My comment wasn’t at all that he was late or behind, but solely that Sundance does a fantastic job putting posts together and that takes more than a handful of minutes. If a post on it were coming I wouldn’t expect it right after news broke, not even counting all the other demands on his time.

Idaho, Alaska and Az. just filed a brief, thst responds to a potential argument I had hypothesised the othrr side could make; that the STATE legislatures have the authority to detirmine how electors are selected, but that they can’t be forced to by other States or SCOTUS (essentially).
It invokes the “Guarantee clause” of the Constitution; all States are GUARANTEED a Republican form of government, which means one where the people elect their representative form of government.
So, that answers that questiin, at any rate.

THis TX lawsuit is NOT a suit that alleges fraud or purports to prove it, not at all.
I mean there is only one reason why you would try and change the law through extra legal measures and reduce voting security… I think they are trying to keep the argument purely theoretical law because the lower courts refused in almost every case to hear the evidence necessary for the court to make a ruling on the actual fraud vs the circumstances that enabled it.
I don’t know about other states, but in Georgia only the Governor can call for our state Legislature to open a session and the sold out commie Governor Brian Kemp will not do so. So our Legislature sits at home howling at the moon.

The overlying fear I have, is that the SCOTUS may agree with the argument that the legislature has authority to determine the rules, BUT they should have exercised that responsibility BEFORE the voting! 1. The Pennsylvania executive and judiciary has validated to the state legislature that the election was valid and legitimate
2. The Pennsylvania executive and judiciary were responsible for changing election law prior to the election; therefore they are conflicted, biased and not capable of rendering an unbiased certification of the most recent election
3. Texas has looked at the evidence and disputes the conclusion made by the Pennsylvania executive and judiciary branch and has concluded that the election was fraudulent and therefore invalid
4. Texas is sending a slate of electors to vote for President Trump and therefore are also biased.
5. In order for the Pennsylvania state legislature to come to a conclusion about the legitimacy or validity of the recent election it needs the opinion of an unbiased and independent third party.
6. If the state legislatures were to come to the conclusion that the most recent election was, indeed, invalid despite both the state judiciary and executive branches attesting that the election was valid. I suspect this would open Pandora’s box allowing any state legislature to invalidate election results regardless of whether the election was conducted properly or not.
7. If the supreme court evaluates the evidence and determines the elections were valid then there is no reason for the state legislatures to act. If they find the election invalid then the state legislatures are compelled to act.
8. If the supreme court decides not to get involved, I can not see how a state legislature can intervene when both the state executive and judiciary have certified and attested to the state legislature that the election was conducted in compliance with state law.
Just expressing my opinion on why I don’t think state legislatures, POLITICALLY, can intervene in an election when the same state executive and judiciary branches have certified that the election was legitimate. An independent and unbiased party such as the Supreme Court can provide a reason for a state legislature to ignore both the state executive and judiciary and intervene.

You can even research what happens to humans when exposed to that frequency. As an example it can cause oxygen uptake issues in the blood. Heard so many saying that the Texas case is not about fraud. The election fraud will definitely be the focus of SCOTUS’s evidentiary hearing/trial.
Even if the four defendant states are found to be encroaching their legislatures’ constitutional authority, that alone is unlikely sufficient to outweigh the “disenfranchisement of voters” factor. Absence of showing actual fraud being committed due to the significant laxation of ballot security as a result of the unconstitutional encroachment by the states, there would not be damages unconstitutionally done to the plaintiff states. That means no remedy is needed for this election.
Election fraud remains to be front and center in the Texas case. That is why POTUS must join the Texas case to show actual election fraud being committed. Powell’s cases will also be relevant.
I believe POTUS will join in the Texas suit and will drop all the evidence of voter fraud his team has collected, including the contents of the server seized in Frankfurt, during the SC arguments. That’s not how our Constitution works. If Biden somehow croaks or has to suddenly decline the office to “spend time with family” or whatever the excuse is prior to the inauguration, Harris does not take his place. I believe the procedure would be for the House to select the President. There would be a lot of controversy over whether Harris is still the VP or if the Senate would vote for a new VP. My guess is that Harris would still be the VP, and Trump would have to get her criminally prosecuted (I’m sure they’ve got something on her), removed, and a new VP appointed.

Actually, the key is President Elect and Vice President Elect. After the Electoral College certifies its vote, we are officially in transition, and Harris has rights as Vice President Elect (VPE).
If the PE becomes incapacitated, the VPE assumes the role immediately, similar to VP and P, as “acting”. The VP can then designate a new acting VP. There is a process where the Congress approves the release of the President from his duties, and an option to return the President to power if the incapacitation was short term (reverts Acting President to VP).
Only if both P and VP are incapable does it go to the succession path of Speaker of the House.
