Not unexpectedly, U.S. District Judge Amy Berman Jackson has ruled that unelected bureaucrat, Hampton Dellinger, the U.S. Office of Special Counsel head has more unilateral power within the executive branch of government than President Donald Trump. [RULING pdf HERE]
This ruling stems from the same mindset as former AG Bill Barr, former FBI Director James Comey, former Deputy AG Sally Yates, former IC Inspector General Michael Atkinson, and the entire organization of professional Lawfare activists that includes Mary McCord, Andrew Weissmann and Norm Eisen. The collective belief is that in the modern “continuity of government” framework, the bureaucracy of government controls things, not the elected and plenary President.
Basic constitutional civics has been destroyed in the modern era by progressive advocacy saying the executive branch is an omnipotent organism that is not controlled by the duly elected President of the United States. Current Lawfare activists and activist judges seek to retain this bastardized view of constitutional government.
Let us hope the Supreme Court finally puts an end to decades of this ridiculous nonsense. The earlier ruling in the Presidential Immunity decision indicates SCOTUS is positioned to do exactly that.
(Via POLITICO) – A federal judge ruled Saturday that President Donald Trump’s firing of a federal workforce watchdog was illegal — teeing up a Supreme Court showdown over the president’s claim to nearly absolute control of the executive branch.
U.S. District Judge Amy Berman Jackson concluded that Hampton Dellinger — confirmed last year as head of the Office of Special Counsel — may continue to serve his five-year term despite Trump’s effort to remove him from the post via a brusque email last month.
Jackson ruled that Dellinger’s duties, which include holding executive branch officials accountable for ethics breaches and fielding whistleblower complaints, were meant to be independent from the president, making the position a rare exception to the president’s generally vast domain over the executive branch.
Dellinger’s “independence is inextricably intertwined with the performance of his duties,” Jackson wrote in a 67-page opinion. “The elimination of the restrictions on plaintiff’s removal would be fatal to the defining and essential feature of the Office of Special Counsel as it was conceived by Congress and signed into law by the President: its independence. The Court concludes that they must stand.”

The Congress and a President cannot usurp the Constitution. This requires a constitutional amendment. Therefore that law is invalid. The judge has, again, violated her oath to the Constitution. She should be impeached, by the Congress, which also violated it’s oath to the Constitution.

Our representative Republic was well-designed – we need to get back to the Founders’ vision. Repeal the 16th Amendment which allowed the Federal income tax – we did just fine without it up to 1913 when it was ratified. All the pernicious growth in the Federal government is because of it. Repeal the 17th Amendment which allowed direct election of Senators by the people instead of being chosen by the State legislatures – Senators now are just glorified Representatives instead of being held accountable to elected State legislatures.
Then, Trump must hand out pre-emptive pardons like candy and appoint a special council everywhere. I guess I file a lawsuit claiming I don’t pay taxes anymore because the 3 co-equal branches of the government described in the constitution no longer exist. Welcome to the Balkanized United States.
This ruling presents the key issue squarely on the facts.
If SCOTUS holds to the unitary executive principle announced in US v Trump, it will rule Congress has no power to constrain the power of the Exectuive to remove ayl subordinate executive branch employee, and that is game over for the administrative state.
I hope the case is expedited. A ruling returning the Republic to its constitutional underpinnings cannot come soon enough.
The judicial lawfare against President Trump can be stopped in one of two ways. We could wait for these lawfare cases make their way to the Supreme Court and hope they rule in our favor or Congress can pass a law prohibiting federal district court judges from making any rulings effective nationwide. I know Senator Lee (R) is working on the legislation. I believe it could pass in the House but it would be a heavy lift in the Senate to get the required 60 votes unless they put it into a spending reconciliation bill.
Is Continuity in Government anything like Interagency Consensus? That was the key takeaway from Trump impeachment 1. President Trump had the nerve to disagree with the Interagency Consensus and thought he was president and not them.

The judge is a judicial activist.
There are three separate but equal branches of government, Judicial, Executive, and Legislative. In the United States these branches constitute the separation of powers.
In the US these branches derive their power through consent of the governed.
European governments do not recognize such rights and are not defined or necessarily limited by their constitutions.
Therefore, this judge, by referencing a ‘bureaucracy’ separate and unaccountable to consent by the governed, is acting as a foreign agency and attempting to rule over the executive branch.
It’s shocking actually that a person who purportedly studied law and our Constitution could ever reach such an opinion.

If the GOP appoints a special counsel to investigate Democrat misdeeds who is later fired by a Democrat president then Berman Jackson would rule in favor of the Democrat president.
This is no different than lower courts filled with Democrat appointees now ignoring SCOTUS precedent forbidding states to enact draconian laws and allowing them to do just that or letting the case languish on the docket for 1-2 years to allow gun grabbing states to “win” until it gets to SCOTUS which could take another 1-2 years.

It cannot stand that Dellinger would have the authority to override the President’s judgement on how executive branch officials are to be dealt with. So…the Federal Judiciary now assumes the authority of the President of the United States? How is this possible? I’m not a Constitutional Lawyer, but I can read! I see NOWHEre in the US Constitution, that some “judge” can overrule the Executive Branch and the President. In fact, the Constitution soenstn even recognize the existence of federal courts!
