President Trump Via Truth Social – “TOTAL VICTORY in the FAKE New York State Attorney General Letitia James Case! I greatly respect the fact that the Court had the Courage to throw out this unlawful and disgraceful Decision that was hurting Business all throughout New York State.
Others were afraid to do business there. The amount, including Interest and Penalties, was over $550 Million Dollars. It was a Political Witch Hunt, in a business sense, the likes of which no one has ever seen before. This was a Case of Election Interference by the City and State trying to show, illegally, that I did things that were wrong when, in fact, everything I did was absolutely CORRECT and, even, PERFECT. Every single Dollar was thrown out, even the penalties imposed on us by the Corrupt Judge, one of the most overturned in History, Arthur Engoron.
I wasn’t given a Jury and, during the course of the Trial, which lasted a long time, was not given one Ruling in my favor by this Political Hack, but worse than him, if that’s possible, was Letitia James, a Corrupt and Incompetent Attorney General who only brought this Case in order to hurt me politically. She is a Trump Deranged Lunatic! They made me bond the outrageous sum, which never happened before, and which cost me Millions of Dollars a month.
It should have never been allowed to happen, and everyone knew it! Importantly, the Vote was 5 to 0. I am so honored by Justice David Friedman’s great words of wisdom, which should be read by everyone. I would also like to thank the Court for having the Courage to make this Decision, which is already going down as one of the worst business persecutions in the History of our Country.
Sadly, there are other Cases against me that are equally disgraceful, including those headed up by Corrupt Judges, like Juan Merchan, whose daughter collected Millions of Dollars in Fees from Crooked Joe Biden and Kamala Harris, while her father shockingly REFUSED TO RECUSE himself from a vicious and corrupt trial, which is also under Appeal, one in which every Legal Pundit in New York said, “THERE WAS NO CASE!” — Even Editorial Boards said, “DO NOT DO THIS!” Judge Merchan gave me an unprecedented Gag Order, not letting me talk about him or his daughter, or the fact that the Appellate Judges thought he should not be doing the Case, but he did it anyway.
Many Lawyers said that his daughter and him created the Greatest Conflict of Interest they had ever seen. Judge Lewis Kaplan, the other remaining Case, whose wife, family, and friends attended his two trials, is as mean and nasty as anyone I have ever met.
That Case, also on Appeal, should also never have been brought, and he should be admonished for Abuse, and every other thing that can be thrown at a Corrupt Judge. He loved the publicity, and would not let us present the irrefutable evidence that we wanted to present. This Clinton appointed Judge should not be allowed to get away with this SCAM….
….These were all Political Trials in an effort to destroy my viability as a Presidential Candidate before, during, and after the Election. They were strongly coordinated with the Biden/Harris Campaign, and will go down in History as among the most Corrupt Cases ever brought. These two Cases are even more ridiculous than the Corrupt Letitia James Case, and will be found out to be so in the very near future.
All of these Judges should be ashamed of themselves for allowing them to happen. They are Political Hacks who did everything possible to hurt me as a Candidate. This was an attack by the Biden/Harris Administration on their Political Opponent, ME.

This case should have never been brought in the first place. PDJT should sue her and the state of ny for malicious prosecution. He should recover his attorney’s fees and go for punitive damages.
Not a total victory, the appeals court still (wrongly) says that Trump committed fraud. All they said was that the penalty was excessive. But since this is a NY court, that might be the best Trump can hope for here.
This is a ruling by the intermediate appellate court, the Supreme Court-Appellate Division. Trump can appeal to the NY Court of Appeals, which is the highest court.
I expect he will. The Appellate Division was all over the place on the fraud issue, and clearly wants the Court of Appeals to be the court to decide.
In the Appellate Division, two judges found Trump was properly held liable, and James “vindicated a public interest” by pursuing her fraud case, but the penalty was an excessive fine that violated the U.S. Constitution. Two other judges also found James had authority to sue, but a new trial was necessary because the trial judge should not have held Trump liable for fraud at the outset. The fifth judge said the case against Trump should have been dismissed.
I think this panel from the Appellate Division might be mostly NYC area judges (they sit in panels around the state). The Court of Appeals has seven judges, so there are likely several from other parts of NY. The entire Court of Appeals will hear the case.
The verdict on the case was automatically (which is rare) referred to the NY Court of Appeals. The SC-Appellate Div at least made that move, which clears the hurdle of the NY CoA refusing to hear it.
I immediately noticed that CYOA decision by the court. If the court had found James did not properly have cause to bring charges then an earthquake would have been felt in the whole liberal lawfare world. Now they will just quibble about process.

If it’s fraud then most every homeowner in America is guilty of inflating their value for loans while deflating their value for taxes. As an ex tax assessor I dealt with hundreds of people who claimed their value was lower even shortly after a sale, an appraisal, or a loan that proved it was not. People would say ” I overpaid” but it is not considered fraud to try this.
I even went to a local board of appeals to defend a tax value where the owner claimed they paid a certain price but recorded documents showed she was lying. She lost that one but still not fraud.
No ….what you do for the state is fraud upon a property owner. Property Tax is one of the most egregious taxes there is. The fact that you can have your property appraised by 3 different appraisers and end up with 3 different valuations shows that many states can and do abuse this fact. Property taxes, estate taxes , are morally unjustifiable as is ax on SS.
Appraisals are estimates based on similar sales. If a house down the street is exactly like yours and sells for $X then your home is valued at $X. Unfortunately there are rarely exact matches so appraisers have to pull value from similar home sales.
If two homes sell that are the same except one has a 2 car garage and the other has a one car garage, with a sale price difference of $5k, that might mean an extra stall garage is worth $5k, maybe. A skilled appraiser would evaluate the motivations of the sellers/buyers, time on market, list price, and many other factors to arrive at the “estimate”. Appraisers/assessors are not allowed to simply value a property at the sale price. They must establish the best method for each jurisdiction and apply that consistently to each property.
Your insinuation that tax assessors defraud property owners is baseless. If you have evidence, let’s hear it. In MN a tax assessor is tasked with valuing properties as accurately as possible. Once the year is finished, each jurisdiction is evaluated by the state to verify that the overall assessment is within a range around +- 5%. If the assessor is out of that range the state requires the values for an entire neighborhood to be adjusted. How is that fraud? If your home is valued +-5% of what you could expect for a selling price on the open market, it is as accurate as possible.
Obviously you don’t know what you’re writing about because if you did you would separate taxation from the valuation aspect. Tax assessors do not determine what your tax rate is, politicians do. Maybe that is the fraud you erroneously assign to tax assessors.

The only thing that was harmful to the local markets was the farcical charges and ruling itself. The court tried to criminalize the standard commercial real estate financing practice that was legal and had existed to the satisfaction of both developers and banks for decades.

That statement alone should have disqualified both the case itself (blatantly violates the Equal Protection clause under the 14th Amendment) and James’ ability to ever again practice law in NY (or anywhere)..

Not being a practicing lawyer, I don’t know OldDog. But I didn’t follow Trump’s attorneys’ filing /submittal to the Appeals Court that struck down the absurd fine.
I have seen it mentioned recently by several prominent commentators (former attorneys, judges, politicians, journalists) that a LOT of mainstream laws have been blatantly violated during Obama and Biden’s administrations without ANY objection or pushback by their respective Depts. of Justice.
So I guess PDJT’s attorneys have to know what arguments are “acceptable” or “unacceptable” in each court. That is twisted and NOT the justice our Constitution provided, but unless we can all get together and shut down cities with peaceful protests to change that corrupt practice, there’s not much else we as private citizens can do.

Isn’t it ironic that Big Trish claimed her building was 4 units rather than 5, causing the “marketplace” harm by using an erroneous definition of units that affected the value of every other building of the same type.
The example would come from a sale where a seller claimed his building is 5 units but the buyer says, no, Trish has the same type building and it is considered 4 for loan purposes so the buyers would only pay value based on the amount of rent available, thus the monetary harm to owners and sellers.

Trump has a guaranteed appeal to the Court of Appeal (NY’s highest court) on the fraud convictions because at least two judges dissented on that point.
This is a big deal. Without a guaranteed appeal (called an “appeal as of right”), you have to ask the Court of Appeals to hear the appeal. It’s a very big uphill climb on that.
Getting to the highest court in a state is like getting to SCOTUS. You must request permission. Some things (like death penalty sentences) are automatically appealable to the highest court, but something like this would usually need permission. Unless two judges in the appellate court disagree, which apparently happened here. So the Court of Appeals will have to take this case (not that I’d expect them to turn down a petition to appeal from Trump.)
Oh, and the next place to appeal, if somehow Trump lost in the Court of Appeals would be SCOTUS.
