On its face Twitter is suing Texas AG Ken Paxton for targeting them with inquiries into their practice of censorship and deplatforming. The lawsuit baseline is essentially (and ironically) because Paxton is a government official, Twitter is claiming their ‘first amendment’ right to control speech on their private platform is under attack.
However, you might ask yourself why Twitter chose Paxton and not Florida Governor DeSantis or any other government official who is doing essentially the same thing as AG Paxton with their efforts against Big Tech. ASSOCIATED PRESS – Twitter has filed a lawsuit against Texas Attorney General Ken Paxton, claiming the Republican used his office to retaliate against it for banning the account of former President Donald Trump following the riot at the U.S. Capitol.
Days after the deadly January insurrection, Paxton announced an investigation into Twitter and four other major technology companies for what he called “the seemingly coordinated de-platforming of the President.” The attorney general’s office demanded that the companies produce a variety of records related to their content moderation policies and troves of internal communications.
Twitter responded Monday with a federal lawsuit alleging Paxton is seeking to punish it for taking Trump’s account offline — a decision the social media company says is protected free speech. It asks a judge to declare the decision to be under the ambit of the First Amendment and to, in essence, halt Paxton’s investigation.
“Paxton made clear that he will use the full weight of his office, including his expansive investigatory powers, to retaliate against Twitter for having made editorial decisions with which he disagrees,” lawyers for the company wrote in the suit filed in a Northern California court.
Spokespersons for Paxton’s office did not immediately respond to a request for comment Monday evening.
Twitter’s counterpunch comes as states, in addition to federal lawmakers and governments outside the U.S., are cracking down on tech companies they see as having amassed too much power in the past decade. This includes antitrust and anti-monopoly regulation, internet privacy laws as well as attempts to regulate how platforms like Twitter, Facebook and others moderate their sites. (read more)

Twitter should be sued for breach of fiduciary responsibility. Twitter is not a “private” company so to speak. They are a publicly traded company and as such the executives and board have a duty to the shareholders. Twitters market value is based on its users and user growth. Eliminating the very user’s who contribute to your market share is a breach of fiduciary responsibility to your share holder. Look no further than what has happened to twitters share price since this has started happening.

Paxton has been a target of the left for some time…however, I can assure you that over the years Dims in Austin thanks to the late Ronnie Earle and local media went after anyone on the right who they perceived a threat. Since his demise, someone else in Austin has picked up the baton and presses forward against Paxton.
The specific charges are unknown, yet given the history of targeting, the charges are trumped up.
Does Paxton have to be involved personally in the Twitter or other actions under Texas law, or can he delegate whatever authority to a deputy AG?
While the prospect of that makes me think of the Jeff Sessions recusal mess, there may be other ways to handle the legal matters and continue to hold Twitter and others to account.

Paxton was also responsible for “outing” the Supreme Court in December as parties to the election fraud. When the TX lawsuit was tossed, that was the definitive end of the Left’s ability to cover up the election as legitimate. Their entire strategy rested on a quick declaration of Biden as the winner, and the entire establishment giving Biden a hug. Paxton’s lawsuit revealed the Supreme Court, a bunch of RINO Republicans (e.g. Jeb Bush mocking it), and naturally the Democrats/Media as totally and irredeemably corrupt. It also outed SEVERAL justices as Manchurian Candidate justices like Barrett.
An immediate casualty in the aftermath was the destruction of the two RINO GOP candidates in GA. Nobody after the TX lawsuit had any reason to believe (assuming they still had one) that the GA election would produce legitimate results…or that if fraud was uncovered that we would have any legal recourse.
In short: Paxton’s lawsuit burned the tattered remnants of the Official Government Party’s “two party system” fig leaf.
Paxton is at least partly responsible for the Official Government Party being outed once and for all. So, there’s an element of revenge to this as well. And by outing the American Justice System as fully-corrupted, he’s got a target on his back in many courtrooms which are infested with Leftist judges itching to “Emmet Sullivan” him.

One last jab: Twitter filing a First Amendment (“Freedom of Speech”) injunction against Paxton on the basis of wanting to silence the free speech of others is ludicrous. While the Twits say they have the right to censor, but complain about state governments penalizing them on First Amendment grounds, lays bare their utterly compromised Section 230 status. If they’re going to say they have editorial rights, they’re publishers by definition and therefore not eligible for Section 230 exemption. The Court should throw that suit out.
But, since November, we’ve been saying “the Court/Judge(s) should…” and have been disappointed and shocked that Courts and Judges have failed in almost every instance to follow the law and the rule of law.

I’ve got a general question(s) here. I am a member of a private message board of Alabama Athletics. This website requires a $48 yearly subscription. We get tons of information and have several discussion boards. The discussion boards have rules on what can and cannot be posted. The discussion boards are moderated by the owners and they remove posts that do not conform to their guidelines.
Twitter is free. Anyone can join. In fact, they WANT you to join because they make money by selling access to you thru their website to businesses.
So, how can Twitter retain the right to suspend or remove a member when any of the 6 billion people on earth can join freely, requiring ONLY the information that they sell access to to thousands of businesses that pay them for that access?
If Twitter claims first amendment protection for how they regulate their board, how can they turn around and declare that the members have no first amendment right? Individuals have first amendment protections. Do businesses? How can a business restrict first amendment freedoms on individuals who are NOT employees while claiming the company can NOT be restricted?
I think I know what the answer to the first question, but I don’t know about the second question.

One of the many gems of wisdom that Rush Limbaugh shared with his listeners was that, during the IRS scandal that happened in the Obozo reign of terror, where Lois Lerner obstructed conservative 504 PACs from getting their nonprofit status (which impeded their ability to raise funds), was that Rush opined that looking for a paper trail of orders coming from Obozo or one of his minions to authorize Ms. Lerner…was NOT going to be successful because such hard evidence likely did NOT exist.
Rush reasoned that no such written orders or even telephonically transmitted orders were non existent because…. the people among the Left, certainly among Obozo-acolyrtes – all had the same understanding of who was their enemy and thus who had to be stopped, or obstructed, or “resisted”, regardless of the legality in so doing.
Rush claimed the Left’s minions all mostly thought along the same wavelengths, so specific written orders to take specific actions against conservatives – their political existential enemies – was unnecessary.
I would argue that the same parallel thinking exists among the media, the DemoCommunists, Big Tech, and every other organ of power or cultural influence here in the Un-united States. So an investigation might find bias everywhere as did IG Horowitz, but nothing specific enough as to identify a particular source of authorization….
Parallel thinking – no written orders – they all think the same – they all know what to do…….what a key to success!

In my bluer than blue state of IL there is a law prohibiting social media from using the ability to identifiably”tag” someone’s image on their platforms(s) without consent, no matter what they write into their “terms of use”. A user filed a class-action suit against Facebook under the law and actually won the case. Shockingly, our AG at the time also backed up the suit. And by legal standards the case was settled in a timely fashion. Facebook “settled” rather than go to court. We are now in the settlement final approval stage and just waiting for our payouts. Per the last count of class members who joined in the settlement it could be more than the pennies that we usually end up getting from these suits. AG Paxton won’t back down.

If the company for example encourages you to join for free on their speech platform, so that they can use information that belongs to you and sells that information for a profit, and then edits, blocks, or deletes your speech on their speech platform they are no longer a speech platform but and editorial platform.
They are not covered by Section 230 anymore.

If they said you can join but we can screw you out of your belongings and then restrict your right to post your speech.

I don’t use social media. I choose sites/communities where I want to read and comment. Just sayin to another Treeper, I made a cost/benefit analysis re social media. No matter what the math was, social media was just not something that ever was an acceptable option. I have protected free speech on the CTH. Its enough for me.

To sue a prosecutor who is investigating you means two things: They want to discover the evidence against them and they want to divert money and resources away from their investigation. Jack Dorsey should be arrested for Obstruction.
So, they’re suing to protect their free speech right to infringe on everyone else’s free speech rights … makes perfect sense.
And so, community standards against hate speech are basically, “What you are saying upsets me, so I hate it; therefore, you are using hate speech and are banned from my site. I’m taking my marbles and going home, so there.”
Has Twitter forgotten that Texas is under the 5th Circuit Court of Appeals and not the 9th Circuit yet the company is suing a Texas Attorney General in a Northern California District Court of all places?
9th circuit has no standing is what the State of Texas should tell Twitter.

The media also forgets to remind the public that they are all taking advantage of Section 230 of the Communications Decency Act. They cease to be publishers when they censor or remove content and should be liable for anti-trust lawsuits. Can’t have it both ways.
