Ninth circuit..should be gone. Re. Tariffs.
The 9th Circuit did not handle the tariff case ruled on today. It was the United States Court of Appeals for the Federal Circuit, which is a specialized court of appeals.
That’s correct! The appeal decision today was from the unanimous ruling by a three judge panel of the United States Court of International Trade (formerly the US Customs Court) that the IEEPA did not authorize tariffs. In fact, the judges pointed out that the word “tariff” isn’t even mentioned in the IEEPA neither is there language suggesting tariffs such as duties, imposts or import taxes. The initial three judge panel of the CIT consisted of two judges appointed by Republicans and one by a Democrat. One of the judges appointed by President Trump was an aide to Robert Lightizer the US Trade Adviser to President Trump. The case will be appealed to the Supreme Court.
While some of us have been scratching our heads for the last 50 years wondering how the Founding Fathers could have possibly left the Constitution exposed to Judicial Tyranny – Of course the answer is the geniuses didn’t, a paragraph of the Federalist Papers was posted on the internet a few months ago explaining how the Court’s opinion was only considered a final decision because they have no enforcement mechanisms – that’s the check on them, they really can’t do squat.
The Executive has the Power, and the Legislative has the Money – the two major enforcement levers in life.
Do you see that perfect balance of separated power: a neutered decision maker, with the enforcement mechanisms distributed to the other 2 branches of government. So what the Court will do (very appropriately) is align itself with either of the other 2 institutions that it judges to be correct. And if the other 2 institutions (directly controlled by the people) align against the Court, then the Court has made themselves irrelevant.
How brilliant is that!
It’s common knowledge that for long periods of time in U.S. History the Courts have been toothless – this is why, arrogant people stepping out of their bounds and dissipating the power they wield through Prestige. This is exactly the kind of disintegration we need to happen to the Activist Court system in the United States.

Part of the problem today is that there are so many in CONgress that would vote to impeach and convict if President Trump ignored court “rulings” which are, correctly stated, just opinions; opinions are not enforceable law.
The IEEPA authorizes The President to take measures that protect the US from activity originating outside US that presents an unusual danger – like China flooding our shores with fentanyl.
Or economic hardship – like the 80 yrs of one way tariffs levied only against the US destroying our manufacturing base – once he declares a national emergency.
President Trump determined “measures to protect” are rightly to be tariffs. He is well within his authority to do so. Regardless of what the lawfare activist courts say.
Time energy and resources will once again need to be wasted appealing to the SCOTUS, for yet another activist-smackdown.

I noticed Newsom made a snarky comment on X about the tariff case. Is he even aware that California levies a tariff on imports? Yep, CBP provides the California Franchise Tax Board with import entry information (pretty silly) which California employs to collect a user tax. No matter what they call it, it functions as a tariff. In fact they used to have a customs department, but I think they changed the name. This tariff collection likely violates the Constitutional prohibition against states collecting duty or tonnage tax without turning it over to Treasury. Secretary of Treasury should send Newsom a demand for payment, once DOGE figures out what they owe. Might as well also bill them for the CBP hours spent enforcing California’s alcoholic beverage import regulations.
I’d never heard of that before. So is this for imports for California sale only? Or is this a duty tax for anything coming in through California ports?
FTB issues a demand for payment, the importer must provide dox proving the shipment went out of state to avoid the duty.

Good morning! I normally go over to The Still Hour to do my daily rosary prayer comment but I think there is some kind of glitch where it is not allowing me to make a new comment or post the new comment by replying to existing comments. Plus there does not seem to be a link in this post to take one over to The Still Hour.
For those newer people unfamiliar with The Still Hour, I believe it came about as a way for our wonderful poster Stillwater to have a special place for the prayers which used to appear in the Daily Presidential Thread and it’s really nice for those of us who like to check out the prayers but not interrupt the flow of the Daily Presidential Thread. I post a comment with regard to praying the rosary on things and found a youtube video for praying the entire rosary (20 decades) at a time but just the usual five for a designated day (such as the Glorious Mysteries on a Sunday) is also good! Or just to know about it, that Mary will crush the head of the serpent is a good thing to know!

Here is the game plan that the forces against Trump will be using for the foreseeable future.
They will attempt to get you to make the perfect the enemy of the good.
Be it the freedom clowns and spending, the immigration hawks with H1B visas, the peace doves with timing, the cultural warriors with total bans of DEI/CRT, the neocons with war fighting, or the swamp dwellers with draining the swamp.
All of them will attempt to get you to believe on whatever issue is the issue of the day that it doesn’t go far enough or do enough. They will try to make you think that some sub issue of that issue is more important and should be handled first, that since the issue hasn’t been handled yet it won’t be, that we can’t do more than one thing, that so and so is a plant to stop the draining of the swamp, or that because it wasn’t 100% Trump lied. On every single issue, one or more groups will attempt this strategy.
You can’t allow them that power over you. If Trump secures the border and deports 2 million, don’t allow them to reduce that good by them saying well he didn’t deport 2.5 million, so he failed or lied.
You can’t allow them to use the perfect to void out the good in the coming months.
They will try. They already have with the CR and the H1b visa debates. It works, that is why they use it. You have to keep it in the front of your head on everything about to occur that half a loaf or hopefully in most cases 7/8ths a loaf is better than no loaf.
Do not allow them to gaslight you into thinking the good is the enemy of the perfect.
In the real world, most things are never perfect, but if we try real hard, we can get plenty of good accomplished in the coming 4 years.
President Trump is transparent in his words and actions. He is consistent in what he says, what he does, and what he asks/demands of others. His promises are bold and he keeps them like no other president has. He is making massive, nearly overnight changes, not only in our country, but in the world. It is amazing that he is able to accomplish so much when there are so many snakes in the grass. This term, he is weeding them out faster. No U.S. president has ever faced so much organized resistance and treason than President Trump
The purpose and goals of President Trump are plainly visible by his actions and consistent: He is for the benefit first of the common PEOPLE of this country, then of the PEOPLE in the rest of the world. It is validating, even to our battered conservative skepticism.
The methods of his leadership are amazing. I still don’t get HOW he does it, or HOW he is able to get so much momentum going, but every day the momentum is growing. Everyone and every organization has their eyes opened every day — just by watching him. Even those who hate him, are biased against him, and want to see him gone — cannot ignore him. He lives rent free in their head, and they come around to seeing the universal principles by which he is operating. He hammers actions based on truth from one direction, then another, and they cannot mount an organized opposition against him.
He has chosen to use his intellect and every skill he has to do what is right. He has tremendous faith that he can make a difference in this world. He has a confidence and courage such that he doesn’t care what others think, yet a humility to know he has to do it with the help of like minded people. Those people are the “common” people, and he ridicules those who think they are not common.
He believes people are basically good. He believes that God is real. He believes that healthy people are happy people, and they need to be able to create wealth freely for their labor, and have the freedom to spend their money on what is good for them.
He believes the United States, with its Constitutional Republic, is the best environment in the world to enable and give opportunity for people to be happy and prosperous.
He believes that we can be a light for the world, but we must demand that the rest of the world respect us and our right to life, Liberty, and the Pursuit of happiness.
He believes the enemy of our country are the stupid, greedy American people who have been selfishly taking advantage of this country; who betrayed the trust and obedience of its people; and who diverted the people’s wealth for their own selfish gain, at the expense of the principles of this country. He’s not going to allow that anymore.
He has cultivated and focused the family of MAGA. Identifying those people whose goodness, industriousness, trust, and obedience have been taken advantage of and abused. He has opened our eyes to this abuse, and the rights of freedom and self determination that have been quietly stolen from us.
He has rekindled the healthy distrust of government and men with too much power held by our founders. He has recultivated the desire to reclaim our freedoms and rights, and is empowering us with a hope and pathway to reclaim our spiritual and economic freedom.
He wants the US to be a light of hope on the hill for all people. He will negotiate win/win agreements with those nations and countries who respect us; who respect the principles and intent of our Constitution. If you do not respect us, however, we are not going to let you take advantage of our goodness, or share in our wealth at our expense. If you as a nation are treating your people badly, you are going to be treated less favorably by us, until you show that you value your people as much as we value ours.
He is convincing those who are very wealthy (most of whom truly earned their money), that the best economic soil in which to build wealth is in a constitutional republic, which supports the ability of the common man to earn wealth in proportion to his efforts. The economic engine of the United States is the human spirit freed to enjoy the fruits of honest labor, and that engine has more natural and raw horsepower than any other governed economy.
The Trump Train seems to be remarkably aligned with universal principles of Truth, which reflect the will and design of our Creator, and are the best standard by which we should live. These same principles were what our country’s founders used to declare independence, and framed into the Constitution of this nation.
Our founders believed that a nation should preserve the right and freedom of an individual to seek, understand, and live by God’s principles. They believed that free individuals working together in humility would make a stronger nation than a government which dictates its will on the people. President Trump professes and seeks to lead and restore this nation back to these same principles.
These principles resonate deeply within all human beings, down to our DNA in every cell, in our spirits, and produce fruit that “miraculously” multiplies. Because we follow universal principles, we see the snowballing acceleration of momentum on day 223 of the 2nd term of this very stable genius in the history of the kingdoms of this world in the year of our Lord 2025.

It takes time to successfully wipe hard drives on servers, computers and cell phones. Aggiegirl: The busiest days fo the week for air travel. Also, the criss-cross pattens simply indicate the normal flight paths of aircraft, east/west and north/south. There are highways in the sky. Look up water vapor pressure and contrails (or vapor trails) and you will learn the physics and chemistry that fully explains the persistent trails in the sky. The trails will come and go, depending on atmospheric conditions.

Back then the SSN record (aka Numident) was maintained on a small slice of cardstock in a file cabinet in Baltimore. The records were not computerized. There was no process in place or need at the time to show that John Doe was dead. That all changed with systems modernization.
Should the government in 2015 have gone back to show that John (and all the others in the 30’s, 40’s and 50’s) were dead? Perhaps, but at the time a determination was made that it wasn’t too costly.
Now with automatic data exchanges between states and government agencies, death data is propagated from one system to another rather quickly. In short, John Doe wasn’t a scammer. He was just some guy who got run over by a train.

Exactly. My complaint was with the misleading chart and the inference that all these people are/were receiving checks. As in my example, John Doe may have never worked at a job or received a social security check ever. He simply had a number assigned to him.
When the SSN data base was created in the 1930’s, there was no field the record to enter a Date of Death. That field wasn’t added until sometime in the late 1980’s I think. The government had to make a decision whether or not to go back and retroactively show the date of death on millions of records for folks who had been dead for decades. For many, it just didn’t seem cost effective.
Sure there’s fraud in the system, and certainly there are checks being sent to people being deceased. That’s wrong. But it’s nothing like being shown in this chart. The administration should have made this clear when DOGE first released this data, but it made for good headlines to keep it misleading. I’m surprised it’s still circulating.
