So if I understand correctly, this can either be charged as a misdemeanor or a class D felony, depending on the type and level of physical contact.
Use of a weapon would open the door to enhanced penalties, but that won’t apply in this case. She did, however, physically assault at least one federal agent, and that physical assault opens the door to a felony charge.
It’s not clear in the clip above, but on the day the story broke, when agents were telling her she couldn’t be getting physical with them, one video showed her yelling something to the effect that “I’ll touch anybody I f***ing want to!”
So I do hope that video is used as evidence of intent and she’s charged at the felony level, because I think in her case it’s appropriate.
I’m not even sure the prosecutors will need to ask for a change of venue. Given the present political mood in New Jersey, I think it’s possible they might even be able to empanel a jury that will convict her.

Correct. The jury pool is selected from multiple counties. New Jersey has only one federal district but has 3 courthouses. The Camden courthouse would select from the south Jersey counties which have sizeable red areas.

Trespass, interfering with police, pushing and shoving (assault), loud (disturbing the peace) are all criminal acts. They are crimes for which you can be arrested and are prosecutible in criminal court, not in civil court. They are mostly misdemeanors but can arise to more serious charges. But the point is they are criminal acts covered by criminal statutes.

Sorry to seriously disagree. Depending on the state, an assault can be merely threatening to push or hit someone, while battery is making physical contact. These laws are there for a reason: to prevent alterations from escalating into serious physical harm/death to any party. This can, and does, happen “when tempers flare.”
I see no equivalence to the J6ers, who were mostly overcharged and over-sentenced on nonsense conspiracy charges and what not. If any of the J6ers laid hands on LE, they should have been arrested. Accounting for mitigating factors like intent, lack of prior criminal history, and high emotions comes later. Defending a fellow protestor from abusive LE? That’s a defense to present to the charging district attorney and, if it comes to that, to the jury.
If the good congresswoman had plopped her ample behind on the ground and refused to move and had to be dragged away screaming, THAT would have been civil disobedience/protesting. This was not that.
