The department has initiated retirement grade determination proceedings under 10 U.S.C. § 1370(f), with reduction in his retired grade resulting in a corresponding reduction in retired pay.
To ensure this action, the Secretary of War has also issued a formal Letter of Censure, which outlines the totality of Captain (for now) Kelly’s reckless misconduct. This Censure is a necessary process step and will be placed in Captain Kelly’s official and permanent military personnel file.”
“Captain Kelly has been provided notice of the basis for this action and has thirty days to submit a response. The retirement grade determination process directed by Secretary Hegseth will be completed within forty-five days.
Captain Kelly’s status as a sitting United States Senator does not exempt him from accountability, and further violations could result in further action.
These actions are based on Captain Kelly’s public statements from June through December 2025 in which he characterized lawful military operations as illegal and counseled members of the Armed Forces to refuse lawful orders. Thus, he put out a video, where he talked smack about PDJT’s lack of military service.

He will forever feel slighted because in his mind he deserved it… hence why he became a politician (to massage his ego) and why he has the position against the military today.

Except that the basis for the censure is clearly false. He and the others stated that military members are required to not follow illegal orders…the same advice Hegseth had publicly stated several times on several public platforms and media outlets.

That’s a lot longer time frame than that one video. Public statements can include radio and TV interview, press conferences, posts to social media, remarks at a fundraiser.
That’s a long time for somebody with TDS not to step in it someplace when his shtick was dancing on a line.

He was agitating against the military. That is a no-no for military who still can be called back due to pensions. They are still tied to the military.
Kelly’s gas lighting and attempts to split hairs about his words reeks of a defense an immature teenager would conjur up. Anyone with a half-sense can understand the context and implication of the video., which was to stir up mutiny in the ranks against President Trump. As for his defense, his “information” is already given in basic training and he was well aware of this. Additionally, one would think for Kelly to go on blathering the same seditious message referring to a specific ongoing military campaign against narco-terrorism puts the legal nail in the coffin for him. He may understand aviation technology, but he is not very bright otherwise.
My impression is that his arrogance to keep sticking his foot in his mouth after he clearly saw how much people were enraged by his seditious actions, may show some personality disorder ego malfunction. Or, perhaps he was getting so much graft that his greed got the better of him and he had people in the shadows egging him on and promising him a big prize if he continued this seditious public banter. “I’ll never back down” shows no insight or remorse and invites the hammer of Justice.
So he gets a tiny slap on the wrist, which isn’t even a done deal as he has 30 days to dispute this and it is a yet to be confirmed punishment. But we’re supposed to be overjoyed and grateful that anything at all was done. He really should have gotten a full Court Martial. This is the reason our Republic is in peril. Because the message out there to all the ringleaders, foreign and domestic, who would like to start a military coup or anarchist revolution to overthrow our Constitutional Republic is that you might as well give it a try because you have almost nothing to lose. Kelly obviously has a desire for higher office, most likely POTUS. You just can’t justify advocating active military personnel to ignore lawful orders from superior officers, no matter what side of the isle you are on.
