I never quite understand the position of affording illegal aliens U.S. constitutional rights, when they are illegal to begin with.  Seriously, what makes the protection of U.S. constitutional law applicable to an illegal entrant.

california illegalCALIFORNIA – A California toddler fighting for her life Thursday after a brutal beating at the hands of an illegal immigrant with a long criminal record is the latest case to rile California sheriffs and police against a U.S. immigration policy they say is forcing them to release dangerous criminals out on the street.

Francisco Javier Chavez, the live-in boyfriend of the unidentified two-year-old’s mother, is out on bail after being charged in the late July attack, which left the San Luis Obispo County girl with two broken arms, a broken femur, a compressed spine, a urinary tract infection and a fever of 107 degrees. Chavez’s criminal record includes assault and drug convictions and arrests for violent acts including kidnapping, car jacking and cruelty to a child.

A disgusted San Luis Obispo Sheriff Ian Parkinson told FoxNews.com Chavez should have been locked away or deported long before he had the chance to inflict “horrific injuries” on the little girl, but said conflicting federal policies leave his department handcuffed. Instead, Chavez is now free, awaiting a court date for which he may not even show up. (read more)

      Exactly! Is the Prosecutor even bringing the highest possible charges against this savage?? He is exactly the type to skip bail so why grant bond in the first place? And why isn’t Congress voting to stop this specious argument that LE must have a warrant from ICE to turn illegals over for deportation? Of course, in a case like this I prefer NO BAIL and no deportation until after his trial and serving a long sentence!!

      I might be okay with giving violent, repeat-offender illegal aliens all the rights of an American citizen…………..if they could then be tried solely in a Sharia-only court.

      It is so sickening to think of our taxes going to keep this sadistic, vile miscreant in an air-conditioned American prison, likely one of the “progressive” California versions that have cable TV and access to college classes. He deserves to have everything he did to this BABY done to him, & then some. Then throw him into a tunnel-proof Mexican prison, and tell all the other inmates he insulted their mothers.

      I had a violent offender living behind me who was undocumented. After busting out my child’s bedroom window and making gestures like he was armed and going to shoot us, I called 911. The police werent even going to arrest him, saying it was an “accident” and that he was just drunk. They took him into jail on a “no id” hold for less than 12 hours. He was released the next to day to terrorize us even more. After 12 times of calling the police in a short period of time, they eventually sent out an officer who asked me “Why do you live here?,” with a serious look of concern and compassion on his face. I got his message loud and clear. As a white man, with a family history in this country that dates back to the 1600’s, I did not belong. I had no rights or protections being afforded to me. The end result was the police offering up a “cultural mediator” to figure out a solution to my complaining about the neighbors various criminal behaviors. I now live in a much nicer area where this is not a problem.

    Why was he even given bail? That needs to change too. Being an illegal should bar giving bail to illegals in these situations. Using ICE as a scapegoat is disingenuous, though I do agree that ICE should be notified..

      I hope Mayor Patino, Dudley, Lavignino and Zuniga get the boot. Did you know that former city council member Patino, former city council Marxist Hilda Zacarias and former Chief Macagna demanded rightful citizens of this country to show proof that they had a right to attend city council meetings in Santa Maria. Yes, valid government issued identification was required to be allowed entry into at least three city council meetings on the basis that there was limited space. Absolutely disgusting. You know who didn’t need ID? The Hispanic advocacy groups and anyone they brought along with them.

        No I did not know about that. Patino is still a member of the city council, she’s the mayor and Zacarias is still on the council. I had great hope that Martin was going to be an improvement over Magagni but other than increasing the size of the force (much needed) I don’t see much difference. Well, at least the officers aren’t shooting each other any more.

      These are not animals. They are people making murderous choices. The minute you call them animals they are no longer subject to the laws that govern us.

      It’s a serious point I mean to make: so many people, in frustration and anger, speak of such as ‘animals’ which actually provides them an out, and an excuse for their behavior.

      It puts them in a category where the same solutions can be applied that might be applied to animals – shoot the violent ones. ADD: And yes (before someone makes that thought an excuse to go ugly.….) certain crimes under our laws and justice system allow for damage to be done to the individual after they are found guilty under the provisions attached to sentences prescribed for their crime – although I don’t think any states use the firing squad any more….

      I’m not willing to go there – shoot them on my own, iow, outside of the law.

      Thinking matters.

      Words matter.

        Sharon I know you are right about words mattering and everyone should be subject to the law but they aren’t , In these days and times there are to many people that get away with way to much while the rest of us who try to live by the law and have morale values get it used against us like a weakness .           One of the glories and strengths of this nation from the outset was that – finally – it was to be written into the foundation documents that every man would stand equal before the law.

          The fact that many men (and women) no longer consider themselves accountable before the law is not a reason for me to change my perspective about either myself or the law.

          The national house is already on fire. I am not going to strengthen the fire by becoming an arsonist myself.

          I can choose to use words myself in the right way.

          I can choose to THINK as well as I am able.

          I will not change how I use words or stop thinking as well as I can because others are arsonists.

          I will not help them by becoming like them.

    This is the MAIN reason I am NOT for any type of AMNESTY program. Obama, along with the help of the FBI have been hiding the crime stats of Illegals/Hispanics in the FBI reports under Caucasian. Guys just take a look at the FBI Crime stats; there is a category for Blacks, Hawaiians, Native Americans, & Asians. ( I might be missing a one or two). However, there is NO category for Hispanics, because they are mixed in with Whites/Caucasians!!!
    Reason I find it strange is that all the other categories I mentioned are & have been for several years now a smaller % of the American population than Hispanics.
    ALL Amnesty programs Depend on HONESTY!!!! Come on guys, some Illegals might be basically good, but they have been lying their butts off since the day they either overstayed their visa or crossed the border illegally. Illegals are ALL Criminals who have broken American law, and then compounded their first crime by either working here illegally &/or collecting governmental benefits(Usually both). Illegals are NOT Only ALL Criminals, but LIARS!!!

    I really hate to tell you how many of these guys there are out running amok. I live in SO CAL so I guess I’m used to it. So many early release and illegals running around it’s mind boggling. This is why I always throw my two cents into any amnesty discussion. In the 80’s and 90’s most People coming here were good. Not any more we have gotten to the bottom and even the Hispanics would admit this. These politicians need to pay for umleashing all these guys on our neighborhoods. Look up the map of sex offenders in your area or FBI most wanted or your states most wanted…Case closed……

      When I first moved to my quiet little corner of Northeast Oregon a decade ago, it was almost crime free, even across the River in Tri-Cities!!!
      Now not even a day goes by without some type of shooting, beating or ???. Almost daily there is a murder of some sort in Eastern Washington, or Northeast Oregon. 9 out of 10 times when the perpetrator’s name is givne its Hispanic. 75% of those Hispanics later turn out to be Illegals with the 90% of the rest being anchor babies.

    Bail was set at $100,000. I had to review a legal web site to be reminded of what bond is. If you cannot pay bail up front, you might be able to get a loan (using your house, car, or other collateral) and pay something like 10% to a bail bondsman who then guarantees the rest will be paid if the defendant disappears. So if the idiot who got Chavez out of jail either paid $100k (doubtful) or used something to get a $10k loan from a bail bondsman. Wow. Was it the mother of the abused toddler ???? Let’s say she did it and used her car for the loan. If Chavez doesn’t show up for his next court appearance she will no longer have her car.

    We shouldn’t allow bonds. If the bail is set at $100k and the person can’t come up with that amount, too bad. Better yet, as someone suggested above, no bail for illegals. I’m so mad I can hardly type.

      The 10% is up front in cash. It’s a non-refundable fee. A car could be used as part of the collateral only if the pink slip/vehicle can be produced. Real estate is used quite often.

      Cash is different. Once the case is completely adjudicated, none of the posted cash can be kept by the court as it belongs not to the inmate but to someone not related to the case(s) at hand. However, it’s not unusual for large cash bails to be posted, accepted by the jailer, a receipt for it immediately issued, then sat on until a local judge determines whether or not the money is dirty. And, you won’t be told beforehand, either.

        Does anyone here live in San Luis Obispo County and can go to the records office and get the record ? I guarantee you if I lived anywhere near there I would do it.

      I don’t agree that we shouldn’t allow bonds… at least not across the board. Because there’s a huge difference from one type of case and another, and the attitude of one judge and another. But in a case like THIS? If this guy (considering his record as well) was able to get out with only $10K, that’s messed up. Actually I don’t understand how his initial amount (before “10%”) was less than $1M.

        They have to hurt multiple people before they hold any illegals. Case in point in my little town yesterday. The guy shot his girlfriend and another. They released him with an ankle bracelet. He came back and shot her again yesterday and two others. he’s on the run. Imagine the insanity of that then multiply it by hundreds daily. Yep it’s a lot worse than your thinking.

    My first thought was not to chime in but several posts here did suggest a ‘fitting solution’ to this problem. We have lots of infrastructure problems. The elites claim all these folks come here to do is work. Let’s put them to work repairing the infrastructure – sans modern power tools – as laborers. Those with pending cases can be assigned lighter tasks. Convicts are assigned to heavy labor groups for the duration of their sentences.

      Voting in “any republican” will not change a thing. Any republican joined at the hip to the GOP establishment has already gone along to get along with the democrats. Most of them talk conservative at election time because desperate conservative Americans will believe them and hope/hope/hope. Once they are elected and their pensions are in the pipeline, they do not govern conservatively. It’s been going on for decades.

      Some people think that it’s a strike against Trump that he’s not a life-long dyed-in-the-wool republican. I see dyed-in-the-wool-R as a negative at this point. I’ve seen too much and been lied to too many times. I will never again vote for “any republican”.

      I never skipped voting (in my 70’s now) but I’m a keen fan of reality and I will NOT vote R for “any republican” ever again. I’ll either skip or do a write in. I’m so tired of pretending it will all be better if I just vote like a good republican. Done.

  29. I would like to know, and as posters have commented above, WHO PAID THIS GUYS BAIL? This County’s records aren’t online. Was it PRO ILLEGAL IMMIGRANT GROUPS, ACLU, Criminal Friends? How did this man “hiding in the shadows” or “only here for love” (/sarcasm), obtain 10% cash for his Bail?
