The Fifth Circuit Court of Appeals has made a massive ruling in favor of President Trump and the ICE removal process [pdf Ruling Here]. In short, throughout the nation 360 immigration judges had previously ruled that illegal aliens (applicants for admission) should be granted bond and released during the removal proceedings.
The Fifth CCA has now ruled the aliens can be detained as they go through the removal process. This means ICE captures the illegal, holds them in detention and then rapidly deports them. The ruling, which will likely be appealed to the supreme court, fast-tracks the removal.
(VIA POLITICO) – […] At the heart of the issue is a 30-year-old immigration statute that requires the detention — without bond — of all “applicants for admission” to the United States while they are “seeking admission” to the country. For decades, administrations of both parties applied this to people who had newly arrived in the country, perhaps by crossing the southern border.
Those residing in the country’s interior, often for years, were categorized under a different statute that allowed them to seek a bond hearing before an immigration judge before ICE could lock them up.
But in July, ICE Director Todd Lyons adopted a new interpretation of the law, declaring that anyone targeted for deportation by ICE would be treated as an “applicant for admission,” subjecting them to mandatory detention. That decision was backed up in October by the Board of Immigration Appeals, a panel of immigration judges who set national policy for executive branch-run immigration courts that handle deportation proceedings. This issue was a big deal during the 2012 “Unauthorized Alien Children” influx, when President Obama and DHS Secretary Jeh Johnson began releasing all the captured illegal aliens with a bond hearing. Thousands of temporary judges were assigned and NGO’s provided tens of thousands of lawyers for everyone so the illegal entrants could quickly exit ICE custody.
Later, as an expanded part of the Obama and Biden directive, the border patrol just started issuing citations on the spot for court appearances and letting the illegal aliens go into the country. Now, all illegal aliens will be subject to continued detention as soon as they are captured, pending removal.

And make them eat MREs – the same food OUR military has to eat.

In my day, MREs (1st called L-Rations for long range patrol) were highly sought after, as they were a delicious improvement over C Rations.

MREs are completely different than the LRRP rations issued to long range patrol teams. The LRRP rations are dehydrated meals. They were sought after in Vietnam because they were quite tasty and a refreshing alternative to C-rations. They were so desirable that my supply sergeant once traded four cases of them for about six pallets of 60 mm mortar ammo, for which my LRRP unit was not authorized. We weren’t supposed to have that Korean war 60mm mortar either. But then we also weren’t supposed to have those three stolen jeeps. Oregon Freeze Dried Foods still makes many of those meals today for backpackers, as they are extremely light weight.
A good supply sergeant that is a little “shady” is a must have.
I stocked up on MREs as prepper food before switching to freeze-dried for the long term. Most MREs were delicious once heated up, especially beef brisket and the chicken entrees. Plus the pound cake desserts were SO good with coffee.
But living on any restricted menu palls quickly.
I am happy to hear that the food provided for our wonderful fighting men was tasty – they deserve it.
Yea, my grandfather gave us some of that stuff – saltines, a yummy tiny biscuit and some inedible stuff.
I guess that’s right. But the late night chili bar couldn’t have been much better. That’s what we got when we missed a meal while on watch it something. But pretty sure there isn’t such a thing as field deployment in the air force or space force. In the Navy, we bring our bases with us… because they are ships. My son was on a sub though… their galley resources are much lesser than a Nimitz class carrier (which is the kind of ship I was assigned) and can’t speak to frigates or other smaller vessels either.
But the chili bar… took some getting used to. First experience was nausea though that was also my first deployment so it’s hard to know what the cause actually was but nausea on a carrier is less of a thing.
Well, i can tell you that the food wasn’t horrible on small boys (most days) but, the carrier I was on had a lot more variety and better hours than we ever dreamed of.

We had field exercises in the medical field in the U.S.A.F. Overseas we used the golf course to set up quonset huts and slept in tents, showered in the clubhouse.

Perhaps ICE acquiring multiple, large facilities suitable for repurposing as detention centers reflects confidence that the SCOTUS will uphold the law as written. The same prescient confidence may have predicated the President’s “softening” of the ICE roundups in MN.

Dot checks, ICC checks, roadside driver medical checks, tear the busses apart on the roadside, check every lug nut, screw, airbag, steering linkage, then tow the busses, leaving the stranded passengers roadside, bus company needs to send another bus.. rinse, repeat…. Then do a cursory check of the passengers, bench warrants, alimony payments missed, unpaid EZ pass balances. When collecting fines or unpaid state and federal fines you now have a FINANCIAL trail to find out who finances, pays, the protesters. There are no problems, just solutions.

I like that the 5th Circuit talks about the INA…because it’s clear that there’s no such thing as birthright citizenship. I think there’s some message sending there for SCOTUS.
Don’t see how it has anything to do with citizenship. But the interesting question is just what rights does an “applicant for admission” actually have? And not even considered are those who were admitted but have violated their visas (typically, over-stays) and those with “parole” status.
Simplify it.
Wait in line if you want in, go through an extensive background check and vetting process, take a test and pass it (twice is enough) within a specified amount of time, get sworn in as an American citizen, keep your nose clean. If you skipped any of this, detention and deportation with no possibility of reentry. Your significant other and any minor children go with you. (You wanted a better life for them and yourself, but you blew it. Life’s tough, you should get used to it).
Temporary workers, students, vacationers, etc. — same vetting process, keep your nose clean, leave when your permit has ended, or be detained and deported with no possibility of reentry. If you brought or had children while here, they’re your responsibility, not ours. You are not a citizen, so you are not allowed any benefits that a citizen is.
But: You have “legal status.” Which means that you DO have rights and protections.
These people are instead being “trafficked.” They are purposely(!) being placed in a defenseless position. Their desperation is being exploited. Ruthlessly.
“Deportation” just might be the best possible thing that could happen to them. Seriously.

Note that this ruling, unlike the lawfare supported FEDERAL District Court Rulings , LACKS the NATIONAL APPLICATION language that the lawfare supporting FEDERAL District Courts ALWAYS include. Which is as it “legally” should be.
So, for illegals apprehended or living within the jurisdiction of say the 1st FEDERAL DISTRICT COURT will be protected from this ruling by any lawfare supporting FEDERAL JUDGE or MAGISTRATE, who will assuredly affix a sweeping nation wide application to that ruling.
The results of the fickle finger of random Judge selection for the appeal will be interesting to see as the composition of the 5th Circuit “theoretically” favors President Trump’s Team:
5th Federal Court
Supervisor: Justice Alito
17 Active Judges: 4 x Bush II, 3 x Reagan, 5 x Trump-McConnell, 5 x Democrats
8 Senior Judges: 3 x Reagan, 3 x Bush I, 2 x Democrats
I use Trump-McConnell for Judges appointed 2017-2020 as there have been cases where Trump-McConnell District Judges have sided with the lawfare lawyers and then there is the Supreme Court with 3 x Trump McConnell Judges.
For those not familiar with Federal District Court composition, a group of “Senior Judges” is kept on staff, who have “retired” from full time service and who are kept on staff with full privileges … and are available to be assigned cases. Many democrat senior judges have played prominent roles in allot of lawfare cases … as a “shopped Judge”.
I think the 5th Circuit in New Orleans is generally considered pretty conservative. What’s needed is differing decisions in other circuits so the USSC can settle the matter.
Those other decisions have already been made in several other Federal District Courts. The USSC has watched decisions being made and unmade for a year as well as lawfare supporting Federal Judges issuing NATIONAL LEVEL TRO’s (which are illegal and contravene USSC findings).
So, how long is the waiting period??
