Kyle Rittenhouse shot and killed Joseph Rosenbaum and Anthony Huber as he was being attacked by a raging mob. Rittenhouse, also fired on Gaige Grosskreutz as the attacker held a handgun toward him. Prosecutors claim that Rittenhouse was a vigilante looking for a fight. The defense, and all video of the events, show all shootings were justifiable self defense.

Binger has to be the most incompetent prosecutor I’ve ever seen. He didn’t prep any witnesses, keeps back-talking the judge, and manages to get his own witnesses to testify to information that damages his case. He even called pixels “pickles” the other day when trying to convince the court that zooming in too far can’t create image artifacts that aren’t really there (it most certainly can).
He needs to find a career that fits him better, like circus clown.

However, the fact is the defense has already requested that the defendant have his case dismissed with prejudice (Or maybe the term is without prejudice) Dershowitz spoke of this yesterday. If it is dismissed in that manner, he can NOT be re-tried – ever.
WITH prejudice means they can’t retry him. WithOUT prejudice leaves the door open for another bite at the Apple.
The standard for dismissal with prejudice (no do-overs) is that the prosecution was intentionally trying to generate a mistrial to get another shot at it. So if he was doing that (and it kinda looked that way), he wouldn’t get another shot at this.
That said… it probably won’t happen. Usually you just get an adverse jury instruction of some kind out of it. With all the sass he gave the judge, he might end up on the losing side of the arguments over the jury instructions that will happen next, so we’ll see.

It’s time for the judge to issue a directed verdict, with prejudice. Everything that has been presented, by both sides, aligns exactly with the legal definition of “self defense.” There is simply no other plausible interpretation.

Much as I’d like that, there are subjective elements that will be left up to the jury. I really hope they get proper jury instructions that mention WI law, especially the part where fleeing is a way to regain innocence after provoking someone. The standard jury instructions are terrible and don’t even mention that part of the law.
I do think that the charge of possessing an illegal weapon ought to be thrown out as a matter of law, though.
Whether or not you “possessed the weapon illegally,” by virtue of being less than 18 years old at the time, the key issue of this case is “what you actually did, and why.” You’re not being charged with illegal possession of a firearm – no, not really – you’re being charged with murder. And there is very simply no justification for any such interpretation of your actions … when two people grabbed the barrel of your rifle before you shot them, and the third person whom you inexplicably decided to spare was pointing a pistol at you. That’s the essence of this case. If either of them … if any of them … had succeeded, Kyle would have simply been “an unfortunate corpse.”
When Kyle had no remaining alternative, he shot them dead, because at this point there was literally nothing else he could do. And yet, he spared the life of a third. He didn’t move his rifle by a fraction of an inch and fire another shot. (As I most-certainly would have done …)
Any “vigilante” would not have given a damn who or what he shot at. Per contra, this young man was entirely selective. Such a person committed no crime.

The problem is that the law has a ‘reasonableness’ standard the judge can’t decide without the jury–that’d be a reversible error.
In a more reasonable world, no charges would’ve been filed against Kyle and Zimminsky, who fired the first shot, would be tried for felony murder.
The judge can make a directed verdict that the prosecution didn’t prove their case and acquit the defendant before the matter goes to the jury.
I think a discussion of directed verdicts, Wisconsin law and prosecutorial appeals would be beneficial. I got into the code a bit and got a headache so quit.
Acceding to a defense motion to dismiss with prejudice forecloses appeals AFAIK and I believe that motion is on the table already.

I still stand by my opinion that a directed verdict is appropriate. “Mistrial with prejudice” is a less satisfactory alternative. A jury is supposed to become involved when both the prosecution and the defense have succeeded in raising “a judicial controversy,” between which two alternatives the jury must then decide. But there is simply no such controversy here. The prosecution has not managed to offer anything which would plausibly suggest that this young man was a “vigilante,” wandering through the streets looking for innocent people to kill. However, they certainly did present three people who were determined to kill Kyle!!
He never fired a single bullet until he had no choice. He killed two of them because their own actions left them no alternative but to die. And yet, he spared the life of the third one! ? How very easy it would have been to shift the barrel slightly and squeeze the trigger just one more time … “problem solved!” … who could have faulted him for doing that?
Juries are “finders of fact”, they are not there to decide upon questions of the law.

And yet today “Leave it to Binger” got an enhanced FBI drone video introduced into evidence AFTER Dr. Black testified the image is changed by the software program to enlarge the photo from that video. Binger’s ‘expert’ could only say “I do not know” a dozen times on cross. The image is supposed to show Kyle pointing his AR-15 at presumably Rosenbaum after Rosenbaum or someone shot into the air. The prosecution ended the day submitting that photo into evidence and saying it proves Kyle is a liar.
The enhanced, enlarged photograph really didn’t show very much.

I think the idiot Binger was claiming that Kyle put the fire extinguisher gently (as opposed to dropping it) on the ground and then turned and pointed his weapon at Ziminsky. The trouble for the prosecution is that they never gave an explanation as to why Kyle would suddenly just decide to train a weapon on the man after he had initially just run past him. The only reason Kyle would have had reason to raise the gun was because just as he passed Ziminsky and was stepping to the car to put out the fire in the back seat, Ziminsky yelled out for someone to “get him and f’ing kill him”. Mere seconds later Rosenbaum came charging after him. I guess if I suddenly heard someone calling for my murder, I might become startled and raise my gun, too.
Ziminsky should be tried for the death of Rosenbaum. He’s the instigator.
The defense needs to get a computer graphic artist to explain again how an image is changed by software and how it can degrade image quality or alter how the image will look to the average person. Graphic artists who work with computers know the answers to the questions that the judge and all the lawyers were stumbling over. However, it might be too late for that at this stage.

Mike Robinson I agree — and you make important distinctions. In An’s 2 posts, s/he made (also good points) that if would have to go a jury because of “subjective elements,” a jury would need to decide, and later elaborated that there’s a reasonableness standard. Now, I’m inferring An meant the “reasonableness” standard is the subjective piece — but it’s not. Reasonableness is objective.
I believe someone made the point that once you flee, that erases any intitial “provocation.” Absolutely NO ONE denied that Rittenhouse fled. He was trying to get away. He even told Huber he was going to the police (doesn’t matter if Huber didn’t hear it … this is RITTENHOUSE’S actions we’re looking at here). There may be other factors of “reasonableness” — but point is, they are objective, not subjective.
So the distinction I think MR is making is that “reasonableness” isn’t necessarily something for the jury to decide, so this issue is there’s any other matter of factual dispute or controversy. One quibble with your point Mike Robinson is that juries don’t settle matters of law, or “judicial controversies.” Judges and courts settle matters of law. Juries decide facts.
So, the question for directed verdict — much like a summary judgment motion — is whether the prosecution has presented facts which, if true, are enough to satisfy the elements of the crime. The “if true” is key — because the standard is that even if every fact the prosecution is true as presented, the facts STILL don’t constitute a crime.
That’s where we get back to the legal standards, one being the reasonableness of self-defense. I don’t think the prosecution offered any uncontested fact that is not consistent with self-defense. It’s not subjective. But if prosecution put on a witness that contradicts that Rittenhouse was chased, beaten, tried to get to police, etc., that might create a factual controversy. But I don’t think they did.

I agree. Nothing for the jury to decide. The prosecution did not prove absence of self defense by a reasonable doubt, and no reasonable jury could convict Kyle of murder. typically it is not legal for a minor to have custodial possession of a firearm…as it was stored long term at his friend’s house this does not apply here
WI law allows a 16 and 17 year old to possess a firearm without an adult present depending on circumstances and certain exemptions. From what’s been presented, it doesn’t look like he was breaking any laws. I believe that charge was probably slapped on him because they had initially thought he had carried it across state lines. Remember, these clowns didn’t even bother with preliminary investigations to determine much of anything before becoming politically activated.
People carry firearms across state lines all the time especially in New York, New Jersey and Connecticut where the three states are within miles of each other for hunting deer!

I sat on a jury once, it was embarrassing and a circus. Changed my thinking on juries. One lady wanted to get home so she could fix her husbands’ supper. Another lady didn’t want to drive at night so we had to hurry up, and another man kept falling asleep. We have a man’s career and life in our hands and not everyone took it seriously.
In cases like Kyle’s I am not convinced someone won’t be paid off. Everything is so corrupt and crooked.

When I was a kid, many many years ago, there was a case where a man with no criminal record went into a public restroom where he came across another man in the process of sodomizing a young boy. He was enraged and went after the boy’s attacker. In the ensuing fight pedophile was killed. The police arrived and investigated thoroughly. The man was released on his on recognizance and told not to leave town without notifying the police. A few weeks later the man’s lawyer contacted him and told him to report to a courtroom at a certain time and day and not to worry. When he got there there was the DA, the judge and his lawyer. The DA announced to the judge he was bring charges for murder against the defendant. The man’s lawyer agreed to a trial before the judge without jury. The judge then asked the DA to present his case and the DA said he had no evidence. The judge then declared the defendant not guilty and order him released. Afterwards the DA and his lawyer explained that the trial was done so there could be no further legal charges brought against him over this incident in the future. Maybe this trial is something like that.

When you zoom in electronically the image does become blurry, the image is cropped and information is added.
Digital zoom does not increase detail of the original image. The image is cropped, then enlarged to fit the original size, then pixels are calculated and inserted. Various calculation methods are used to manufacture the additional pixels.
Digital zoom becomes blurry because of accumulated errors. Interpolated pixels are added, zoom further and those interpolated pixels are used to generate new interpolated pixels. This process happens repeatedly, each iteration becoming less reliable.

The prosecution successfully shamed the judge into not requiring they meet their burden of proof that the doctored photo would be a “fair and accurate” depiction of the event.
Any technologically altered or “enhanced” photo can be challenged to put up evidence to meet that burden. The prosecution wasn’t expecting to have to. Their photo guy admitted he had not idea what was added to the photo. So the prosecution’s second-chair basically deflected their own incompetence by literally telling the judge he was too tech-stupid to understand it. And the judge agreed and let it in. Not one of the finer moments of an otherwise decent judge.
Having watched the shooting footage several times, I can’t help but feel that someone was on Kyle’s side. I have friends who are military and law enforcement, and both have said the shots he took from the ground shouldn’t have been possible. ‘Dumb luck’ perhaps, but I don’t believe in such things. Someone above had a hand over him.

I’ve cried and prayed for that young man since the moment the news hit the internet. Not a day has gone by where I haven’t thought of him, and often cried for him. Seeing him break down nearly broke my heart.
I keep thinking of that sad scene when he went home and told his mom and sisters what happened before he turned himself , it must have been so heart wrenching and confusing, he was pepper sprayed, beaten up , probably hungry, I can’t imagine what he and his loved ones were going through.

Kenosha is 87.8 % White, 13.5 % Hispanic. So the Jury aligns along racial lines.

I have spent this week with a head cold which nowadays results in being banished and unable to go about your daily work activities to the extreme.
So I’ve been able to watch an enormous amount of the two trials currently ongoing in Kenosha and Brunswick.
It’s obvious that Kenosha needs a larger courtroom an ethical DA and the ability to utilize technology in a smooth manner. Kyle should be walking down the courthouse sidewalk sometime Tuesday.
The Brunswick 3 are going to face a different outcome later this month. The bell has tolled for the old boy network in Glynn county. DA Jackie has been removed and indicted. A new out of state police chief has been hired since this murder occurred.
