In the Atlanta ballot lawsuit Henry County Superior Court Chief Judge Brian Amero has granted the ability of Fulton county, the county elections board, and county courts clerk, as offices, to be removed as defendants in the lawsuit filed by Garland Favorito and nine plaintiffs. However, Judge Amero kept the lawsuit alive by granting the plaintiffs’ request to add individual members of the county board of elections as respondents.
The problem this presents is transparent. The next move by Lawfare lawyers representing opposition to the case will be for each of the individual members to now claim sovereign immunity as none of their specifically individual actions will be identified as contributing to any ballot fraud. This level of legal confidence seems present in the defense statements after the ruling was released:
“Don Samuel, an attorney for the Fulton elections board, said he planned to file motions to dismiss the claims against the board members because there are no allegations they had a role in counting the county’s ballots.” (link)
Favorito released a statement showing confidence in the result. However, CTH is not so sure.
Perhaps the plaintiff lawyers have a good argument to focus on the individual board members, but in my experience any petition therein would have to show direct evidence linking a specific person to the specific harm claimed by the plaintiff.
If the Fulton County board of elections is not responsible for the way the ballot counting was handled, it seems challenging to identify a specific member of that board who would be responsible. I’m not a lawyer, but that’s the way the defense argument seems to be framed.
The bottom line in this private civil lawsuit is the harm needs to be identified in order for the discovery, the actual inspection of the 147,000 absentee ballots, to be conducted. The plaintiff is alleging harm based on the sworn depositions of election workers. However, the defense is telling the court that a specific person will need to be identified as responsible for the alleged fraud the election workers are claiming to have witnessed. This is a typical Lawfare catch-22.
The solution for this is obviously the Georgia Senate ordering an audit of those ballots via a legislative subpoena. However, it doesn’t appear the Georgia legislature has taken any steps toward that goal.
I may be wrong, but I am less optimistic now than before.
In simplest terms, it means the fight goes on. At some point the whole mess starts to unravel, but for that to happen, resistance must be maintained.
We are rapidly approaching the point where any audit result will have no effect on the next election cycle.
They will drag it out as long as they can whereby the results have no consequences.

In cases like this, where a “committee” has oversight responsibility in a shared or distributed manner, there should be a legal principle that it is only necessary to demonstrate that someone failed, because they share responsibility and each member has the obligation to ensure that others in the overall process are performing in accordance with law. Basically, the court needs to rule that SOMEONE MUST BE ACCOUNTABLE, and ALL OF THEM DO if no one otherwise seems to.

Is there credible evidence of fraud?
Sworn affidavits should be credible enough to warrant a hearing before a judge.
If the defendants say no crime, no harm, no lawsuit, then the plaintiff can say “credible evidence requires an answer. We’ll drop the case if there is no fraud, because the defendants would clearly be without criminal act.”
However, the plaintiffs must have the chance to prove fraud, and that can only be done via an audit. The audit is THE determinant of fraud or fairness–and ONLY it. If the judge says it’s up to the legislature, then the plaintiff can say, “the state law says any election can be contested provided the contestor posts a bond to cover the cost.” (Surely the state law has something to that effect.
If the above, then the plaintiffs will have to either convince the legislature to become a party to the suit or simply promise a timely audit, or they have to solicit funds from the citizens to post the bond and perform the audit.
But, no matter how it’s argued, there should be a direct path to audit if the judge is not crooked.
It would only be just to add the rider that if fraud is found, the plaintiff intends to treble damage claims for defendant intent as well as rope in the offices just exempted for same, plus referral to criminal proceedings for RICO and civil rights violations by intent to disfranchise.
Yes, they previously were given access to the low-resolution ballot images and found something like 20% were duplicates. That was one of the main reasons the judge ruled to allow ballot inspections a month ago. Then the defendants filed motions to dismiss, that the wrong parties were served, etc.
Garland served everyone, and let the judge figure out who the proper party to sue is, which he did today. Georgia’s sovereign immunity laws were changed earlier this year, which made it more complicated.
The defendants have already admitted to violating the judge’s protection order to go “check on the alleged pristine ballots” themselves, maybe that will be spoliation of evidence?

I am encouraged because the judge could have dismissed on sovereign immunity anyway, but then – after the defendants violated the judge’s order – he decided to continue. I agree with you that stripping any attorney associated with disputing the legitimacy of 2020 election of their license (aka livelihood) is something all lawyers and judges would take note of. We have to remember – those who perpetrated fraud know what will be discovered. So yes, making Giuliani a spectacle right now (in my opinion) is an act of desperation!
Seems to me Favorito should going after Frances Watson, Chief Investigator for the secretary of states office for sending investigators to secretly inspect ballots when Judge Amero had previously signed a protective order over the ballots in January. The protective order over the ballots should restrict anyone, including the SOS office from accessing and inspecting ballots. Also should file on SOS investigators trying to get the whistleblower to recant her affidavits. Beginning to wonder if the judge knows what he is doing or is faking not knowing what he is doing.

From what I know, a person representing the government is normally named first along with the government entity. If the person/s were acting in accordance with the law and policy, the names will be removed / replaced by the government entity. However if the persons are determined to be criminally negligent in their duties by knowingly not complying with the law or policy, then they stand alone in their defense. I am sure the training they received did not comport with their actions, but if it did then the government wold carry the liability. This could be the beginning of the internal pointing game.

It appears quite evident that getting any support from the judicial side is at best a stalemate which is a win for them, the offenders. I’m beginning to think that the offenders act with impunity, or have some sort of immunity granted to them by their masters. We however will be treated to the full extent of the law. The scales of justice are heavily weighted against us. The country is in a very precarious position.
I’m in agreement that this is shot for a few other added reasons. Even if they could somewhere somehow get the judge to bite on discovery you’ll still end up with a situation of no relief being available. The judge can’t do what the Senate is abdicating on, it’s impossible from a legal standpoint.
Additionally… And I’ve no idea why everyone is avoiding this elephant in the room but. The Georgia legislators shot an audit into oblivion with the “voter integrity / ID act” they passed a few months back.
It made it illegal for anyone besides a state / county certified individual to physically touch a ballot… This is where the “digital images” issue comes from.
Post election the legislators basically gathered all of the Intel possible on the best ways to find fraud / audit ballots (Pulitzer by example) and made sure no one could possibly do that going forward.
If the Senate committee did magically issue a subpoena tomorrow, those ballots would be limited to digital images in inspection or be audited by the state and counties themselves.
I found the right’s celebration of that bill to be oblivious to what It did… And found the left’s to be fake opposition for the same reasons. Closed door I’m sure it was high fives and congrats!

Subcontracting is another one of a 100 things that leads to election corruption in Georgia and other states and needs to be addressed though legislation and ended. However when all things are considered those 100 things have been known issues for decades and kept in place… Why? If you haven’t figured it out in 240+ years of voting, it’s by design.

No. The sovereign immunity defense is, essentially, “You can’t sue me for that no matter what I did.” A sovereign immunity defense could prevail even if a specific wrongful act/omission were identified.
This is not to say that the Lawfare guys won’t try to get the individual defendants out on exactly the grounds you describe. It’s just that that argument would be the “It wasn’t me!” defense, not the sovereign immunity defense.

Panama. If you are retired it is the best place. The Pensionado visa is not expensive and has many great benefits. The people are multi racial, but are not being agitated the way the media is doing in the U.S. I highly recommend.
