By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered:
Section 1. Purpose. The H-1B nonimmigrant visa program was created to identify uniquely skilled and highly specialized foreign temporary workers to strategically supplement the United States economy. Instead, the program has been widely abused by certain employers, third-party placement groups, and outsourcing firms to undercut and displace the supply of skilled United States labor. The large-scale, systematic abuse of the H-1B program to obtain non-qualifying foreign labor has undermined the additive purpose of the program and harmed the wages, working conditions, and job opportunities of skilled American workers.
The abuse of cheaper H-1B labor places downward pressure on domestic pay. H-1B visa holders earn far less than comparable United States-born workers, despite the statutory mandate that H-1B workers be paid equally to their domestic peers, with the estimated wage gap starting at $9,000 and climbing as high as $20,000 in H-1B reliant industries. One company even warned its shareholders that restrictions on cheap H-1B labor could force the company to use “local” workers, which “may only be available at higher wages.”
Many employers have laid off large numbers of highly skilled American workers, only to promptly hire large numbers of H-1B workers who are often lower-skilled and lower-paid. For instance, technology sector employers have collectively requested H-1B visas for hundreds of thousands of workers, yet have also laid off somewhere between 800,000 to 1.3 million American employees from 2022 through 2026. Employers have even forced laid off American workers to train their foreign replacements.
Many jobs held by H-1B workers eventually leave the United States entirely. Employers with outsourcing business models use teams of H-1B visa holders to replace United States workers at third‑party client businesses and liaise with other individuals working off-site from their country of origin. As soon as practicable, much of their own work is transferred offshore. In Fiscal Year 2026, the top six users of the H-1B program operating with this outsourcing business model accounted for over 25,000 H-1B cap registrations. One foreign country’s foreign minister even publicly admitted that H-1B “has become the outsourcing visa.”
The systematic and organized abuse of the H-1B program is also a national security threat. Domestic law enforcement agencies have investigated H-1B-reliant outsourcing firms for engaging in visa fraud, conspiracy to launder money, and other illicit activities to encourage foreign workers to come to the United States. Abuses of the H-1B program also present a national security threat by discouraging Americans from pursuing careers in science and technology, risking vital United States leadership in these fields.
Numerous executive departments and agencies (agencies) have flagged employers’ large‑scale, systematic abuse of the H-1B program to obtain lower‑paid, lower-skilled labor from abroad. These ongoing Government probes continue to identify widespread fraud and noncompliance among H-1B employers, such as: displacing American workers or otherwise giving preference to alien workers; misrepresenting the duties, requirements, or working conditions of job opportunities to avoid hiring or training American workers, falsely qualify jobs as specialty occupations, or lower applicable wage requirements; and misrepresenting aliens’ qualifications to perform specialty occupations by submitting questionable foreign degrees from diploma mills as support for their H-1B visa applications. The pervasiveness of these violations and the persistence of the violators confirm that more needs to be done to preserve the H-1B program’s integrity.
I have determined that continued efforts must be made to protect and prioritize the American workforce. It is therefore the policy of the United States that all relevant agencies shall implement appropriate measures to protect American workers from abuse of the H-1B program and ensure that the program serves the national interest.
Sec. 2. Interagency Coordination. When processing petitions, labor condition applications, and visas for the entry into the United States of aliens as nonimmigrants to perform services in a specialty occupation under section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (INA) (8 U.S.C. 1101(a)), the Secretary of State, the Secretary of Labor, and the Secretary of Homeland Security shall coordinate and consult with the Secretary of Commerce, the Secretary of Education, and the Administrator of the Small Business Administration to ensure the compliance of such petitions, applications, and visas with statutory requirements, including those in sections 101(a)(15)(H)(i)(b), 212(n), 214(i), and 274B of the INA. The Secretary of Commerce, the Secretary of Education, and the Administrator of the Small Business Administration shall provide any relevant wage, employment, academic, industrial, or other economic information.
Sec. 3. Consideration of Applications, Petitions, and Visas. (a) Consistent with sections 101(a)(15)(H)(i)(b), 212(n), 214(i), 215(a), and 274B of the INA, the Secretary of State, the Secretary of Labor, and the Secretary of Homeland Security shall take into account in any labor condition application, petition, visa, and entry of aliens entering or attempting to enter the United States as H-1B nonimmigrants to perform services in a specialty occupation whether the employer sponsor directly or indirectly engaged in layoffs within the previous year or plans future layoffs that negatively affect the employment of similarly situated United States workers.
(b) Within 30 days of the date of this order, the Secretary of Labor, through the Administrator of the Wage and Hour Division, shall begin reviewing data related to previously submitted labor condition applications to determine whether further action against sponsoring employers is warranted under section 212(n)(2)(G).
(c) Pursuant to 3 U.S.C. 301, the authority granted to the President under section 215(a) of the INA is hereby delegated to the Secretary of State, the Secretary of Commerce, the Secretary of Labor, and the Secretary of Homeland Security to the extent necessary to implement this order, including the authority to issue or adopt rules, policies, operational guidance, or other guidance to carry out this order.
Sec. 4. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:
(i) the authority granted by law to an executive department or agency, or the head thereof; or
(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
(d) If any provision of this order, or the application of any provision to any person or circumstances, is held to be invalid, the remainder of this order and the application of any of its other provisions to any other persons or circumstances shall not be affected thereby.
(e) The costs for publication of this order shall be borne by the Department of Homeland Security.

À once highly reputable hotel in our small VT city was purchased 3 years ago by à partnership of Indian businessmen. They are squeezing every last dime out of it and running it into the ground. There has been only rare, intermittent elevator service in à four story hotel. There is a constant stream of immigrant workers doing 3 month stints among only a handful of local workers. The imports live/work/isolate within the hotel. No different than slave labor. My point: these are not all Mom & Pop Patel operations.

Do you assert that loan repayment ahead of schedule is unamerican? Do you define a repaid loan a ‘subsidy’, while US Banks are given bigtime ‘loans’ at ~1% while charging US credit card customers 25+% interest?
Who else funds space launches? Who else funds tunnels under cities? [answer – mainly governemnt-funded] Musk forced the US government -NASA- to be ‘model American’, by accepting his ‘bid’ promising performance, or NO COST. Musk actually had to sue NASA to accept his bid to build working rockets, or he would not get paid. Doing what is specified in the contract, or do not get paid by the government is old-time American. An old “model American” concept that was anethma to the NASA beaurocrats.

Typically “American” government contractors ‘win’ a contract, then find new things to put on the contract initially won by competitive bidding. With NASA compliance !!! So the “new things” change the contract to make it a “no bid” contract, at high no-bid cost. Delays and “overruns” are commonplace. These are your “model Americans”? NASA was a co-opted money source, which is not “model American”. Musk turned that around, and effectively made NASA somewhat more functional, like it used to be. That is American !!
Musk proposed actual performance meeting the NASA contract deliverables, or he would not get paid. NASA didn’t want to sign such a contract, but was forced to by litigation. Can you even imagine proving to an honest American Judge why an American-NASA would reject such a contract? Why was NASA so intent on being an open money spigot for just a few contractors which didn’t meet deadlines, with significant cost overruns? Check out the overrun costs yourself. Back-and-forth employment? Other stuff?
Anyway, Musk delivered performance to NASA, apparently quickly building an organization of engineers like the original American-talented NASA engineers and contractors who were able to go to the moon decades ago, with much less ‘tech’ available. His new SpaceX business is more like the original American “can do” competency than the current batch of beaurocrats. (remember Boeing using foreign programmers for its 737 upgrade? ). (remember Disney, originally an American, animation leader with American family-supported high profit, which went-woke, fired its animation staff and made tham train their foreign replacements or lose benefits, and put out woke unpopular films? This was one of the MAJOR reasons I wanted President Trump in office. I was personally affected by this H1B visa crap… lost my dream job AND my subsequent company because of this program specifically. I never worked in my profession again… and it REALLY PI***S me off 🙁
The other issue with H1Bs is that they do not pay FICA which means a huge loss of monies into Social Security and Medicare. I never see that mentioned….

Altogether, we can see how unfair the November criticisms were. No previous Administration before Trump has risked getting sideways with the Chamber of Commerce by curbing H-1B abuse. Not even close. No prior president has dared offend academia by crushing foreign student enrollment.”

I think the Trump Administration is getting off to a very strong start on this issue….they’ve issued the Executive Order and given it lots of big sharp teeth. Applications have already dropped as much as 80% in some cases, which indicates to me the former abusers of the system are laying low, which I think is very telling and a good sign.
I think once they start looking back and investigating some of what’s already gone on it will possibly open the way for civil litigation to be taken by folks like our own Observer SC, who has been so severely harmed by the past abuses of the h1b visa program. I sure hope so.

I understand how you feel. I was affected by H1B and DEI in 2013 at age 60. I was hoping for 6 more years with my company to retire comfortably. But I was forced to work for 9 more years (interrupted by Covid) at some other companies at a much reduced salary. Not only was I robbed of time and money, I was also robbed of the satisfaction of doing a job that I loved and was damned good at. I hate those lying bastards to this day.
Between this kind of crap, moving industry and manufacturing to China, the destruction of the education system, and covid, the people of this country have taken killing body blows in the 40 years.

The Immigration and Nationality Act of 1952 created a visa for temporary foreign workers of “DISTINGUISHED MERIT AND ABILITY”. This US Citizen job-replacement program then got “dumbed down”. GWH Bush signed the Immigration Act of 1990, creating the H-1B visa for foreign nationals to work “specialty occupations” requiring a bachelor’s degree or higher => but the weasely “equivalency through work experience” is acceptable for the US Citizen job-replacement scam.
There are ~730,000 active H-1B visa holders in the US. Astoundingly, the US APPROVES ~400,000 H1B petitions annually, comprising ~141,000 new (initial) visas and ~258,000 renewals. “Renewals” means nothing has been done to train or attract US Citizens for those jobs during the entire tenure of the renewed visa. . The US issues about 140,000 Green Cards per year, about the same as the number of new H1B employees. WOW !! This is a National Emergency !!! We have lost over 700,000 jobs for bachelor degrees (or “work equivalence” – snicker, snicker) among our American citizenry. We lose about 140,000 jobs for new graduates and other capable citizens per year. Back in the 1950’s when we needed more engineers, Eisenhower signed the National Defense Education Act of 1958 to address this for US Citizens. It worked, but salaries had to be paid.
H1B employees, AND the US employer, each do not pay the 6.2% Social Security and 1.45% Medicare (FICA) tax, if the foreign H1B employees present a Certificate of Coverage from their home countries. While the SS and Medicare funds go broke, almost 15% of the salaries of over 700,000 US company employees is refused. This makes the foreign employee even less expensive than a US Citizen, and the lower-salary more valuable to the foreign employee. !!
Back when this scandal was created, what were the actual ‘skilled workers” who could not be found? The US had a high level of highly skilled citizens. There were a few highly skilled people who were foreign (but already here). John von Neumann, Enrico Fermi, Albert Einstein, Leo Szilard, Edward Teller, Robert Fano, etc. But we quickly built our own skilled worker supremacy. If any skills are missing domestically, we need to correct that, instead of making it worse.
Those who seek “highly skilled workers” not available in the US should have to precisely define the skill(s), and file written evidence UNDER OATH and subject to 18 USC 1001 (false sttements) as to how tha proposed H1B foreigner meets those skills. Those defined skills (not the potential employee skill description) must be posted on a federal database, where any job applicant can access it. If a US Citizen, after the employer has employed the foreign employee, has such skills, the US citizen can submit those skills to the EEOC which can anonymously request a statement under oath about why the US Citizen qualifications do not meet the posted skill description. The issue is not whether the foreign employee is a ‘better person”, or fits in better with the already foreign department. THe issue is whetehr the US Citizen had tehe defined skills.)
Employeers must do much more than put a vague “help wanted” advertisement in an obscure publication that is not read by job-seekers. Which is what is done now. And be required to contribute an amount determined to be a “fair salary for that skill” to capable universities to a fund used to teach that skill.

Wre learned a bureaucrat can not compel a rubber O-ring not to freexe at too-low temperatures, just because it is politically important not to delay launch. During the visit, the Inspector General conducted field checks at several locations tied to companies that have received hundreds of approved H-1B petitions. At one multi-story building housing numerous businesses linked to more than 500 approved H-1B applications, door-to-door inquiries were carried out. Many of the offices showed clear signs of inactivity: doors locked, lights off, and little to no evidence of active business operations.
“We are sending a clear message: fraud in our foreign labor programs will not be tolerated,” said Anthony P. D’Esposito, Inspector General, U.S. Department of Labor. “This investigation goes beyond paperwork—it’s about safeguarding the integrity of our system and ensuring American workers remain the priority. When the system is abused, hardworking Americans pay the price. We will not stand by while jobs are taken from Americans and H-1B fraud fuels criminal enterprises. Thanks to the dedication of our investigators and auditors, we are actively responding to every hotline complaint, pursuing every lead, and holding offenders accountable.”

It’s not just individual companies. There are entire industries built around H1-B labor just as there are entire industries built around illegal alien labor.
It’s important to understand that there are two sides to this coin. Removing the immigrants will reduce labor supply and therefore cause wages to rise. But those same industries built around cheap labor will raise prices to offset the increased cost of US workers. It’s still better in the long run, but we should be making sure people understand this.
It’s really time to invoke a National Security Emergency.
