Thanks. I remember reading that – and the comments – in July, but it sheds no real light on the matter. It is very mystifying how Boelter claims that Walz asked him to do it, more would come out in the future (it hasn’t), and there was a VERY IMPORTANT LETTER in his van that he begged officers to find before it was disappeared.

I wrote a Substack article laying out the details of this case this past weekend. The case only broke into the open with an Emergency Hearing called by her on Friday afternoon last week.
The basics of the case are this — 14 West African’s were deported to Ghana on September 7 even though none of them were from Ghana. Five of the 14 filed a lawsuit in D.C. claiming that they had obtained protection from being returned to their home countires — Nigeria and Gambia — in their normal DHS deportation proceedings based on a finding of credible fear of persecution or torture if that were to happen.
The five are aliens who entered and remained in the U.S. illegally. US law says they must be removed. The immigration process imposed some restrictions on where they could be removed to. Removal to Ghana was not one of those restrictions. But the plaintiffs claim — without actual EVIDENCE — that removal to Ghana was all a subterfuge, and it was always the plan between Ghana and the US that the aliens would be sent by Ghana to their home countries after a short stopover in Ghana. The details of the removal process are included in my Substack article.
At the conclusion of the hearing last Friday Judge Chutkan expressed a conclusion — based only on affidavits from aliens who never appeared before her and who want to return to the US — that DHS was engaged in a “wind and nod” operation with Ghana to evade the orders from Immigration judges that the 5 deportees not be sent to their home countries. But she took seriously the question about whether she had any jurisdiction to provide the remedy they were asking for.
Late in the evening on Monday she issued a ruling denying the requested relief that the Trump Admin be ordered to tell the Ghanian Govt to not transport the five plaintiffs to their home countries. She found she did not have jurisdiction to do so.
But she didn’t let that minor inconvenience stop her from issuing a polemic diatribe against the Admin based on information that has not been verified in any fashion — she just accepted the allegations made by the plaintiffs’ lawyers.
Before I get to her comments, let me make on thing clear — as stated above, these are illegal aliens who had entered the country illegally, had not right or privilege to remain, had been afforded due process resulting in the order they be removed, and had their opportunity to express their “fears” about removal. They raised no concerns about Ghana. There is no allegation they face persecution or torture in Ghana.
Yet they seek a remedy whereby a federal judge is going to ORDER the President, as part of his powers over foreign affairs, to ORDER the government of a sovereign country to do or not do something with individuals who are currently within the borders of that sovereign foreign country.
They ask for this when they are outside the United States and have no right to be inside the United States.
And a U.S. District Judge took seriously the idea that she might do so absent any jurisdictional bar that prevents her.

For over three decades, through five presidential administrations, this country has adhered to its obligations to treat refugees humanely and to comply with the Constitutional requirement of due process, which is afforded to all persons present in this country, regardless of their citizenship status. “[T]he Due Process Clause applies to all “persons” within the United States, including [non-citizens], whether their presence here is lawful, unlawful, temporary, or permanent.”.

In recent months, the government has embarked upon a series of deportations which signal a drastic change of course.

But it is 100% undisputed that these 5 plaintiffs received due process — they went through full Sec. 240 deportation proceedings, including the opportunity to obtain withholding of removal. That was all the due process the Congress and Supreme Court say is necessary.
They have no due process claim to make because “due process” does not include the right to demand that the Executive branch order a foreign sovereign government to do or not do something that is the prerogative of that government to do or not do.
The various procedures being used by the Trump Admin. to deport a greater volume of illegal aliens are necessary ONLY because the Obama and Biden Admin. abandoned the idea of having sovereign borders that were a barrier to illegal immigration into the US. The Trump Administration didn’t allow 20 million illegals to enter the country. But the Trump Administration has a LAWFUL DUTY to see that the laws are faithfully enforced, and that include the laws against illegal immigration.
Judge Chutkan:

Plaintiffs are not Ghanaian citizens, have no connections to Ghana, and did not designate Ghana as a potential country for removal during their immigration proceedings. They were taken to Dema Camp, a remote, open-air detention facility surrounded by armed military guards.

When you don’t want to go back to your home country, and you are sent to a third country, it is pretty much a given that you are not a citizen of that third country — just like you are not a citizen of the U.S.
The only obligation DHS has is to not send you someplace the Immigration says you should not go to — there are not obligations to arrange suitable accommodations for you when you get there. Sorry, but turn-down bed service and a mint on your pillow don’t come along as part of your “due process.”
Judge Chutkan:

Although Defendants agree that it appears Ghana is violating the assurances it provided to the United States, and agreed that this practice “is not okay, ” they claim that they cannot prevent this repatriation because the U.S. government “does not have the power to tell Ghana what to do.”

Defendants’ actions in this case appear to be taken in disregard of or despite its obligations to provide individuals present in the United States with due process and to treat even those who are subject to removal humanely. These actions also appear to be part of a pattern and widespread effort to evade the government’s legal obligations by doing indirectly what it cannot do directly.

“Appear to be taken….” — based on what evidence?? The only “evidence” in the record is what one plaintiff says he was told by government officials, and that he has been sent to Gambia. But there is no EVIDENCE that the U.S. was part of that decision-making. Ghana has a history of free elections going back to 1992, and there has been a peaceful transfer of power each time. Ghana’s citizens elect their leaders to enforce Ghanaian law – not U.S. law or the orders of US immigration judges. The fact that Ghana may not have followed through with its pledge with regard to one individual should inform U.S. decision-making in the future but it says NOTHING about the agreement reached in the past for how Ghana would handle these deportees.
They received the “due process” to which they were entitled. They were sent to a country.
Judge Chutkan:

[I]t is not the first case in which plaintiffs allege that the government has deported or attempted to deport them with no notice or opportunity to contact family or counsel.

If an illegal alien has a “Final Order of Removal” they aren’t entitled to get any notice or opportunity to contact their family or counsel. Transportation out of the country is the final step. They can call family and counsel when they arrive at the location they are sent to.
This comment by Judge Chutkan is either wilfully dishonest or it reflects an ignorance of immigration process by a District Judge — likely as a result of the fact that District Judge’s have no role in immigration cases.
Judge Chutkan:

Nonetheless, despite the danger Plaintiffs now face as a result of Defendants’ actions, and as explained below, the court cannot grant Plaintiffs the relief they seek because Plaintiffs have not met their burden to establish that this court has jurisdiction to order such relief.

Defendants — DHS — sent them to Ghana pursuant to an agreement that Ghana would not send them on to their home country. There is NO EVIDENCE — only an allegation — that this agreement was a ruse. At least as to one of the five it might be the case that Ghana did not abide by the promise it made. That doesn’t mean the U.S. was wrong to accept that promise.
These plaintiffs were going somewhere — the obligation of DHS was to find a country that would take them. All were from West African nation, and they were sent to a West African country that allows other West Africans to enter without a visa. That’s what happened.
The outrageous part of Judge Chutkan’s opinion is that she accepted uncritically the truthfulness of every claim made by the Plaintiffs and their attorneys when there is no factual basis in the record to do so. That decision by her is a simply and plain manifestation of her overt hostility towards the Trump Administration.
Judge Chutkan:

D.A. Decl. ¶ 19 (“[A] Ghanaian military commander came to Dema Camp and informed me and the other people detained here that government officials from our countries would be coming to the camp to see us tomorrow morning. . . . We were told we will be removed the next day, on September 13, 2025.”)

D.A. is not the plaintiff sent to Gambia. The Plaintiffs’ counsel had to come forward and update the Court on Monday, Sept. 15, that the four remaining Plaintiffs — including D.A — had not been removed, they were still in Ghana.
Judge Chutkan has NO EVIDENCE of who D.A spoke to, what authority that person has, or whether such a conversation ever actually took place. I suspect a Nigerian citizen deported from the U.S. wouldn’t have much reluctance to make whatever claims might be necessary as part of an effort to get taken back to the U.S.
Final quote from Judge Chutkan:

While the Supreme Court upheld the district court’s order that the government “facilitate” Abrego Garcia’s “release from custody in El Salvador,” it provided little reasoning or instruction regarding the district court’s jurisdiction over the relief it had ordered…. And the Court cautioned against district courts encroaching upon “the deference owed to the Executive Branch in the conduct of foreign affairs.” Id.

Because even emergency orders from the Supreme Court “constitute[] a precedent that commands respect,” Nat’l Institutes of Health v. Am. Pub. Health Ass’n, 145 S. Ct. 2658, 2663 (2025) (Gorsuch, J., concurring in part and dissenting in part), this court cannot reasonably determine that Plaintiffs’ situation here mirrors Abrego Garcia’s predicament.

I suspect Judge Chutkan had to dictate those two paragraphs as it is difficult to type with your “hands clenched in fits of rage.” That she had to acknowledge the words of the Supreme Court telling other liberal progressive district judges to quit obstructing Trump Administration polices must have galled her to no end.
Actual final Judge Chutkan quote:

The court does not reach this conclusion lightly. It is aware of the dire consequences Plaintiffs face if they are repatriated. it is alarmed and dismayed by the circumstances under which these removals are being carried out, especially in light of the government’s cavalier acceptance of Plaintiffs’ ultimate transfer to countries where they face torture and persecution. But its hands are tied.

If only the framers had recognized the wisdom of allowing any one of the 677 district court judges to step in and play POTUS when the need arose, this country would be a much better place!!!!! How shortsighted of them to not foresee what a benefit it would be for judges’ hands to not be tied when a foreigner in a foreign country needs to have a federal judge order the Executive to do something to help him out.
The failure to provide such an avenue should have us all rethinking the wisdom of the Constitution in all respects.
