They were able to access the phone found at the scene with the heart sticker on it. You just have not seen any discovery about that. The state is not about to release information on a phone that would destroy the DeeDee narrative.

    • hooson1st says:

      you continue to amaze

    • recoverydotgod says:

I would think the defense would want to know what’s on that phone before they depose Ben Crump.

      • crossdraw says:

i would think the defense would at least want the voice mail of TM cell phone that way they would have a sample of his voice because didn’t TM mommy say thats the only way she could hear TM anymore

    • tara says:

Wow, that is really interesting. First they state that they couldn’t get the info off of the phone because the battery was low and/or the phone was wet. Later on they claim they couldn’t get the info because they didn’t have the password:

On March 1, 2012 I was contact by the supervisor from the Seminole County Sheriff’s Office that they could not do anything with the cell phone other than download what was on the memory chip because they did not have the password

On March 1, 2012, I was contacted by the supervisor of the Seminole County Sheriff’s Office that unless they had the swipe code they could not access the victims cell phone

      Who had the Cellebrite device?

And yes, I’m still counting the days on O’Mara. He has until Friday to file anything he would like the court to consider at the Jan 8th hearing. I find it extremely difficult to believe there was nothing to be done in that area since the last hearing considering the history of this case and considering what remains to be done. My main consideration is the SYG hearing. This judge by her history in this case so far does not seem like she will be friendly to the defense in granting continuances so if O’Mara wants to push his luck in that with her that’s on him. I am seriously doubting he will be ready for an April SYG hearing and she aint going to be happy about that but I am of course happy to be proven wrong. I guess we’ll see in April. I’m just trying to get ahead of the game.

    • jordan2222 says:

Isn’t there some unfinished business from the last hearing? If I recall, at least one motion, maybe more, were not filed on time according to her 48 hour rule.

    • jello333 says:

Here’s what I figure is going on: All the complaints that MOM/West had about the prosecution have now been taken care of “behind the scenes”. The judge told Bernie that if he didn’t straighten up, she was no longer gonna protect him in open court, and would even entertain possible sanctions motions should it come to that. Same goes for Crump. And so those two FINALLY realized they had pushed it as far as they could, and have now FINALLY started to cooperate with MOM/West. That’s the only thing that makes sense to me, anyway. Oh, and we’ve talked a lot about Gutman and his copy of the first Dee Dee tape. Well, as I’ve been saying for a couple months now… I bet he has already voluntarily talked with Mark and Don, and maybe even already turned the tape over to them. Of course none of this would completely explain why nothing official has recently been posted on the GZ Case site, but…

      • justfactsplz says:

No news is good news. The defense is getting what they need.

      • jordan2222 says:

        What do mean by this?
The judge told Bernie that if he didn’t straighten up, she was no longer gonna protect him in open court, and would even entertain possible sanctions motions should it come to that. Same goes for Crump.

        • jello333 says:

It’s just my opinion. But I have a feeling that Nelson is not nearly as out-of-touch and naive as she sometimes appears. When she says, “He [Bernie or Crump] is an officer of the court, and I’m sure he can be trusted to do the right thing,” I do NOT think she really believes that. But she puts on a show in court. I think she may have finally told those two (and maybe others) in no uncertain terms that she was done playing games. If they didn’t start cooperating with the defense team, she was gonna stop playing nice. Again… just my opinion.

          • jordan2222 says:

Thanks for clearing that up because I do not recall Nelson actually scolding Bernie .. or Crump. She did however, seem to chide West.

            • jello333 says:

A couple of lawyer types ( ;) ) here have mentioned this a few times, and it’s been my experience too: When you see a judge seemingly coming down hard on one side far more than on the other side, it’s usually bad news for the side who’s being treated “nicely”. That would be the case where a judge already pretty much knows which direction the case is headed, and so doesn’t want anyone to claim she was biased when she eventually makes her final ruling. In other words, if your side has been hammered throughout the case, but in the end the judge sides with you, chances are you’re not gonna mind all the hammering that went on earlier. Now on the other hand, if you get hammered and also LOSE… well then, you might be screaming BIAS! from the rafters.

          • libby says:

Right, she said, i played games with you in open court for months but for once they would have to do their jobs as the LAW requires (she couldnt get away with being a persecution surrogate for the entire time she presided over this case as much as she might like to).

  3. justfactsplz says:

Since nothing has been filed for the hearing, I am assuming the defense has been very busy behind the scenes. I certainly hope this is the case.

    • arkansasmimi says:

I hope its the case also. Also, there have been big holiday season just gotten done with. Maybe fixing to see some real surge in stuff going on, hopefully. Hang in there Geo and Shellie. When is Shellies next hearing? I remb her attny had filed a motion.. Geeze I am behind ;)

      • diwataman says:

        JAN 23

It only recently occurred to me that the reason that case keeps getting continued was because of something changing in Judge Nelson’s cases, I forget now what that was, this one in particular has been set for some time now to be passed on to Judge Alva.

        • arkansasmimi says:

I remb that come first of yr (2013) Judge Nelson was going to be taking on diff type cases, but was keeping Geo, and I thought Shellies too. It seems like her attny filed a motion (thanks I will go check) back in Dec.

        • Chip Bennett says:

It only recently occurred to me that the reason that case keeps getting continued was because of something changing in Judge Nelson’s cases, I forget now what that was…

Does it involve Nelson’s move to civil court in 2013 (which is why she also has Zimmerman’s defamation suit against NBC)?

(Seriously: can’t Florida find any other judges? I don’t care how impartial someone is, at some point having too many cases involving the same parties will inherently introduce a conflict of interest.)

          • allhail2 says:

The best judge for this case would be O.H. Eaton, Jr. He is one of the most respected judges in the Central Florida area. He is retired, however, he could be asked and then appointed by Chief Judge Dickey to handle the GZ case. He has stepped in when needed during retirement. He would not have to worry about re-election, therefore, any public pressure thrown his way would be useless in that regard. Even if he was still duly elected, he would not give two craps about the media, pressure, schemers, etc.

          • jello333 says:

I know, this is just bizarre. Nelson wants George criminal case. And she don’t need no stinkin’ “discovery judge” to help her with it. And she wants Shellie’s perjury case. Oh, oh…. and she also wants all the multi-million dollar civil cases! The woman sure knows where the actions is, eh?

        • Alva will be the GZ judge by the end of the month

        • jordan2222 says:

It has now been over 6 months since she was charged. Who do these delays benefit?

  4. eastern2western says:

the arizona watermelon juice is sufficient to prove there was never any struggle and george zimmerman never attacked trayvon.
Fact: the arizona melon juice was found in perfect condition in the center of martin’s hoodie pocket.
    Lets assume all possible scenarios.
    1) according to dd, she heard people rolling around on the grass and trayvon yelling get off. wow, if she told the truth, then the arizona can would had felt out of the hoodie jacket or could had been destroied.
    2) de la rionda accused zimmerman as the aggressor and he tackled trayvon. Okay, let me assume this was a surprise attack, then this imaginary tackle must be either coming from the side or the back. If de la rionda’s theory were true, then the arizona can would had either felt out of the hoodie pocket or smashed by the force of travyon falling to the ground.
However, the can was found in a perfect condition and it slipped out of the hoodie pocket when the officer tried to turn over martin’s body to give him cpr. The arizona can should be use as a circumstantial evidence to prove that martin was on top of zimmerman during the whole fight until the gun shot. It is ironic that the arizona can was the symbol of camp trayvon and it could possibly be use to zimmerman’s advantage/

    • howie says:

Juries pick things like this. At least some of them do. It is surprising what a juror might focus on. To me this seems minor. But if one juror seizes on it it could turn the verdict.

    • ejarra says:

I found that evidence that surrounds the can to be much more damaging to the state. Ergo, Why was the can removed from the 7-11 bag? The can was found under his hoodie, yet the bag was several feet away from the initial altercation.

My theory is that he removed the can from the bag to use it as a weapon while hiding between the 2 buildings east and south of the walk and the wind blew the bag out on the grass. I believe that the can of watermelon drink was in his hand, the hand that initially struck Georgie’s face/nose. Georgie said that he thought Mr. Martin had something in his hand when he had gotten hit. Mr. Martin then put the can back, sans bag, inside his sweatshirt before he continued his pounding.

This is all conjecture on my part; but, I do believe that this is exactly what happened.

      • crossdraw says:

i have been reading awile on here and i figure i might as well get in the conversation, i was thinking that TM had ahold of the top of the bag with the can in the bottom and swung the bag and hit GZ with it until the bag broke and then at some point when GZ was on the ground TM picked up the can and put in his hoodie to use it later on GZ or his lean. because if you look at the bloody pic of GZ there is a half moon mark on his forhead like a bottom of a can would make

        • tara says:

Interesting. We know Trademark left the 7-11 with the watermelon juice and Skittles in a bag. We know a 7-11 bag was found at the scene but Skittles and watermelon juice were in Trademark’s pockets. Is the bag at the scene the same bag which had formerly contained Trademark’s purchased items? Do we know if the bag was intact?

          Is this the bag? http://www.wtsp.com/images/640/360/2/assetpool/photogallery/255685/DSC_0019.jpg

Lying in the middle of the sidewalk. Why would it be there if the contents were already in Trademark’s pockets?

          • tara says:

Just noticed in the evidence section of the discovery docs, the white bag is noted as having blood on it. But the white bag is the WalMart bag. Spray from the shooting?

            • crossdraw says:

i think the walmart bag was bung out to put over the hole in TM chest while doing cpr by the cops or first responders

            • tara says:

Police document indicates that one of the first officers to arrive requested a plastic grocery bag and vaseline from bystandards so that he could seal Trademark’s chest wound. Perhaps the WalMart bag is that bag, and that’s why it had blood on it. Sorry if I’m trying to work out things that you all know. :)

          • rumpole2 says:

At 7-11…. Drink was in bag, but skittle he put in pocket. So he wandered off with a bag containing just the can… a possible swinging weapon?

            • tara says:

I don’t think he’d have time or motivation to take the can out of the bag and put it in his pocket after swinging it. I’m wondering if the bag was even Trademark’s bag. There were two bags in the vicinity, maybe just random garbage?

              • rumpole2 says:

I am suggesting (just as speculation) that he swung the bag, hit GZ nose and the can came free… not that he took the trouble to take can out of the bag.
As GZ staggered TM picked up can and put in Hoodie pocket and continued his attack.

      • rumpole2 says:

        Conjecture, but worth pursuing.
I thought similar… only that he swung the bag with can in it… can dislodged from the bag but picked up again by TM

    • tara says:

As a juror I wouldn’t find the can theory compelling. What I find compelling are 1) GZ’s notable injuries and Trademark’s lack of injuries, 2) statement by police that GZ’s back was wet and covered with grass, 3) DD2’s statement that it was Trademark who initiated the verbal confrontation, 4) Trademark’s location within the complex (not by Brandy’s house even though DD2 stated that Trademark told her he was “right by” there), 5) eyewitness statements placing Trademark on top.

      • eastern2western says:

the can theory should be part of the circumstantial evidence that shows martin was on top of zimmerman and beating on him till the gun shot.

      • jello333 says:

And the screaming. Far, far, FAR more evidence to suggest it was George, not Trayvon, who was screaming. Everything else makes perfect sense once you realize who was really screaming.

Tracy Martin and Larissa B Rozier Takira Brenae Martin (born 1999)
Tracy Martin and Cindy Lopez Demetrius Jamal Martin (born 2000?)
Tracy Martin and Brandi Green Jalen Martin? (born 2013)

Or is Brandi’s new baby Tyler Brandon Martin? If so, then who is Jalen?

      • tara says:

In a prior message by Takira, she mentioned brother Kevin. Who is that? Is he a Martin, or is this another kid of Rozier’s by some other dude? I think we need some complex math to sort this all out.

          • tara says:

Yes, and we shouldn’t forget that Brandy has at least one child by a different father. Nobody in the Trademark universe was monogamous, apparently.

Side note: It appears Chad’s father is Chester Joseph. Articles always refer to Chad as “Chad Green”, but in one court document his name is listed as “Chad Joseph”.

Unrelated to the family spaghetti bowl, but interesting IMO … both Brandy and Chester Joseph had taken someone named Marlita Williams to court. In Brandy’s case she filed a complaint on Chad’s behalf, “repeat violence”. In Chester’s case the complaint is “dating violence”. The year was 2004, Chad would have been 6 years old or so. Poor kid growing up in that environment! I’d like to whisk him away before it’s too late!

You know what I find so odd about that is the timing. I mean, not shocking that Tracy and Brandy managed to have a kid… that’s not what I mean. But if she’s just now giving birth, it means she must have gotten pregnant somewhere around late March, early April. I had kinda assumed that their “relationship” had ended right after the shooting. But if these dates are right, it means that Brandy and Tracy were still sleeping together even as the Trashcan Tour — starring Sybrina, Tracy, and Jaharvis — was going on.

          • ejarra says:

    • libby says:

It is hard to tell how many kids are involved or their relationships since they lie about their relationships so much (traydad usually has at least one wife and one fiancee at any given time). traymom was the mom that wasnt (she prolly lost custody of trayvon when she couldnt get him to go to school-truancy court).

Did y’all see the interview with Sybrina in Essence magazine? Wonder when they framed that picture? lolol!

    • That’s a good one. Sybrina quote shows she has hoplophodia:

“….When I hear the NRA’s recent comments on gun control I think they probably won’t understand until it hits their home. Only then will they say something about needing tougher gun control laws. Nobody wants to take the 2nd amendment from anyone, but I think we do need to revise the laws…..

She would keep the 2nd amendment but allow flintlocks only.

  15. raiikun says:

Heh my guess is that it’s an automated thing on the Seminole County court website, but George’s court docket is showing Alva as the judge for his case.

    • LetJusticePrevail says:

Thanks for pointing that out. I see the same thing, and reach the same conclusion. It should be funny to see how the TrayHuggers react, though.

  16. Ron Callaway says:

Sybrina there were 532 shot in Chicago in 2012, where guns are banned.
Probably 99% of shooters looked like Obama.
Kennesaw Ga. pass a law where every house had to have a gun and ammo
    and crime dropped 89%.
More people need guns to shoot back when attacked.

  17. allhail2 says:

    Sundance, you have mail.

  18. manoncanal says:

I should have said 532 killed. There were hundred more shot but survived.

  19. jordan2222 says:

send email and await response. Thanks. /SD

  20. sundance says:

D-Man, I think Judge Nelson is actually NO LONGER the GZ judge.

    D-Man please send email (unrelated)

Have I entered the Twilight Zone?
Can other people see a Dman post quoting Tony Pipitone says Defence cancelled next week’s hearing because there are no motions pending???

      • howie says:

Maybe the writ of quo warranto by shellie’s lawyer stirred up the pot. Alls quiet on the western front.

      • diwataman says:

Dude, I am so in the same Twilight Episode as you. Apparently in this episode there’s a new judge and no hearings or motions in the George Zimmerman case and no one reports on it or files it in the docket. God knows how this episode will end but that’s the fun of entering the Twilight Zone.

        • howie says:

Maybe the judge had a blood clot. Or fainted.

        • rumpole2 says:

Yes and BDLR has turned over all Discovery (though there is no court record of that)
And the phone stuff is sorted
And Crump is complying with requests
And Crump recording of DD is the best and complete copy… no need to trouble Matt Gutman
And Ping logs are so not relevant
          And toxicology reports don’t matter

  22. howie says:

Hmmm. State maybe go away? Cant’t take defense investigation?

    • diwataman says:

It’s like everyone went away, O’Mara, the judge, the state, the news. It’s like everyone just said “okay, we’re done”, lol. It’s truly bizarre. I have no idea what’s going on with this case.

      • howie says:

Maybe they let him go if he keep quiet. That might be it.

      • margegunderson says:

Except Sybrina is still around. Insisting upon” justice” $$$$$$$.

        • eastern2western says:

I do not understand why they are still asking for more money. the funeral costs are probably already paid off and they no longer need legal expenses because the state has taken over. The only time they ever need some legal representation is when ever the lawyers decide to show up and have some kind of media conference.

          • theparagons says:

They need money to go around the country and brainwash the black communities. They’re trying to get support for the trial – and I believe it’s working. Black people think George murdered TM because he was black. Most nights Sybrina sleeps in hotels. That gets pretty expensive.

      • John Galt says:

Maybe trying to get the phone and social media info in hand before attempting to depose Crump and DD.

      • jello333 says:

There’s a different kind of dark / The kind that stops the dogs to bark

    • jello333 says:

      Something is afoot…

  23. diwataman says:

“On October 12, 2012, the Zimmerman defense filed a Motion to Schedule Standing Hearings to Address Discovery and Other Case Management Issues. In response to our motion, the Judge has pre-scheduled a number of hearings that can be used if the defense or the state has motions to bring before the court. The next pre-scheduled hearing was set for January 8; however, the defense and the state have agreed that there are currently no matters that can be appropriately addressed by the Court on that date, so we have chosen to waive the January 8 hearing. The next hearing is scheduled for February 5, and we anticipate there will be new motions put before the court in advance of that hearing date.”

    • howie says:

      Velly interesting. That CRS Motion.

    • brutalhonesty says:

feb 5th huh? I posed on Insession earlier that I hope there is a massive evidence dump on either feb 5th or feb 26th, to silence any of their rhetoric on those specific dates. You know they will be cranking it up for his birthday and the anniversary of his death….hard to play victim when all the evidence of georges innocence is made public that very same day and the media jumps on it (hopefully).

  24. tara says:

Do any of the idiots who write articles about gun control in regard to the Trademark shooting realize that if GZ hadn’t been armed that night he might have ended up dead and Trademark would have been charged with murder?

It really scares me that many of these idiots vote. They are incapable of processing facts with logical thought.
