If FISA-702 did not exist, the quasi-constitutional justification for the wholesale collection of U.S. citizen metadata no longer exists. It really is that simple.
There is ZERO justification for the capture of U.S. citizen data by the government. The capture itself violates the Fourth Amendment. The only way the government can justify the capture of U.S. Citizen data is if there is some quasi-constitutional or national security reason for it.
Take away “702”, and the data collection collapses; ANY “incidental” search of the database then loses any plausible legal justification. 702 is the camel’s nose under the tent.

“FISA” is not a “court” by any plausible sense of the word. How can it be a “court” when the judge hears only one side, and the defendant does not even know s/he has been named? Every now and then, a judge figures out that s/he has been lied to, but how often do they not?
This level of surveillance – of American citizens – serves no legitimate defense or other purpose. It is simply being done because it is possible. And, no doubt, because there’s a stupendous amount of money in it for some.
That’s normally also the premise & method under which “red flag laws” are implemented. ‘Ex parte’ über alles.
Right, the ‘red flag’ laws sound logical, until a million exes and other disgruntled people use them to persecute innocent people. The govt can’t be trusted to apply laws fairly, that is why we have constitutional protections.
Ex-parte is an abomination to the liberties & due process rights under the Constitution.
It’s coming to be common in Guardian/Conservatorship court processes. It can strip all independence & financial rights from a senior. An abomination.

Also, even in this case the Judge has to pace a large degree of trust in the evidence used to establish probable cause for the warrant … Just like the FISA Warrant process.
The crimes in all of this are …
The spying that generates the evidence used in the court … violates 4th and 5th Amendment Rights of those who’s data was collected.
The lying that the evidence cleared what ever process was used to vet it’s authenticity, to establish probable cause.
Finally, the Judges should be held to account for all the perjury that has been proven in the FISA Warrant applications involved. Also, the Garland DoJ, which IGNORED all of Judge Collyers findings v/v/v the NSA Report assembled by Admiral Rogers.
The 702 process that Sundance refers to is the FISA 702 Query capability that authorized users of the NSA database can use to gather data on a named target. These are the queries found to violated 4th and 5th amendment rights by FISC Judge Collyer after she reviewed the NSA Report by Admiral Rogers.
Then there is actual SPYING and data collection done by NSA, which is also technically a violation 4th and 5th Amendment rights. Somehow Congress Congress felt it is within their power t just cancel these rights, with amendments to the Constitution via the Patriot ACT.
The Constitution may ONLY be amended by a Constitutional Amendment, NOT by statutory law (laws passed by Congress). It is the Supreme Law of the Land, and may NOT be amended by a hierarchically inferior level of law.
But the political clas tries over & over, esp DEMOCRATS.

FISC is the acronym for Foreign Intelligence Service Court, while FISA is the acronym for Foreign Intelligence Service Act – which act created the court which is supposed to determine the legality of any warrants those using the act are trying to get approved or if such warrant is not authorized.
The problem -other than the whole thing is so anti-constitutional – comes in the form of the FBI and other agencies actually lying to the court as to the information the agencies are using when they apply to the FISC to approve the warrant.
It was designed to safeguard US citizens Fourth Amendment rights and of course the agencies found their workaround to defeat any teeth the lawmakers thought they were putting into the law when it passed.
Especially when the judge is “in” on the crime!
FISC is literally a Star Chamber. Not authorized by the Constitution for use on U.S. citizens.

It was initially created to try powerful individuals who could not be brought before ordinary courts, but it became associated with arbitrary and secretive judicial proceedings.“
The arbitrary nature of the FISC is exposed when it is compared to court-issued warrants for wiretaps / collection of personal comms that must meet 18 U.S.C. 2511 (or 18 U.S.C. 2518(7) in emergency situations) and 1st and 4th Amendment requirements.
Isn’t Judge Immergut from Oregon, the one who thinks she can try and block the Nat’l Guard a protege of Boasberg on the FISA Court?
The worse part of all this FISA business was it was the fix for IC faults identified by the Church Committee in 1975.
It says a lot that the IC cannot even be bothered with upholding the low bar set by the FISA process at that.

I practiced law for quite a while. There is no such thing as “quasi-constitutional” in the United States. In Canada, the bedrock of all things reasonable and serious, there is such a thing, but not here. U.S. government action is either constitutional, or it’s not. There is no middle ground, half-pregnant, gray area.
But the “national security” petard has been used by the U.S. government for decades to violate our constitution in many different so-called “quasi-constitutional” ways
Regarding 702, the argument for capturing all Americans’ metadata (i.e., everything we do, everywhere we go, everything we say in writing) and putting it into the mind-boggingly massive NSA database for easy and quick warrantless reference any time the government wants, is that MAYBE there is an American out there who’s working with a foreign terrorist.
National security, therefore, requires that we collect all that information without a warrant, Your Honor. You know, just in case we need it quick-like.
