[…]  George started painting an American Flag on this canvas, but heard about Andy getting sued by CAIR (the Counsel for American/Islamic Relations) while he was working on the painting. George decided to scrap the original American Flag painting and repaint it with a Confederate (Battle) Flag.

“The caption, ‘the 2nd protects the first’ is a double entendre,” said George. “The first flag I painted on this canvas was an American Flag, but decided to repaint over it with the Confederate Flag when I heard Andy was getting sued by CAIR. The 2nd flag I painted was the Battle Flag – which we need in America in order to protect the first.”
Quite literally, the caption “the 2nd protects the first” is referring to both the Bill of Rights as well as the two flags on this canvas. You cannot have the 1st amendment without the 2nd, and you cannot have the American Flag if you remove the Battle Flag. (link)
