Unionized Twinkie Compromise Failed….

(Via AP)  Hostess Brands Inc. lived to die another day.  The maker of Twinkies and Ding Dongs said late Tuesday that it failed to reach an agreement with its second-biggest union. As a result, Hostess plans to continue with a hearing on Wednesday in which a bankruptcy court judge in White Plains, N.Y., will decide if the company can shutter its operations.

The renewed talks between Hostess and The Bakery, Confectionery, Tobacco Workers and Grain Millers International Union came after the company declared last week that it would move to wind down its business and start selling off its assets in bankruptcy court. The company cited a crippling strike that was started on Nov. 9 by the union, which represents 30 percent of Hostess workers.

After making its case to liquidate on Monday, the bankruptcy court judge noted that the two sides hadn’t yet tried resolving their differences through private mediation. The judge noted that 18,000 jobs were on the line and urged the company and union to try to resolve their differences. Both sides agreed to hold mediation proceedings on Tuesday.

In a statement late Tuesday, Hostess said it would not comment on the breakdown in talks other than to say that mediation “was unsuccessful.” There was no immediate comment from the bakers union.  (article)

    When I think back to all the times my Father won against the Unions, how people in his plants fought Unionization, the thug tactics and the leg of mine they almost broke; I just get angry.

      I agree with the final premise in the article — that the Feds will swoop in and interefere with the winding down of Hostess in contempt of existing civil law. I don’t know how much more it will take for people to realize that we no longer have a justice system based on impartial and established codes of conduct, but a spoils reward system based on reflexive loyalty. The screwing over of bond holders and dealerships with the auto bailout should have been a wake-up call, but no.

      And management is planning on using the liquidation to strip out assets and reward the non-unionized management signficant payouts – enough that they can afford to ride out the coming economic storm for a few years. The unionized salary workers? Not so much.

    I am upset because Hostess owns the company I love better which is Drakes. Man I grew up on Devil Dogs, Yankee Doodles, Ring Dings and Funny Bones :( (all mainly sold on the East Coast)

    Michelle has been known to say she loves fried Hostess Twinkies, so her desire to limit Twinkies was sorely pointed at others. Consumption of the treat went down hill no doubt with her obesity propaganda, backfires at herself and the union workers who voted for her American flag hating spouse. Like they say, Obama followers are like poultry following Colonel Sanders. Hopefully, Hostess also liquidates the Twinkies recipe and manufacturing patent, but not likely under union or Obama will any company revive it for a while. Once the states secedes maybe a new plant will have a chance. The liquidated plant is in Ohio? Maybe this will give union workers incentive to demand a recount or for the state to join other red states in seceding. If enough Americans are hurting…….there is no choice but to massively call for non confidence in the INCOMPETENT FRAUD. Romney was not liked by many but he had know how to save Hostess Twinkies. Too bad liberals. They aren’t laughing much at Obama winning.

    It is infuriating to me that a company has to apply for “permission” to close its doors in the first place. And this was entirely predictable, which is probably why they readily agreed in the first place. If they are smart, they are going to strip out the assets in the pension funds as part of the bankruptcy unwinding, just like Conrad Black did with Dominion Stores.

      They had to ask permission from the bankruptcy courts. They were already in chapter 11 which is a special legal status designed to hold off creditors and provides additional access to capital and government loans. This gives a company a chance to rebuild thier process and get the company back in the black accounting wise. They need permission from the original provider of this status and to show that they tried to comply with the courts instructions, but that they were unable to do so, in this case because of crushing union demands. Its more akin to avoiding being charged with contempt of court than asking permission per se.

        I understand. That was my point exactly. We are rapidly getting to the point where businesses will “not” be allowed to close/unwind. Open a business and see yourself as a serf to the system for life.

  10. Did anyone else notice, in the article Sharon so graciously provided, this little tidbit:

    “Doug Mansky, a Hostess driver in Detroit and a member of the International Brotherhood of Teamsters, was in the process of moving to a cheaper condominium on Tuesday, after his union had agreed to an 8% pay cut that he said would shave $200 a week from his income.”

    A cut of 8%, which equals $200, means that Mr. Mansky was making $2500 a week. Mr. Mansky was making $130,000 a year delivering snack cakes?

      Yep. And it wasn’t enough.
      As well, Hostess was not allowed to consolidate runs – so two separate trucks would be sent out to the same stores delivering different Hostess products.
      Eff them.
      Wonder how much of a pay cut he’s going to see now that he has NO job?

      Plus health care, retirement benefits, unemployment insurance payments, etc, etc, etc. Probably amounting to 20% more. That union driver likely cost closer to 160k a year for hostess to employ. And there were what? over 6000 teamster delivery guys working for them? Even without benefits, thats 3/4 of a BILLION dollars in shipping costs ALONE.

      And now they are bankrupt.

    Also posted on today’s OT. Catherine Austin Fitts is a very well credentialed – and smart – lady. She makes difficult concepts easy for most people to understand – especially how all of this – the “Stimulus”, the rounds of QE, bailouts, escalating labor strife – is all interconnected – and NOT for “our” benefit. All of this manufactured chaos and faux controversy (Betrayeus, etc) keeps people from seeing what is going on under the wavetops. Obamacare is a deliberative part of the deliberate “labor deflation”. Many more people are going to lose fulltime employment and benefits, and be shifted into a series of less secure, poorly compensated, part-time work while conditions are set for the predatory picking of assets by the already extravangantly wealthy. Hope! Change!

    Finally, the way the Fed has engineered the Slow Burn to date is to continually offset monetary inflation with labor deflation. It is worth contemplating how much labor deflation will be required to offset QE3 and how sufficient additional labor deflation might be engineered
