Retired Magistrate here: Was listening to Rush today and he seems to be throwing Sidney Powell under the bus. However, I cut him some slack because of all the chemo and other treatments he is receiving may be interfering with his thought process.
When Sidney Powell gave her press conference last Friday she gave an opening statement to the case she is going to present. Before a trial starts, trial attorneys always give an opening statement about what they intend to prove. An opening statement is not the time to present evidence; a judge or magistrate would not allow it. When the Plaintiff presents her/his case the witness testifies to evidence and then the evidence is submitted and admitted into evidence if it meets evidentiary standards.
This is a two pronged approach: The Trump team is presenting constitutional arguments with regard to the equal protection clause and State Courts changing voting regulations that the state legislatures put in place. Those voting changes implemented by the State Courts were unconstitutional on their face; it is not the place of the Court to implement these changes, it is up to the state legislature. These are fairly narrow arguments and should be successful if the cases get to the Supreme Court.
Sidney Powell, who is representing the American Public is taking the broader approach of widespread fraud to the point where in many jurisdictions the votes were switched from Biden to Trump. She will probably argue the equal protection clause also. However, I see her case going beyond the electoral college vote because there is so much information for the Court to digest. Also her purpose is to show that the whole voting system needs to be changed so votes are protected. If she can get the case up to the Supreme Court in time and it is helpful to President Trump all good and well. However, I think her purpose goes beyond that; trying to ensure a fair voting process.
Finally, remember if all else fails I really do believe that President Trump will use Executive Order 13484 to show evidence of all the fraud and seize property due to election interference with foreign entities. Would that allow President Trump to stay in office, I don’t know because we are in uncharted territory.
Thoughtful comment. Jenna Ellis said pretty much the same thing in her remarks on Thursday too – this was akin to an opening argument. She then proceeded to slay the reporters for their uneducated and baseless questions. It was entertaining to watch.

I don’t think anyone should rush to judgment on anything at this point. We are definitely against a time crunch, but I don’t think someone like Sidney Powell or Lin Wood would go off half-cocked.
We’re all anxious and concerned. The waters ahead are rough, but steady as we go. Donate to POTUS’s defense fund or to Sidney’s fund if you can.

I would think the natural counter argument is: any failure to ensure only legitimate votes are counted will disenfranchis all legitimate voters.

Then also you have some counties that follow the law and others that flaunt it disenfranchising those whose votes were thrown out in counties that follow they law.
