Let there be no doubt the decision to charge George Zimmerman with 2nd Degree Murder is a political decision first, and a legal decision second.

The Politics

There will no doubt be those who would naively state politics was not part of the legal consideration and decision.   That is a ridiculously disingenuous position.   Angela Corey is an ELECTED official.  Get that.  ELECTED.   So yes politics are inherently woven into the decisions of highly public cases.   Politics, and the politicians who engage in it, are tied at the hip to being swayed by public opinion.   It doesn’t matter the legal profession of the politician, they are a politician first and a lawyer second.

During a scheduled press conference today Special Prosecutor Angela Corey announced she is charging George Zimmerman with: 2nd Degree Murder

Florida Statute 782.04  – The unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life or as provided in s. 775.082, s. 775.083, or s. 775.084.

He is in custody.

In short he is accused of the unlawful killing of another, with specific intent but without malice of forethought.

BREAKING – CNN Reporting Zimmerman in Custody !!!

SANFORD, Fla. (AP) — A special prosecutor has confirmed that there will be a 6 p.m. news conference regarding the investigation of the shooting death of Trayvon Martin.  State Attorney Angela Corey says she will release new information on the case but didn’t elaborate.

Her announcement came not long after another law enforcement official said that charges are being filed against George Zimmerman, who shot Trayvon. (more…)

Oh hellz yeah…  Eric Holder should be thanking Reverend Sharpton for distracting everyone away from all that ‘Fast n Furious’ stuff. 
CNS NEWS – Attorney General Eric Holder praised left-wing activist Rev. Al Sharpton at the opening of the National Action Network (NAN) convention on Wednesday, and also stressed that the Justice Department is conducting a thorough investigation of the fatal Trayvon Martin shooting that “will examine the facts and the law.”

At the opening of NAN’s 14th annual convention in Washington, D.C., the attorney general first thanked CNN’s Rev. Sharpton “for your partnership, your friendship, and your tireless efforts to speak out for the voiceless, to stand up for the powerless, and to shine a light on the problems we must solve, and the promises we must fulfill.”  (read more)

Angela Corey is the lead prosecutor in the Trayvon Martin case. She, and she alone, will determine whether there is probable cause to arrest and charge George Zimmerman in the shooting of Trayvon Martin.

For Tracy Martin and Sybrina Fulton its the difference between getting advanced notice of the lotto numbers under the auspices of justice, or looking like they were willingly surrounded by race-baiting self-promoting opportunists.
For George Zimmerman its the difference between another step forward in the judicial process of defending himself, or the first step in putting a shattered life back together, if that is even possible  at this point. (more…)

Based on the information released it looks like George Zimmerman is in direct contact with the State Attorney General.   Apparently Zimmerman feels he has nothing to hide.
One can only imagine what Zimmerman is going through, feeling like he has lost total control of his own life.   Actually his disconnect from the attorneys is understandable from that perspective.   Fortunately, and hopefully, for George Zimmerman his father is a retired Judge from Virginia who can guide him along.
He must feel like the lonliest man in the world with everyone else calling the shots.

FLORIDA – The attorneys for George Zimmerman, the Florida community watch volunteer who fatally shot unarmed teenager Trayvon Martin, said Tuesday they have lost touch with their client and are withdrawing from the case.

Craig Sonner and Hal Uhrig said at a news conference outside the Seminole County Courthouse in Sanford, Fla., they heard that Zimmerman had contacted a special prosecutor, who will decide whether or not to press charges against him, against their advice. (more…)

From the very beginning of this now national story I have retained the same gut feeling. Initially the media rush to judgement reminded me of their 1996 attacks against Richard Jewell.  Jewell was targeted by the media as a result of an FBI leak to the Atlanta Journal Constitution ambiguously claiming he was a “person of interest” in the Olympic Park bombing.
Jewell, a security guard, discovered the bomb and evacuated the park saving countless lives, but the media took Jewell from hero to villain in days.   He fit their “profile”.  NBC, CNN, CBS and the Atlanta Journal Constitution along with the New York Times and New York Post were ridiculous in their advancement of the guilty narrative.  NBC anchor Tom Brokaw said on live TV:

“The speculation is that the FBI is close to making the case. They probably have enough to arrest him right now, probably enough to prosecute him, but you always want to have enough to convict him as well. There are still some holes in this case”.

Jewell had nothing to do with the bombing, nothing.   Eric Rudolph was eventually arrested, charged, and pled guilty.   However, by that time the damage was done.  Even though Jewell had nothing to do with the bombing his life was destroyed. (more…)

Arresting someone because they are “not black” is just as racist as not arresting someone because they are black.

Another installment in our soup to nuts deconstruction of the lies and obfuscations by the media in the Trayvon Martin case. Along with what verified fact based information we can gather.
Every Day The media looks more and more insufferably inept. You don’t charge someone with a crime unless you think you can convict them, that’s basic prosecutorial ethics. If the evidence isn’t good enough to use at the trial, it’s not good enough to use to arrest.
Throughout the past few weeks more new facts surrounding Trayvon Martin have been discovered thanks to the New Media doing the work the Institutional Lame Stream Legacy Media intentionally refuses to do. Simultaneously we discover how many lies and falsehoods are continuing. Today’s updates include:

• The Huffington Post reports that Trayvon’s girlfriend “DeeDee has finally talked to federal investigative authorities.
• Independent Prosecutor Angela Corey WILL NOT seek a grand jury indictment, and will instead decide on her own.
• The family of George Zimmerman accuses Eric Holder of racism in his non-charging of New Black Panthers for death threats.
• The motivation of Trayvon’s family is potentially tied to Florida’s “Immunity Laws” and money.

In short. This is perhaps the biggest national racial event since Rodney King. It is also shaping up to be the biggest media driven false public story since Richard Jewell. It’s in the process of becoming a watershed event; And, as more facts surface, it continues to look almost entirely fake. It’s a tempest in a teacup. (more…)

The Congressional Black Caucus will do everything within their power to guarantee Tracy Martin and Sybrina Fulton a payday.  They will engage the same political resources they exploited with Pigford.   This is all about getting some Obamabucks, albeit through the exploitative use of civil lawsuits to reward the opportunism.  
The CBC will circle the wagons and support Martin/Fulton until it is no longer politically advantageous to do so.  It’s all about the money.
Del. Eleanor Holmes Norton (D-D.C.) on Tuesday will convene a meeting of her Commission on Black Men and Boys in Washington to discuss “Lessons from the Life and Death of Trayvon Martin.”

The commission, which Norton founded several years ago, will hear from four witnesses and attempt to pull together lessons from Martin’s February shooting, which has prompted a wave of criticism that his shooter, George Zimmerman, has yet to be arrested. Authorities in Florida say Zimmerman claimed Martin’s death was an act of self-defense. (more…)

A couple of  thoughts, and here’s my take.  The special prosecutor realizes she doesn’t have a case for the Grand Jury to hear;  Not enough evidence.  Backing away from a Grand Jury quickly provides her more time to focus on a making a case with weak evidence and avoids a potentially disasterous quick jury dismissal.  It would be hard to proceed with any charges if the Grand Jury could not indict.
Also, supposedly “DeeDee” has only ‘just now’ talked to federal authorities; presumably so-too the State Attorney.   I’ve a hunch this “girlfriend” is viewed very suspiciously, for obvious reasons,  and will be thoroughly checked before any weight is provided for her information, or potential testimony.   
However, this also looms as troubling for George Zimmerman, because it shows a propensity of the prosecutor to bring charges despite the flawed or non-existent evidence.  If she (Angela Corey) had a case you can be certain the Grand Jury would be seated to hear it.  However, removal of the GJ from the process just speaks to an agenda of persuing Zimmerman regardless of factual evidence.  
ORLANDO, Fla. — A grand jury will not look into the Trayvon Martin case, a special prosecutor said Monday, leaving the decision of whether to charge the teen’s shooter in her hands alone and eliminating the possibility of a first-degree murder charge. (more…)
