The court said that maps put in place in 2021 must be used in the November elections instead. Three justices dissented from the court’s ruling.
VIRGINIA – The Virginia Supreme Court on Friday overturned the state’s redistricting ballot measure that would have given Democrats an edge in four House districts, dealing the party a massive blow ahead of the midterms.
The ruling now gives Republicans a clear lead in the gerrymandering efforts over the last year, which were further inflamed by the Supreme Court’s Voting Rights Act decision last week.
Virginia voters passed the measure last month. But the state’s top court ruled that legislative Democrats did not follow the proper procedure when rushing the referendum to the ballot.

My understanding:
The dissenters viewed the current election to have occurred on election day (disregarding entirely the early voting perood), which would have satisfied the 90-day separation from the prior election.
(Note that the elections here refer to the votes on the constitutional amendment referendum, not the election of candidates.)
Right. However, since VA has early voting, thousands of voters had already voted for certain candidates before the Dems sprung this. IIRC, the GOP had affidavits from voters who voted early in the general election, and said that if they had know about this scam, it would have changed their vote.
A lot of hairsplitting on what is “election day” given early voting.

If they can keep the House and they are barely holding on to the Senate. Louise Lucas, the head of the Senate, is in a heap of FBI trouble with massive fraud and funneled money to Dems all over the state. Good luck, Hakeem. The federal courts defer to state supreme courts on the interpretation of state constitutions. He’d have to dream up some violation of the US Constitution. And he’d have to start out in district court. I doubt the Fourth Circuit or SCOTUS would take an emergency appeal.
