the one case being heard today is Anderson v Intel Corp. Inveestment Policy Committee. This is a question that falls under the Employee Retirement Income Security Act of 1974 (ERISA). The question before the court is “Whether for claims predicated on fund underperformance, pleading that an ERISA fiduciary failed to use the requisite “care, skill, prudence, or diligence” under the circumstances and thus breached ERISA’s duty of prudence when investing plan assets requires alleging a “meaningful benchmark.”
Just guessing, this is someone wasn’t happy with their retirement savings so are suing the company that oversaw that company’s retirement accounts.
Geee … if this case ends in favor of the plaintiff … maybe we can sue Congress for the mess they made of the Medicare and Social Security Fund(s) with all their borrowing from the fund(s) wrecking the ability of the Fund managers to perform their fiduciary duties.

ERISA only requires a plan trustee to exercise diligence. It doesn’t require a profit. Seems like a very week case unless the fiduciary was reckless.

Thanks for posting. I was familiar with 3, but good to know about 1 and 2.
It would be nice to cap the Ag tax acreage without tax to something like 500-1000 acres. While I don’t mind billionaires and similar, how many buy up swaths of land never to do any Ag except maybe logging trees that take 30 years “harvest”. They don’t intend to plant anything edible. It’s Agriculture, but no value on a year to year basis. I would even be fine with hay as that is fed to cattle and is harvested several times a year.
I imagine the Ag amendment was put in by huge property owners on the order of 5-10,000+ acres. “Hunting plantations” with 30 year harvestable pine trees. No I don’t mind hunting.

The reason people see firefighters at the grocery stores is because they prepare their own meals at the firehouse.
The rotation is usually 24 on and then 48 off.
Usually, they have their own breakfast before they come to the firehouse and then they go to the grocery store and buy enough to prepare lunch/dinner and dinner/supper (two meals) for the 24 hour shift they are on.
The truck that goes to the grocery store has a full crew in the truck in case the fire department gets a call and the truck/crew has to be dispatched.
The city or municipality buys new trucks as needed, not so that the firemen can cruise around in them.
Not sure why anyone would attempt to disparage firefighters by making outlandish insinuations.

Glencore was founded by Marc Rich. Glencore sold oil to Israel during the Iran embargo in the 1970’s. He also got Mossad underground agents in Iran in the process. He used the money to invest in real estate and a lot of other things. He was indicted for money laundering, tax evasion, etc and convicted, and pardoned by Bill Clinton.
He was also implicated strongly in the Bank of New York prosecutions.
Rich and Grigory Loutchansky (USSR/ Uzbek) also founded Nordex (probably with Glencore money). Loutchansky and Vadim Rabinovich were in the US illegally when they attended a Bill Clinton fundraiser in 1995 (on my radar then for other reasons). Rabinovich worked for Nordex, then later joined the Ukrainian Rada (congress). He fled to Israel after a falling out with Zelensky.
Nordex made millions ($22 in Stimulus) on a failed deal to produce windmills in Jonesboro, Arkansas in a deal Obama personally attended to. The building was too small to hold the alleged machinery, and the 700 employees would be limited to 45 parking spaces… (on my radar at the time).
Glencore was involved with a business deal with attorney Hunter Biden representing CEFC and attorney Christopher Wray (or his immediate department at King Spalding) representing Rosneft. This was while Carter Page was being accused by Chris Steele in a ‘dossier’ of being offered roughly $19 billion by Rosneft, so a FISA warrant was issued.

Actually met one of those students. Back in 1979. At a boozy party for the University of
Dayton. A friend of my former girlfriend who had gone off to smooze, so he chatted me up

Hey everyone. Been quite some time. Been lurking here and there, but have overall taken a break from politics to focus on my health, my career and my family. But as we are now entering the midterms, I must say that from what little I’ve taken in recently, I am very concerned I am wondering what kind of thoughts everyone else has. Are we in big trouble? Should I be overly concerned? What is now happening in France should be a HUGE wakeup call to anyone who is considering voting blue or not voting (which is voting blue.) I obviously plan on voting, but I’m in a deep blue state, but will do what I can. I’m eager to hear everyone’s thoughts. God Bless!

Living in a very blue city in what has long been thought to be a reliably red state, but paying attention to what has happened unexpectedly in other red states, I don’t think we can count on Missouri or any state; every single one must be fought for. CO was once conservative, but the conservatives remaining in that once beautiful state feel like they’re living in a foreign country.
I didn’t want to believe the polls in Texas, but I’m feeling better about it now. Personally, I think Ramaswamy is going to lose, which will be terrible for Ohio.

Recently, Sundance posted a video with Victor Davis Hanson regarding his new book and Canada. Sundance disparaged VDH’s monotone and generally seemed underwhelmed by his analysis. At the time I was rather surprised as I had always liked VDH
However, once again when I disagree with Sundance I usually quickly discover that I am wrong. Today, I heard VDH on Mediaite disparaging Tucker Carlson based upon a debate Tucker had with Jacob Reese Mogg, a rather haughty and condescending British historian whom VDH described as having “seconds” in history from Cambridge or Oxford. VDH said Tucker embarrassed himself in the debate and Mogg was correct in all he said.
Curious, I found the debate on YouTube and just listened to it. I would link it but I haven’t learned how to do that and don’t have time to learn right now.
I thought Tucker was very good and very accurate and held his own remarkably well. ( I am no Tucker fan. I think he has been unstable.) I went to graduate school in history and at that time hung out with several diplomatic historians – one of whom taught at Princeton. Their ideas on WWI and WWII were in line with Tucker not VDH.
This is a long way of saying looks like Sundance is right again this time about VDH. Or is VDH just getting old and weary. It can’t be easy being a conservative in the Bay Area.
VDH has always been an actual scholar, whereas Tucker has become (or always has been?) a disingenuous apparatchik.
The two aren’t even in the same category.
VDH considers himself a military historian, and in that area he is excellent.
I have noticed many times in the last decade that he figures out what those of us who read Sundance and others’ works have long since figured out. He gets there but much later. It took a couple of years for him to appreciate President Trump, though he is acutely aware of the current dangers posed by the DSA and related Communists.
I listened to his take on the Cornell Rape (or not) case and thought it was wildly simplistic and he clearly was not in possession of even all the facts already made public.
Tucker is unstable. Despite that he manages occasionally to do some excellent interviews, and I highly recommend the interview of the man who is the caretaker of The Shroud of Turin.
