There are only a few instances where a party can file a direct lawsuit with the U.S. Supreme Court, a state claiming harm by another state is one of those instances.
Texas Attorney General Ken Paxton has filed a lawsuit [pdf here] with the supreme court seeking and emergency injunction against Michigan, Wisconsin, Pennsylvania and Georgia “from taking action to certify presidential electors or to have such electors take any official action including without limitation participating in the electoral college.”
The Texas AG argues that arbitrary changes made by the state’s governors, secretaries of states and election supervisors were “inconsistent with relevant state laws and were made by non-legislative entities, without any consent by the state legislatures. The acts of these officials thus directly violated the Constitution.”
The lawsuit states: “these non-legislative changes … facilitated the casting and counting of ballots in violation of state law, which, in turn, violated the Electors Clause of Article II, Section 1, Clause 2 of the U.S. Constitution.” […] “By these unlawful acts, the Defendant States have not only tainted the integrity of their own citizens vote, but their actions have also debased the votes of citizens in Plaintiff State and other States that remained loyal to the Constitution.”
Paxton notes the intent of the states may have been changes in good faith, due to COVID-19 mitigation efforts; however, the end result of the changes is in direct violation to the Constitution and therefore creates the harm.
“Certain officials in the Defendant States presented the pandemic as the justification for ignoring state laws regarding absentee and mail-in voting.” […] “The Defendant States flooded their citizenry with tens of millions of ballot applications and ballots in derogation of statutory controls as to how they are lawfully received, evaluated, and counted. Whether well intentioned or not, these unconstitutional acts had the same uniform effect they made the 2020 election less secure in the Defendant States.”

As there are no precedents for the issues raised in the Texas lawsuit, the rational for SCOTUS’s decision in this highly political case could go either way. All of them know by now an election fraud was committed on an industrial scale and was coordinated. I believe more likely than not the Justices have already made up their minds and each can pick whatever evidence he/she sees fit to support his/her judgment. The only determinative is courage of each individual Justice, and perhaps their wisdom in fashioning a remedy to this mess.
Actually, I believe that there actually is Supreme Court precedence for Texas’ position that the Legislatures be required to determine the slate of electors; said precedent was set during the Election of 1836. So old, but still precedent.

What keeps the states United is the constitution. If the covenant of the constitution is broken, ie not enforced by the courts, namely scotus, there is nothing left to bind the states. Literally. Secession would be required, not just an idea, Texas would have to lead. Lawlessness cannot stand.

After watching the video released on Tucker with the Chinese individual letting the cat out of the bag, we have to realize the enemy (China) has breached the halls of our Government. They own the leadership in the House, Senate, and dare I say Halls of Justice. We can all see who those individuals are by their lack of action to defend the Republic and the Constitution. I’m afraid that Texas and Louisiana will not have standing. It is up to the legislatures of the various states to make sure their laws are faithfully followed. Therefore if PA did not follow PA law it would be up to the PA legislature to sue, or better yet take action under Art. II. sec.1. Not sure why TX should have a say in this.
TX has a say because TX was not defeated at the end of the US Civil War. TX joined the United States on terms acceptable to TX. TX can secceed from the Union ( USA ) if the terms of joining the USA are breached. TX can appeal directly to the US Supreme Court if the actions of other states harm the interests of TX. Like rigging the election of a President of the USA for example.

Texas claims standing because allowing votes in states for federal office of president in violation of state law diminished Texas citizens votes. In my opinion, based on independent research of numerous legal rulings I firmly believe that our entire society is going to re- learn a basic lesson. CHEATING is not acceptable. FRAUD is criminal. Based on a SCOTUS case from about 130 years ago, the ruling was ” Fraud vitiates everything”. The SCOTUS case was Throckmorton. The interpretation is widespread —- whether a contract, a land deal, a court case ( like the Flynn case), or an election — Fraud vitiates everything. I guess we shall see.

In skimming the the “Table of Authorities”, I noticed Bush v Gore wasn’t there. I thought it was odd that that important, relevant, fairly recent case wouldn’t have been brought up in the suit. But once I started reading, I found that it IS mentioned very early on (page 2). So that’s kinda weird… did the people who drew up the complaint just FORGET to include that one in the Table? I’m sure it’s not a huge issue, but still….
