Pretty much had to, as the argument the DoJ was making (that two-year appropriations from FY25 could not be obligated in FY26 unless there was also an FY26 appropriation) is BS. I mean, if the admin can “find” unobligated prior year appropriations to pay the military without FY26 appropriations it pretty much blows away that argument.
I think until Jan 26 the administrative costs of SNAP are shared 50-50 with the states, so they are correct that a portion of the funding must go to the states for that, not for the EBT cards.

The US Government is still collecting taxes, isn’t there a way around this? At least 2 things need to happen. Congress passes a bill that nothing can stop the payout of certain funds in a shutdown especially related to safety and security. Second, Congress should pass a law that if there is a shutdown, they forfeit their pay, just like the military and public safety.
