In very simple terms, the Supreme Court ruled today (6-3) that federal judges can only grant relief to the individuals or groups who brought a particular lawsuit and may not extend those decisions to protect other individuals without going through the process of converting a lawsuit into a class action, a type of litigation that requires challengers to clear procedural hurdles. The Supreme Court did not rule on the merits of the end to birthright citizenship for children of illegal aliens. However, the Trump administration and DOJ are very happy.

I’ve suspected that the administration filed for cert and SCOTUS took it just because the case would allow the Court to stop the nationwide injunctions without getting into the weeds of substantive law, and in this case, law going back to the drafting of the Fourteenth Amendment..
It might appear on a quick reading that Trump only won on the injunctions issue, but the Court just left the birthright issue for another day. No doubt some dimwits in the MSM will be crowing “At least Trump lost on birthright citizenship.”
So, where does this leave the status of the children of illegal aliens born over the next year or two? Does the removal of the injunction prevent them from obtaining citizenship until either the whole case is decided or a class action and new injunction can be created?
I assume their births will be registered in the US, and until then, they can claim citizenship.
Children of foreigners with diplomatic status do not get birthright citizenship if they are born here, as their parents have diplomatic immunity (that’s what the phrase “subject to the jurisdiction [of the US] thereof” means.).
Not to mention being required to pay income taxes or subject to Selective Service registration or (in the old days) required military service.
As I said elsewhere they still technically not citizens. One cannot benefit from the crimes of another, especially a family member. Yet in the eyes of Democrats, if you are a Democrat or support Democratic ideology you’re above the law.

There was a guy on Fox talking about it. Basically it is up to the States and the District judges in the states whether to register them as citizens or not. So he said the patch work won’t work and the Supreme Court will eventually have to deal with it. He said it’s their job. Let’s hope it’s before Justice Thomas retires.
Despite what you may hear on MSM , getting certification that you can proceed by class action is far from a certainty. Most sought don’t get it. And it’s very expensive and can take 10 or 15 years to prosecute.

So the DOJ lawyers may be working through the Fourth filing motions in each injunction case; the DOJ will move to have the injunction in each case limited to the particular parties in the case (with standing).
And no doubt the lefty judges will have their law clerks drafting new orders certifying class actions.
They can do class action suits, but those have a lot more hurdles to clear than one judge issuung an injuction.
Doesn’t the CA suit have to be brought by the “injured” party, not the judge or law clerk? No doubt this is where they are going however, CA suits take a lot longer.

Absolutely. The Left was just dying for Trump to disobey a judge, and every Dem judge was no doubt hoping his or her order would be enough to provoke Trump to disobedience.
But Trump had some very wise counsel, and does know how to play a long game, too.
At some point, I suspect the Administration is going to have to disobey one of these judges. We’ve already seen with Boasberg that these judges are prepared to disregard the class action rules and immediately certify a class. If the Administration can’t get emergency relief from those decisions, the bad guys will be able to run out the clock on the deportations and on the other issues for which injunctions have been issued.
And I do hope all the nay-sayers here took note of the praise POTUS gave AG Bondi at the end. He mentioned something very important…those arguments on behalf of the DOJ were worded perfectly, not allowing any rejection due to the improper wording…which has happened not very long ago.

The FACT that six Justices were OK with signing onto an opinion where Justice Barrett took a personal shot at Justice Jackson is a VERY STRONG indication that Jackson has alienated her colleagues and there is a growing lack of respect for her work.
Justices circulate Memos among with their legal views on certain cases in order to bring others around to their thinking.
Given what she has written in her dissent, imagine the memos that Jackson must have sent around in this case.
