Judge Dismisses Stormy Daniels Lawsuit – Requires Ms. Daniels to Pay President Trump’s Attorney Fees…

In a rebuke to the political efforts of creepy porn lawyer Michael Avenatti, U.S. District Court Judge S. James Otero has concluded that Ms. Stormy Daniels has failed to establish a prima facie case of defamation against President Trump and has dismissed the lawsuit.  Additionally, Ms. Daniels is now required to pay President Trump’s attorney fees.

TEXAS – […]  “The Court agrees with Mr. Trump’s argument because the tweet in question constitutes ‘rhetorical hyperbole’ normally associated with politics and public discourse in the United States,” states the opinion. “The First Amendment protects this type of rhetorical statement.”

The judge continues by defining “rhetorical hyperbole” as “extravagant exaggeration employed for rhetorical effect” and characterizes Trump’s tweet as displaying “an incredulous tone, suggesting that the content of his tweet was not meant to be understood as a literal statement about Plaintiff. Instead, Mr. Trump sought to use language to challenge Plaintiff’s account of her affair and the threat that she purportedly received in 2011. As the United States Supreme Court has held, a published statement that is ‘pointed, exaggerated, and heavily laden with emotional rhetoric and moral outrage’ cannot constitute a defamatory statement.”

Otero adds that Trump made a “one-off rhetorical comment, not a sustained attack on the veracity of Plaintiff’s claims” and that this distinguishes this suit from other cases where courts have seen enough to deem defamation from a public statement. The judge adds that Daniels’ assumption that Trump knew of the 2011 threat doesn’t establish facts adding up that he did, in fact, know about the threat. The judge ends up agreeing with Trump that Daniels hasn’t shown actual malice nor adequately pled damages.

Daniels won’t get the opportunity to amend her complaint to cure deficiencies, and what’s more under Texas’ anti-SLAPP statute, she now has to pay Trump’s legal costs — perhaps a rubbing of salt in the wound to those who contributed to Daniels’ legal defense fund.       Proving they genuinely have zero understanding of Trump, and zero comprehension of what makes him a great leader and a great president. They are so blinded by The Donald persona (which to them is just like that Avanatti sleazebag) they can’t see the brilliance and unmatched political acumen of President Trump.

Katie Couric, after talking about how gracious and kind President Trump was when her husband passed, and when she needed a favor for her daughter, and how she was invited to his wedding, just can’t understand how mean he’s become and accuses Trump supporters of screaming and spitting at the press during rallies.       What Katie doesn’t understand is President Trump hasn’t changed. If Nancy Pelosi walked in his office tomorrow morning and wanted to have breakfast he’d be happy to go have breakfast with her and act like nothing was wrong in the world. He is attacked, relentlessly, and if he even once attacks back or defends himself they are so clueless they think he’s the problem.

      He’s one of the nicest guys on the planet. He just isn’t a fool. You can be both a nice guy, and stand your ground and fight for what’s in your best interests.

Even then, this kid –subsequently one of a bare handful of Americans awarded Commandant de Legion d’Honneur (in his case, by Le Grande Charles De Gaulle himself)– replied, no thanks: “What am I going to say, how’s Admiral Dewey doing?” [think Manila Bay in Spanish-American War].

        Hate to admit it, but I’d be equally intimidated meeting Trump.

          Romney may be decent in many ways, but he does not listen. He was very rude to my neighbor in a social situation, totally dismissed her. Mitt sees some people as beneath him if he disagrees. Trump listens and learns. I have known quite a few people who have interacted with the Romney family socially. They are honest, do not cheat, help when they can, but are also elitist, in a bubble and entitled. Some people just have never worked a dirty job and it shows. Try watching the documentary the Romney’s made about Mitt’s run for president. It gives a good picture

And “accountability” will happen to the Left, but it might not take the form we expect or want. But in the end I believe a pound of flesh will be paid in full.

    So Avenatti makes untold millions off of Stormy and now she owes how many millions to our President Trump’s attorneys fees? Talk about getting screwed over twice. Ouch.

    I don’t think she’s young enough to make it up in lap dances either.

    I almost feel sorry for her, almost. She fell for the dream that was given to her by Avenatti and the Dems that she would be swimming in money and fame in no time. I sincerely doubt the Dems who made her all of these promises are going to fork out what she will now owe. She is of no use to them anymore.

    It won’t be long, if it hasn’t happened already a meme of her being thrown out of the black SUV like Ford.

    I know there are a lot of stupid ladies out there just like men, but it’s going to be a lot more difficult now to get some female to cry wolf and blame our President Trump. I know I wouldn’t go near it with a ten foot pole, wouldn’t have from the beginning either, but at least one should hope this will scare off any females thinking they can make it rich off of lying against our President.

    Stormy is going to be hearing a lot of doors slamming and unanswered phone calls real soon. She might even lose custody over her daughter and for what? Loose promises from a creepy porn lawyer.

    I wish I could feel sorry for her, even a little, but she should’ve listened to her Elders when they told her lying would get her nowhere.

    Apart from everything else, its disappointing that she should gratuitously have adverse things to say about Trump’s genitalia. Hard to understand why someone should choose to sell their body for sex then disparage clients. Why? For revenge for being a man? Or is it just for money? In any event it’s kind of a breach of an implied condition of the contract. Not to mention blackmailing him for “shut up” money – then breaking that agreement too. I can only say here we have found real trailer trash, someone who is wholly lacking in morals.

    You can kind of understand how she has ended up with a lawyer like Avenati. Given he comes across as the male equivalent of Stormy Daniels and is just as morally bereft.
