent days and months been
changed. These definitions have somehow become a ‘living’ document.
Justices also failed to mention that the “approved” COVID-19 vaccines
are a explicit non-conventional approach and unchartered territory in
solving a pandemic. In addition no mention was made that according
vaccine manufacturers a, still to be determined, number of additional
booster shots are needed, which puts the whole health care approach of
solving the current pandemic on a tilted plane of ice.
Trump was such an idiot to place so much faith in mcconnel. The fact that he chose to continue to try working with that piece of shit instead of calling him out and accepting open warfare is heartbreaking.
