The plot thickens.  We might just have found a biggie….

In a recent Politico interview  (publish date 6/27/14) with the Lois Lerner’s attorney William Taylor III an interesting aspect is buried midway through page #2.

During part of the interview Politico author Rachel Bade inquires about the 1.1 million pages of documents Lerner sent to the Department of Justice that became an issue when discovered by the House Oversight Committee on June 9th 2014.   BACKSTORY HERE.

The documents were sent from IRS to DOJ on a series of 21 discs (CD ROMS) and, according to the admission from the DOJ, “contained legally protected taxpayer information that should not have ever been sent to the FBI“.

Some of the 501(c)(4) documentation included confidential tax records “Schedule B” of IRS filings.   These Schedule B’s outline parties who contribute to, affiliate with, or people who support the 501 organization.   Those tax filing schedules are illegal to distribute.

Why the DOJ waited to inform congress, and why they only did so after Daryl Issa found out about their existence, was a matter congressional consternation but no-one made a big deal about it.

Indeed all prior details and media reports of the interaction have been framed around the substance of legality, and illegality,  for the IRS to actually send the confidential taxpayer data.  This is indeed a concerning aspect – but we think we’ve uncovered something considerably more alarming about both the timing, and the substance.

Inside the Politico article is an explosively revealing defensively framed answer from attorney Taylor.   He is specifically and directly stating it was NOT Lerner who initiated the inquiry:

…” […]  Taylor said Lerner didn’t know [about the unlawful confidential aspect] and sent them because Justice requested the documents”…

Politico [Page 2] Taylor also responded to Oversight GOP reports that Lerner and Justice officials met in the fall of 2010 when Justice was considering the possibility of prosecuting 501(c)(4)s that may have been breaking rules by overly engaging in political activities — details Republicans found in emails handed over by the Justice Department.

Again, he said she was just doing her job.

“We should hope the two are talking to each other,” he said, because Justice and the IRS both bring tax charges and should be on the same page, he said.

Emails summarizing the meeting also show that Lerner apparently expressed skepticism that the (c)(4) issues were a criminal, rather than a civil, matter.

Oversight GOP has also hit Lerner for giving 1.1 million pages of tax return data about 501(c)(4) organizations to the FBI just before the 2010 midterms — 33 tax returns that included unlawfully disclosed private taxpayer information.

Taylor said Lerner didn’t know and sent them because Justice requested the documents: “She [understood] the donor information on Schedule B had been removed. In some cases, we later learned, it may not have been.”

The IRS has acknowledged that the 33 returns were not scrubbed of taxpayer information as required by law.  (cont.)

In all prior reporting -on the initial revelation of Lerner’s submission of the documents to the DOJ- the assumption included within the articles was that Lerner was the initiator of the inquiry.

Apparently she wasn’t.

This latest interview with her attorney would dispute that assumption, and indicate the DOJ was the group making the inquiry – not the IRS.   The IRS was responding to the request from the DOJ.

{Pause – RepeatThe IRS (Lerner) was responding to the request for information from the DOJ !

Naturally this means there was a preceding email from DOJ to the IRS.

The IRS (Lerner) emails around this incident were found by the House Oversight Committee and are included in both this article , and the pdf below.

However, if what Lerner’s attorney is saying to Politico is truthful, there’s more.

Where is the originating email from the DOJ?   ….And more importantly WHO SENT IT AND WHY ?

FIRSTLY – This becomes quite possibly the smoking gun trail from DOJ (Eric Holder – underlings) to the White House.

SECONDLY – At the very least this makes the DOJ investigation into the IRS illegality fraught with conflict of interest.   A conflict because the “impetus” of the inquiry itself, from the DOJ to the IRS becomes the more unlawful part.

How can the DOJ conduct an investigation into unlawful aspects of the IRS targeting of specific 501(c)(4) groups, when the DOJ is the initiating body for the illegality they are seeking to investigate ?

ANYONE ?

 

Aside from the obvious contradiction for the White House, whether the IRS or DOJ were the originating party for the targeting scheme really does make a substantial difference.  We discuss HERE

      Agreed. At the very least, the conflict of interest means to any judge that DOJ simply MUST appoint a special prosecutor. They can no longer hide behind the idea that it’s not a sufficient scandal. They are not allowed to judge such a thing. They were involved, and not as a bystander. There MUST be a special prosecutor.

      This is how conspiracies unwind. Facts coalesce in sufficient number and form that components move back in time against the silence that hides the truth.

      According to William Taylor III, Lois Lerner’s attorney, the request for 1.1 million pages of information about the 501(c)(4) applicants [at the heart of the matter] stemmed from the Department of Justice.

      Previously all reports had been that Lerner was soliciting the DOJ to investigate the 501(c)(4) parties. This outline by Taylor refutes that assertion and says she was merely responding to an inquiry from the Justice Department for information.

      That’s a big deal.

      If the DOJ was the initiator of the requests for information, that means the DOJ was the unit seeking to investigate the groups for potential illegal activity.

      In essence the people looking to go after the Tea Party groups (et al) was the Department of Justice….. and Lois Lerner was a fellow traveller in the same ideological mindset as to provide the information because she too wanted them handcuffed.

      Why this becomes so explosive is when you think about ALL THE OTHER activity of the DOJ at the time this IRS inquiry took place. THINK GIBSON GUITAR etc.

        Who would benefit on such a favorable outcome by having all the conservative and voter watch groups tied up before the 2012 election?

          There is going to be another entire network of emails to subpoena. AND if congress handles this correctly they can most certainly leverage a “special prosecutor” who would need to be outside of the DOJ unit which might easily become a party to be prosecuted.

          The DOJ has a massive conflict of interest.

            By the time this is all said and done we may actually have to have the Royal Canadian Mounted Police handle this through a mutual aid pact with the Canadians. Is anyone in this administration worthy of confidence in an objective inquiry? All this time I thought Elijah Cummings and Eric Holder were in cahoots but I don’t even think we’ve scratched the surface on this one – and it’s still all but un-reported on main network news. Unbelievable.

      Earlier reports were only that IRS and DOJ held meetings about collective assistance. This latest revelation is about DOJ requesting info on 38 specific organizations to initiate an investigation. An investigation they backed away from when outed….

      in 2010 they may have been “talking”. But in 2012 they were actually “doing”…

        Not to mention that when the DoJ requested the records they had no prior evidence of wrong doing,hence nothing to investigate. They were on a fishing expedition so they could either “manufacture” a case against conservative groups or, intended to intimidate, blackmail,or extort their donors.

        For some wealthy and influential people, a mere association with Tea Party types could prove quite embarrassing, and/or damaging. Just look at what accusations of racism did to Paula Dean and Donald Sterling. If the law can’t be used against you, then public sentiment certainly can.

    In retrospect, it would have to of been Holder requesting the info for Lerner to so blindly and callously just turn the requested info over. Is it possible that since the request was coming directly from the top of the DOJ (Holder) that Lerner may have been under the impression that what she was providing was legal (although illegal for DOJ request).

      Hence the need to see the “originating” email. The DOJ cannot deny the existence therein because of the follow-ups, combined with Taylor’s statement that Lerner was merely complying with a request.

      Even absent of Lerner testimony this statement by Taylor is incriminating of the DOJ.

          And that’s the value of this statement by Taylor.

          Previous to this statement the DOJ could hide contact under the auspices of the mysterious hard drive failure. Meaning the inherent position that Lerner started the whole gig – and if she’s quiet, no-one can refute that; no-one is the wiser….

          Now however, Taylor is clearly saying the origin would be inside the DOJ.

          Because any Lerner email failure would not affect the DOJ “sender”, and we know it was not originated by Lerner, a record exists of the originating source.

          That’s the smoke to follow.

            I’m still trying to wrap my mind around this whole thing, and to understand the complete timeline of Lerner’s involvement. Particularly what went through her mind when this took place. Lerner wasn’t some dumb “chippie” who simply didn’t know the law..She’s an educated career bureaucrat who was well aware of the law, especially since (in this case) it was her JOB to know the law. But, for some reason, she wound up violating the law and put herself in deep personal risk. Was this something she did based on ideology, or was she bribed into it? Or is it possible she got “played” by Holder and (only too late) realized that he’d duped her into committing a serious crime, and was planning to let her “swing in the wind”?

            Is it possible that Lerner started to get “scared” so Holder had a “black bag operation” ran on Lerner’s e-mail to wipe out whatever paper trail she had accumulated as an “insurance policy” if TSHTF?

      With the Justice Department after him, John Dean went to the IRS AFTER Watergate to try and implicate Nixon … but … the IRS underling he met with refused to go after anyone on DEAN’s fake list … and John Mitchell backed the refusal. So … nothing happened! There was no Nixon’s “Enemies List” … end of (an eternally false Liberal) story.

    I would like to see a for-true independent investigator, ala Archy Cox, appointed, then I’ll feel more better. I can see DoJ and IRS batting this back and forth, obscuring and obfuscating with banter about legal points and interpretations until it’s moot. I’m wondering if the usual Obama bungling will make Lerner’s lawyer jump and tell her she’s in danger of being thrown to the wolves. I do believe that she’s one of those hard-assed bureaucrats who believes that if she goes to the wall she’ll be rewarded later (think Watergate and Iran Contra). She wouldn’t be the first bureaucrat to go to jail for her beliefs in idols with clay feet rather than spill the beans. I’m interested to see if she’ll go the distance – though if found guilty a firing squad would be nice too.

    I’m perplexed about something….Why would it be a obvious “smoking gun” for DOJ to initiate contact with the IRS if, in fact, someone at DOJ was conducting a criminal investigation of 501(c)(4) groups for election law violations? I guess I can see it opening a new inquiry, but unless there it was just a fishing expedition, isn’t investigating possible crimes what the FBI does?

      The OIG report never outlined the “origin” of the targeting, only that ‘targeting had occurred’.

      From the beginning the White House claim was that a rogue element within the Cincinnati office of the IRS was responsible for the targeting. All on their own. No-one (other than hard core liberals) has ever refuted the impropriety of the targeting itself.

      The files sent to DOJ were ONLY of groups adverse to the interests of the White House.

      The auspices of origin has always been “Lois Lerner”, and essentially this has been the entire construct of the investigation. Who knew and why. The DOJ had claimed (only after the discoveries) they were given the files by Lois Lerner – but never stated they were the group asking for them.

      If they were asking for them, they were more than a mere participant from a recipiency standpoint. Now the Taylor statement reflects it was the DOJ as the primary origin and Lerner facilitating their requests.

      Why would DOJ only seek files from those applicants with adverse position to the White House ? Who would be originating the request ? Why would they be originating the request ?… and Who was the originating party inside the DOJ to begin the entire request process ?

But “profiling” based on “breathing while conservative?” If all the DOJ did was to ask for info about 501(c)(4) groups that were all conservative, anti-Nixon, oops I mean anti-Obama, then it’s an enemies list redux. The new scandals on the left, is like the old scandals of the right, and their dreadlocks have all grown longer overnight. (apologies to The Who).

      Maybe a roundabout way of justifying immunity for Ms. Lerner? After all, if it can be proven that DOJ initiated the request, not her, she might take less flack than if she (as it has been previously supposed) were the initiator, and she might be more easily persuaded to talk. In other words, if the heat is off her as the main suspect and she can prove that she was just fulfilling a request from someone else (though ignorance of the law is not usually an excuse), a deal might be made in exchange for her telling what she knew and was asked to do.

      Bet the view from the inside is that the DOJ would be implicated before too long. And this explains Lois Lerner breaking the news of the targeting at a conference – probably on orders. They wanted to do it intentionally, under controlled conditions, to isolate it at the IRS. They may have felt that something would implicate DOJ if they didn’t distract to IRS a.s.a.p.

    I’m really surprised the reporter did not follow up with the questioning. Perhaps it seemed innocuous at the time but surely when they produced the article the reporter would have thought to call and clarify…. This has the potential to be a very explosive development.

      And I hope some quiet little IRS worker who has been threatened by Koskinen etc. finds Lerner’s missing emails and hands them over, collects the million dollars, and is then put on the witness protection program and lives the rest of his/ her life in peaceful harmony while Lerner, Holder, Koskinen, etc. are spending their golden years in prison.

    This right here is why Holder spouted off so angrily at being “mistreated” by congress. He whined that no other AG or POTUS has evah been treated like this. He was angry either because he’s scared, or because he is just that arrogant. I haven’t decided yet, but I’m hoping either way the wall comes tumbling down and in the aftermath, he us crushed.

    It’s ALWAYS the cover up that gets them. Even on Benghazi, if the administration had come out and said that they were bushwhacked, didn’t see the attack coming, and we lost great Americans that night, most of us would have accepted that answer. But, it had to be some whacky video. Lois Lerner tried to put out the info, but because they were sneaky, we became suspicious. The more they cover it up, the more we want to see. I’d guess that even the truth will no longer help the IRS and DOJ. I think I hear the fat lady warming up. She’s about ready to sing.

  22. What good does it do to know about this corruption if nothing will ever be done about it? Will the DOJ appoint an investigator to investigate—the DOJ? We already know what the conclusion of such an “investigation” will be. It’s like asking the DOJ to investigate themselves to see if there’s any illegal activity. How ridiculous is that?

      No, if there’s a conflict of interest, a judge will step in…there’s already been a story about it.

      • I remember this headline once “Obama asks Eric Holder to investigate—Eric Holder” Common sense would suggest that a third party carry out any investigation, but this is Obama we’re talking about here. If it turns out that evidence of criminal activity is found I wonder who the fall guy will be?

    This is nothing since the DOJ will simply deny making any such request. The only thing that will work is a nation wide taxpayer strike. Not one more dime to the IRS until they and all other parties come clean, the wrongdoers prosecuted and frog marched down Constitution Ave. and the current tax code replaced with a flat or the FAIR tax.
