The Supreme Court has ruled 5-4 in favor of Mississippi -vs- RNC that state legislature can decide how long after election day that qualified election ballots cast may be received. [PDF HERE] Essentially, federal election day is election day, but ballots can be received after election day for the length of time determined by state law.
Justice Barrett delivered the majority opinion, joined by Roberts, Sotomayor, Kagan and Jackson.
Justice Alito dissented along with Thomas, Gorsuch and Kavanaugh.
The Hight Court outlined that congress could change the ability of the states by changing the statutory language of the federal election law to require ballots be received by election day. As long as federal law does not outline the deadline for ballot reception, states can extend that process at their legislative discretion. THIS IS A HOT MESS FUBAR!

As noted by Samuel Alito in his well-written dissent, even during the U.S. civil war, soldier ballots had to be counted on “election day“, not days and weeks after.

The USSC will have to wander a little further from the Constitution than may be comfortable to uphold BC since now it becomes a question of Individual Sovereignty and the standing of “occupants” vs citizens. We shall see, but extra prayers are needed.
The SAA would afford RINOs some temporary shelter from the growing vitriol. This almost sounds like something cooked up during Lindsey Graham’s recent heated four hour with our PDJT.
I am disappointed (actually Mt Vesuvius is erupting in my innards) over this particular decision. It’s not a showstopper, but the train now has to halt to fix the track unless we can reroute.

I think it’s likely that they will rule he cannot.

But if they rule on the constitutionality of BC, I gather from listening to commentary on the oral arguments that the justified are not inclined to strike it down.

In the case of mail-in voting there would have to be a “Mail Your Ballot Day”. In California we just try to get it postmarked by the end of Election Day.

Paul Clement, representing the challengers, countered that when Congress initially passed the law establishing the Tuesday after the first Monday in November as “Election Day,” the casting of ballots and the state’s receipt of ballots were “so inextricably intertwined” that “no one would have thought of one without the other” – supporting his argument that a ballot is final (and the election therefore occurs) when it is received by election officials.

Make law stating that all federal election mail in ballots must be post marked 10 days before election day and put it in the reconciliation bill. If congress passes the bill then there is no interpretation issues, court battles, or any other misunderstandings. That’s the proper way and there won’t be 50 different rules that can be made up.
The Senate Parliamentarian would not allow it. McConnell or Thune should have replaced her, but have not so far.

Some facts from a search. Draw your own conclusions:
Most standard letters dropped into blue collection boxes or mail slots are not postmarked at the local post office. Instead, they are transported to regional hubs.
If you require a postmark that exactly matches the day you hand over your mail, you must explicitly request it at a post office branch.
The only way to get mail date-stamped the day you mail it, is for walk into the post office and request it be stamped.
How about bypassing the post office entirely. Take away drop boxes and sending ballots via USPS. Pass a law that says mail in ballots need to be handed into a polling place to a live person and using picture ID for every ballot being dropped off. The ballot can be dropped into a locked box after the ID is checked. In other words mail in becomes a form of early voting and no one drops a bunch of ballots into an unmonitored drop box.
Of course people with fight this so then if mail in is used via the USPS as the carrier, make it law the post marked date is at least 10 days before Election Day and the ballot has to be in the hands of the polling place monitors BY ELECTION DAY or it’s not counted. Any vote that is late is not valid.
Something can be done to fix this if the mail in balloting is going to be used by the states.
If a state allows ballots to come in and be counted after election day, they must also have a law that says NO VOTES can be counted until those ballots are in and the deadline for their being in has arrived.
No more of a party KNOWING THE COUNT.

The post office claims to take images of every piece of mail passing through it’s system. They should be able to track any individual item from where it started to where it finished. How does a ballot for Mayor of LA take a week or more to move through the postal system in one city?
