Arizona Republican Chairwoman Kelli Ward provides an update on the Maricopa County ballot audit and the new subpoenas sent by the state senate to county election officials who are refusing to comply voluntarily with requests for information.
The second hand count of the raw ballot totals was completed earlier today. Mrs. Ward walks through the content of the subpoenas and the purpose for them.

At the same time Arizona is wrapping up the ballot counting phase, it appears the Lawfare group is writing legal guidance on behalf of the DOJ. A seven page memo, with no official legal standing, was released today by the DOJ in an effort to intimidate any state or local officials who are conducting audits. The memo [view pdf here] looks like it was generated from within the “beach friend” community of Lawfare, the assembly of former DOJ members who are rabid political ideologues.

Dr Ward is not in charge of the audit. She is the State GOP Chairwoman. The audit is a function of the AZ State Senate and the Senate President, Karen Fann, is in charge of it. So before you start jumping all over someone, at least try and inform yourself as to the facts so you know what you are talking about.

Back in the day when I was an auditor, when the auditee did not provide the information we requested, we wrote in our report that their was a “scope limitation.” Which meant we weren’t given the information requested to complete the scope of the audit as planned. We still wrote our report with the facts we were able to obtain and verify.
I think on how many times the ballots have been counted in the AZ audit. My gut tells me not obtaining the router information is a decoy to distract from what information is available. I want the info on the ballot counts. And I pray they are coming.

I’m confident that everything the Audit team collects and reports, will be presented. This clearly isn’t similar to a pre determined, Fed managed, fallout containment operation.
I suspect you may be right. Even if the equipment, passwords, logs, etc aren’t recovered(or spoiled), any other significant impropriety that affected the election in a decisive way, will raise serious doubts re the outcome.

IMHO, the bulk of the tampering which directly affected the outcome of the election was done inside the vote tabulation centers located in the large Democratically controlled urban areas of the swing states, and was done by the tabulation staffs working in those counting centers.
A variety of methods were used. But the most effective way to do it quickly if Trump is winning in a landslide would be to run the same ballots through multiple times — including those which had to be delivered to the tabulation centers after midnight because the pre-staged fraudulent ballots on hand inside the center weren’t enough to close the margin with Trump’s count.

Having also been an auditor myself, in the areas of software QA and software configuration control for automated records management systems, the items being withheld by Maricopa County are key to determining what kinds of actions and events happened as the vote management processes for the 2020 election cycle moved forward through time.
Detailed knowledge of those actions and events is necessary to connect the dots among other pieces of evidence now in the auditor’s hands which would indicate whether or not criminal vote fraud might have occurred.
The audit cannot be a true end-to-end forensic audit if the splunk logs, the network logs, the routers, and the images of the mail-in envelopes aren’t being supplied by the county and therefore can’t be fully analyzed.
I don’t think Maricopa County will hand over this material, leaving the auditors and Karen Fann with a difficult choice to make.
How does the audit report read? Does it explicitly state that criminal activity might have occurred, or does it instead lay out the evidence that is available — knowing it is incomplete because of Maricopa County’s refusal to cooperate — and then leave it to other state agencies to decide whether or not a criminal investigation is warranted?

The DOJ “Guidelines” issued today are an outright threat to the Az Senate an other states contemplating an audit.
As Sundance has clearly pointed out, Lawfare composed these “Guidelines” and issued the document to coincidence with the Az Senate hearing scheduled next Monday.
I expect the Board of Supervisors will use some of these “Guidelines” to avoid turning over the routers, logs, passwords and voter files.
Further, the “Guidelines” appear to severely impact the ability to perform canvassing registered voters without Civil Rights complaints.

If there is any “legal analysis” to be made here, it is very simple: all of these people are state employees, and the Arizona Legislature is their penultimate boss!! The Senate – the Legislative Branch – has every right to ask questions about these people’s job performance … or, lack thereof.
Furthermore, the Legislative Branch has all the legal powers of the Judicial Branch, and then some. It can send out its Sergeant-at-Arms to detain you and bring you before the Committee … handcuffed to the table … there to testify under penalty of perjury. It can hold you in criminal contempt … of itself. The Legislature really is “a Fire-Breathing Dragon,” if and when it wants to be. Most people understand that Dragons are best left alone . . . ?
