Ms. Lisa Cook has vowed to fight the removal effort of President Trump through her attorneys. “President Trump purported to fire me ‘for cause’ when no cause exists under the law, and he has no authority to do so. I will not resign. I will continue to carry out my duties to help the American economy as I have been doing since 2022,” Cook said in a statement to POLITICO.
On a Truth Social Post, President Trump announced his decision to remove Lisa Cook from her position on the FED board of governors, due to the criminal referral which alleges she falsified information on a mortgage application.
WASHINGTON – […] The Supreme Court has repeatedly backed Trump’s efforts to remove executive branch officials that Congress had attempted to shield from removal without cause — including from agencies that have historically enjoyed arms-length independence. But the justices have made clear they view the Fed as an exception to this deference to the president.

Trump’s effort to remove Cook, however, will likely hinge on what he is claiming as the basis. The allegation of mortgage fraud has not as yet led to criminal charges or any findings of misconduct.
In his letter, Trump sought to justify his legal standing in removing Cook, citing his executive authority.

No, it does not.
By the Court’s own words, it is correctly only a “quasi-private” entity, and is in fact a creation arising solely under the Federal Reserve Act.
The key descriptor is “quasi”: having a legal status only by operation or construction of law and without reference to intent.
It is not a completely independent institution or branch of government that may operate without oversight or accountability to anyone, and do whatever it pleases … including engaging in criminal activity or in actions that are contrary to or violate its Charter, or the intent and spirit of such Charter.
The only variable is whether its principal and secondary oversight falls under the Executive or the Legislative branches, and to which degree for each.

If the Federal Reserve had been established by the Constitution or an Amendment, the Supreme Court would be right, but it wasn’t. It was set up by an act of Congress. And the First and Second Banks of the United States that they hold up as historical models were also set up by acts of Congress and furthermore did not exercise central bank functions, nor did they set monetary policy or regulate banks.
All the functions of the Federal Reserve are executive functions that without the Fed would be performed exclusively by the Executive Branch, with the possible exception of some Congressional oversight functions that Congress is letting the Fed perform, although Congress doesn’t have to allow that. The Supreme Court may wish to grant great deference to the independence of the Feb, but they are wrong. Its primary functions are all Article 2 executive functions and the President should have the right to intervene.
Fed was supposed to be reauthorized by congress in 2013.
Originally, the 1913 Federal Reserve Act granted the Federal Reserve Banks a 20-year charter, set to expire in 1933.
This 20-year charter was amended on February 25, 1927, to remove the expiration date, granting the Federal Reserve perpetual succession: “To have succession after the approval of this Act until dissolved by Act of Congress or until forfeiture of franchise for violation of law.”
This amendment eliminated the need for periodic reauthorization, meaning the Federal Reserve’s authority continues indefinitely unless Congress explicitly acts to dissolve it or it violates legal provisions leading to forfeiture. As of 2013, and to the present day, no such dissolution or forfeiture has occurred, and the Federal Reserve operates under this perpetual charter.

This is going to turn into a constitutional issue which is already coming up through the federal appellate courts: Can Congress create an “independent agency” that is not part of the executive branch?
The issue first came up in a case you will probably be hearing a lot about in the coming SCOTUS term. Humphrey’s Executor.
Humphrey was appointed to the Federal Trade Commission by Herbert Hoover. FDR fired him. Humphrey sued, but died as the case went on; the executor of his estate replaced him as plaintiff, as he was asking for back pay, which would be an asset of the estate. The issue was whether the FTC enabling statute, which limited firings only to “for cause,” was constitutional.
SCOTUS ruled in 1935 (9-0) that Congress could create a “quasi-independent agency.” It ruled:
This construction of the Act is confirmed by a consideration of the character of the Commission — an independent, nonpartisan body of experts, charged with duties neither political nor executive, but predominantly quasi-judicial and quasi-legislative, and by the legislative history of the Act.
When Congress provides for the appointment of officers whose functions, like those of the Federal Trade Commissioners, are of Legislative and judicial quality, rather than executive, and limits the grounds upon which they may be removed from office, the President has no constitutional power to remove them for reasons other than those so specified.
Given the recent SCOTUS opinion in US v. Trump, which clearly said that the president was head of the executive branch, and everyone in it worked under him, you can see that SCOTUS may have to re-visit Humphrey, maybe even this term.
SCOTUS already ruled that the president could remove the head of Elizabeth Warren’s creation, the Consumer Financial Protection Bureau, even though it enabling statute had similar “can’t be removed except for cause” language as to its head. Seila Law LLC v. CFPB (2020). That was a 5-4 decision. The plaintiffs had argued that the whole agency was unconstitutional, but SCOTUS wasn’t going that far. It did find the restrictions on the president’s power to fire the head unconstitutional. The majority in Seila ruled:
Such an agency lacks a foundation in historical practice and clashes with constitutional structure by concentrating power in a unilateral actor insulated from presidential control.
Yes, the Fed would be the ultimate test of Humphrey. I’d expect a case involving another agency challenging Humphrey‘s precedent will make it to SCOTUS first.

Seems like the ’cause’, at this time and until a subsequent finding of guilt, is more properly the appearance of impropriety, as opposed to a finding of guilt. Based on the facts, as presented so far, Trump will likely prevail on the merits, since her position is one of trust, high moral character and so forth.

I sense that PDJT is purposely seeking to force the SCOTUS to definitively rule on the legitimacy of his authority as Chief Executive to dismiss any members of “an independent… quasi-judicial and quasi-legislative” governmental entity for whatever cause he determines to be appropriate. As a legal layman, I agree with your opinion that the 90-year old Humphrey precedent requires clarification.
The President could have waited until charges were filed against Cook to avoid the implied loophole stated in the Politico article quoted by SD: “Trump’s effort to remove Cook, however, will likely hinge on what he is claiming as the basis. The allegation of mortgage fraud has not as yet led to criminal charges or any findings of misconduct.”
However, waiting would distract from the primary issue of him being allowed to fire her purely and solely “for cause” prior to any legal accusation and adjudication of criminality.
I anticipate that the DOJ is immediately ready to begin prosecuting Cook if her legal battle finds traction in the courts and she is allowed to remain in her position while her wrongful termination case is adjudicated. In that situation, her criminal conviction and subsequent removal from her position would be the more expedient solution.

Despite her pedigree, questions have long persisted about her academic record. Her publication history is remarkably thin for a tenured professor, and her published work largely focuses on race activism rather than on rigorous, quantitative economics. Her nomination to the Fed required Vice President Kamala Harris to cast a tie-breaking vote; by contrast, her predecessor in the seat, Janet Yellen, now Treasury secretary, was confirmed unanimously.
The quality of her scholarship has also received criticism. Her most heralded work, 2014’s “Violence and Economic Activity: Evidence from African American Patents, 1870 to 1940,” examined the number of patents by black inventors in the past, concluding that the number plummeted in 1900 because of lynchings and discrimination. Other researchers soon discovered that the reason for the sudden drop in 1900 was that one of the databases Cook relied on stopped collecting data in that year. The true number of black patents, one subsequent study found, might be as much as 70 times greater than Cook’s figure, effectively debunking the study’s premise.
Cook also seems to have consistently inflated her own credentials. In 2022, investigative journalist Christopher Brunet pointed out that, despite billing herself as a macroeconomist, Cook had never published a peer-reviewed macroeconomics article and had misrepresented her publication history in her CV, claiming that she had published an article in the journal American Economic Review. In truth, the article was published in American Economic Review Papers and Proceedings, a less prestigious, non-peer-reviewed magazine.

Cook is no stranger to mobilizing such punishments against others. In 2020, she participated in the attempted defenestration of esteemed University of Chicago economist Harald Uhlig for the crime of publicly opposing the “defund the police” movement. She called for Uhlig’s removal from the classroom, claiming that he had made an insensitive remark about Martin Luther King, Jr. (The university closed its own inquiry after concluding that there was “not a basis” to investigate further.) The question is the Federal Reserve a part of the executive branch of government? Article 2 vests all power in the President. The President should be able to fire them all. Period. If not, what branch are they a part of and who has authority of oversight? Who will hold them accountable? Are they a part of the Federal government?

Have you noticed something? When these allegations came out, there was no categorical denial. These are very serious claims to be made about a Fed governor? She seemed to be more vocal about Trump’s dismissal rather than something as egregious as declaring two central residencies.
End the Federal Reserve asap.
