The next couple of weeks could tell the tale: is this country viable or not.Then we will know beyond all doubt.
I’m a Texan. I think the Republic of texas has a fine ring to it.
I know many Texans (especially in more rural areas) that fervently believe that Texas reserved the right to sucede from the Union as a condition to joining (re-joining?) after the Civil War.
I have never been able to find a reliable confirmation or refutation of this claim.

But the greater point is it never had to come to this! McConnell and ALL Republican Senators should have taken to the Well of the Senate to state NO Senate Impeachment Hearing/Trial…Democrat arguments are BS…they also should have named names and stated publicly all BS deals on Votes that they have made with Democrats…and smeared them ALL in the process. This did not happen…WHY?…Because these Republicans are not Ethical people…and Trump took no actions to actually STOP them from the get go. If stopping these kinds of people would have meant a Govt. crisis such as Trump against EVERYONE…then that is what should have happened. Instead…here we still are with the talk of “We caught them all” with NOTHING being done by him using his Legal Enumerated Powers.

But I do suspect a number of other states will join Texas in this very good election challange. The Court can’t do the too soon/too late dance that lower courts have because it couldn’t be known prior to the election how the vote would turn out or how states would conduct their vote counting (standing) and they can’t say this was filed too late due to states having to be given the first attempt at correcting their unconstitionally conducted election (laches).
Should be an easy call for SCOTUS. Should being the key word.

Unfortunately catching people in the act of a crime is not enough. One needs a police force to arrest and charge the criminal and a legal system to try and sentence them. The SC agreeing to hear the Texas v. 5 case is a MAJOR development – in cases of states v. states, SC has original jurisdiction and can hear evidence. This is what we have been waiting for. Louisiana apparently filed a similar suit and they will be combined, as I understand it.
This is no time for naysaying or despair.

You are thinking of another case. Alito denied only one part and that was to stop PA certification. The case still stands before the court.

the definition of “the whole number of Electors appointed” is unclear to me. But, for instance, if the electors from GA, PA, MI, WI are uncertified, and that means they are not “appointed”, then Biden would have a majority of the remaining electors, and would thus win the Presidency.

There is the whole amendment. I do not think it changes my question in the least. The question being; has anyone seen or done research into what exactly “the whole number of electors appointed” means?
If you have any research or corroboration that “Whole number of electors appointed is total electors”, that might help. The way you put it sounds like a tautology.
If the SC says to PA, “your electoral process stinks, so you can’t play”. Then maybe there are no electors “appointed” from PA. Then 270 becomes 260.
BTW – who is Dan Brown? He sounds important to you.
If it worked that way, would TX still be disenfranchised? I believe then the electors in those states, if not appointed, would have an argument they were disenfranchised because of the manner in which their state violated the Constitution. Isn’t that an equal protection violation – the state violated the constitution so nobody gets anything?
I think it goes to the house in the case a state fails to appoint electors and their legislature doesn’t appoint electors either.

For those who doubt that the five SC justices will come through, consider this…
Those judges know what happened. They don’t need perfect evidence presented in bow-wrapped fashion to figure it out and make a ruling. They know this: we and they have our backs against the wall with regard to this communist invasion of government, academia, schools, media, institutions galore.
We are in a mortal struggle for the survival of the Constitution, period, end of sentence. Thus, flair, form, and fairness, while desirable and nice, are not necessary to prevail in this struggle. All that is needed is BACKBONE–backbone to stand and deliver the power of the people back to the people.
If the judges had to figuratively rip it out of the hand of the States illegally, then that is what they WOULD do, because the alternative would be to lawfully transfer power to a communist regime. That makes “sense” to a constitutional lawyer, but it defies the reality of life in this world and understood and practiced by generations of Americans. You simply do NOT cede your fate to communists, even if somehow they have you cornered in a “no-win” legal entanglement that is “supposed” to be ruled their way in accordance with law, precedence, etc.
You simply…don’t…do it. Thus, on that basis alone, it is a foregone conclusion that no matter what is teed up before our Supreme Court, it is bank that the 5 will order liberty to be the victor.
Anybody looking at this honestly, and not from the position of their own short-sighted foolish fidelity to their own greed can see this. The Republican establishment trying to convince everyone that if we just get a Senate majority, things will be ok are fools. A fool and his money are soon parted, GOPers. China has played Wall Street for fools for 30 years.

Trying to figure this out. Lots of tweets and claims shooting around the internet. It may be that the Kelly PA case was not dismissed, but only the request for injunctive relief was denied. Since the issues are largely addressed in the TX case, maybe this denial was just a procedural step for the time being. Does not appear to be a rejection of the case on its merits.

If they wouldn’t hear the Kelly and Parnell case, why would they hear the Texas case? I don’t think the Supreme Court, as comprised currently, wants to be involved in anything “icky” or political. I mean, except Roberts and the other liberals.
Hopefully this means that five of the justices think the Texas case will be more impactful than the PA case and see no need to deal with the PA case 8n light of that.

The case is alive and pending. It’ll likely be merged.

No reason to take on similar/overlap cases. They only declined after the Texas was on the docket.
Read the comments above. All the SC did was deny INJUNCTIVE RELIEF. They did not dismiss the case. It may well be because it will all be joined into the TX suit which is by far more important.
Waiting to see if there is any action on the TX suit by the SCOTUS today besides docketing it. It’s possible other states will join if it goes ahead.
SCOTUS had best be careful.

Ken Paxton, the Texas AG who filed the lawsuit with the Supreme Court today, is basing his case on the Constitution – that only legislatures had the authority to change election rules, and that therefore when other State officials changed the rules without it going through the legislatures, that was unConstitutional.
Also, he is traveling to Washington DC tomorrow (Wed 12/9) and has a pre-arranged meeting with President Trump.

-Texas case has another injunction pending for PA.
*Before* Alito denied relief in Parnell, the court docketed TX for expedited review.
As some are babbling about: TX case involves “original jurisdiction”..court obliged to take it.
So, this far from over.
The media claim this is the end for Kelly v PA at SCOTUS.
I’m not so sure.
The court denied Kelly’s request for injunctive relief (overturning the election).
No one expected them to grant the request for an overturned election.
They could provide a different remedy.
The merits of the case may still under consideration & a different form of relief may be granted.
(It would make little sense to accept the case if they intended to dismiss it without considering the merits and a different remedy.)

“…President Donald Trump announced Tuesday that he would appoint former White House aide Kellyanne Conway to the board of visitors of the U.S. Air Force Academy.
The president also announced the nominations of Transportation Secretary Elaine Chao and Lynn Friess, the wife of Republican megadonor Foster Friess, as members of the board of trustees of the John F. Kennedy Center for the Performing Arts. Matt Schlapp, chairman of the American Conservative Union, would be named to the Library of Congress Trust Fund Board, Trump said.
The news came in a list provided by the White House of more than two dozen intended appointments to “key administration posts” — consisting mostly of seats on panels including the National Cancer Advisory Board, Puerto Rico’s Financial Oversight and Management Board, the Community Development Advisory Board, and others.
Conway, who served as counselor to the president from the outset of the administration until her resignation in August, was the most prominent name on that list. She most recently acted as an adviser to Trump’s 2020 campaign.
Trump rolled out a similarly lengthy roster of appointments last week. President Trump was, in effect, on his way out of Office when McConnell showed exactly how he plays Re: Impeachment. McConnell did NOT have to conduct a Senate Hearing/Trial and give Legitimacy to this clear Farce.
