(Dept of Justice) – Today, Attorney General Pamela Bondi announced charges against three individuals responsible for the violent destruction of Tesla properties. All three defendants will face the full force of the law for using Molotov cocktails to set fire to Tesla cars and charging stations.
“The days of committing crimes without consequence have ended,” said Attorney General Pamela Bondi. “Let this be a warning: if you join this wave of domestic terrorism against Tesla properties, the Department of Justice will put you behind bars.”
♦ One defendant, also armed with a suppressed AR-15 rifle, was arrested after throwing approximately eight Molotov cocktails at a Tesla dealership located in Salem, Oregon.
♦ Another was arrested in Loveland, Colorado after attempting to light Teslas on fire with Molotov cocktails. The defendant was later found in possession of materials used to produce additional incendiary weapons.
♦ In Charleston, South Carolina, a third defendant wrote profane messages against President Trump around Tesla charging stations before lighting the charging stations on fire with Molotov cocktails.
♦ Each defendant faces serious charges carrying a minimum penalty of five years and up to 20 years in prison.

I am pretty sure that is an ATF “regulation” in the 1934 legislation that sought to put restrictions on fully automatic firearms.

It is my understanding that suppressors were subject to that tax stamp ($200 , unchanged all these years) because the authorities were fearful that the whitetail deer population would be decimated by poachers during the hardships of the Great Depression.

Most people do not realize that Molotov cocktail devices are classified as Destructive Devices by the DHS ATF under federal law and mere possession is a federal felony. From GROK3: In the U.S., at the federal level, Molotov cocktails are considered “destructive devices” under the National Firearms Act (NFA) of 1934, regulated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Under 26 U.S.C. § 5845(f), a destructive device includes any explosive, incendiary, or poison gas bomb, or similar device. Possession of an unregistered Molotov cocktail violates 26 U.S.C. § 5861(d), which prohibits possessing a firearm (including destructive devices) not registered in the National Firearms Registration and Transfer Record. Penalties for this federal offense can include up to 10 years in prison, a fine of up to $10,000, or both, per 26 U.S.C. § 5871. Registration requires an ATF Form 1 (for making) or Form 4 (for transfer), a $200 tax stamp, and a background check—though, in practice, Molotov cocktails are rarely registered due to their improvised nature and lack of lawful purpose.
State laws often impose additional restrictions. For example, in California, possession of a destructive device is governed by Penal Code § 18710 PC. This is a “wobbler” offense, meaning it can be charged as a misdemeanor (up to 1 year in county jail and/or a $1,000 fine) or a felony (16 months, 2 years, or 3 years in state prison and/or a $10,000 fine), depending on the circumstances and the defendant’s criminal history. The prosecution must prove the person knowingly possessed the device and knew it was destructive. Exceptions exist for lawful purposes (e.g., military or law enforcement use), but a Molotov cocktail typically doesn’t qualify.
In Michigan, under MCL 750.211a, it’s a felony to manufacture, buy, sell, furnish, or possess a Molotov cocktail or similar device, punishable by up to 4 years in prison and/or a $2,000 fine. If possessed with intent to harm or damage property, penalties increase to up to 15 years and/or $10,000; actual use causing property damage can lead to 20 years and/or $15,000. Intent isn’t always required for basic possession charges, making it a strict liability offense in some cases.
The District of Columbia’s law (D.C. Code § 22-4515a) prohibits possession of a Molotov cocktail, defined as a breakable container with flammable liquid and a wick or a device designed to explode on impact. Penalties escalate with prior offenses: 1-5 years for a first offense, 3-15 years for a second, and 5-30 years for a third or subsequent offense. During a state of emergency, possession is restricted even at home or business, tightening the rules further.
Globally, laws align on treating Molotov cocktails as illegal. In Canada, they’re an “explosive substance” under the Criminal Code (Section 82), with possession punishable by up to 5 years. In the UK, the Explosive Substances Act 1883 bans them, with severe penalties for possession or use.
Defenses in the U.S. might include lack of knowledge (e.g., not knowing the item was a Molotov cocktail), lawful purpose (rarely applicable), or illegal search and seizure. However, courts consistently view these devices as inherently dangerous, with little tolerance for possession outside regulated contexts. The improvised nature and historical use in riots or terrorism mean laws are enforced strictly, often without requiring proof of intent to use—just possession itself is enough.
