SCOTUS finally got an appeal of a district court’s TRO preventing Trump from firing someone. Person in this case is the Head of the Office of Special Counsel. Amy Berman Jackson is the judge. DC Circuit wouldn’t suspend TRO.
What’s unique about this one is that the office is a purely executive branch agency. Not a question of whether Congress specifically appropriated money for this.
Acting Solicitor General also suggested the Court address all the other TROs barring Trump from taking action in the Executive Branch. I doubt it will do it ( it’s called sua sponte – sort of spontaneously deciding, “Hey, we’ll look at this issue, too, even though it wasn’t raised in the appeal. It’s related, and we might as well decide it now.”).
Question is: Can the President fire someone in the Executive Branch?
Even if the Court limits itself to this firing and this TRO, there could be some good general language that the Trump administration could use in the other TRO cases.
DC Appeals Judge Florence Pan and Judge J Michelle Childs were the same two Leftist Appeals Court judges who INCORRECTLY ruled that President Trump had no PRESIDENTIAL immunity from prosecution for official acts whatsoever last summer! Now they ruled that President Trump cannot fire the head of the Special Counsel’s Office agreeing with Amy Berman Jackson!
Their Presidential Immunity decision was overuled in a caustic retort by Chief Justice Roberts. Seems these two activist judges haven’t learned from there earlier mistakes or they have no fear for their judicial misconduct so they just did the exact same thing?

Because those bimbos have lifetime tenure and can’t be removed except by impeachment.
Being reversed isn’t judicial misconduct, although some lower court opinions are so bad sometimes that it’s clear that the actual law had nothing to do with their opinion.
Roberts is the supervising justice of the DC Circuit, but he will likely refer this to the full Court. Yeah, he’s a flipflopping weasel, but he’s smart enough to know when the full Court should address an emergency appeal.
Lifetime tenure, yes.
But Congress can defund their courts, so that they no assistants or aids, no supplies, or budget.
Or Congress can completely eliminate the courts, dissolving their judge positions.
If the Left is squealing so loudly about DOGE exposing the financial end of the Swamp…imagine what the Left would do should MAGA take over Congress and begin eliminating the districts of the activist judges? Like the Constitution states clearly Congress has the power to do?

What is “good behavior?” Failure to recuse oneself in an obvious case of self-interest-dealing is not good behavior. Ignoring the prior and recent ruling about a President’s plenary powers is not good behavior. Ignoring the Constitution’s principle of separate branches of government and the limits, therefore, over another branch in a casual, non-thoughtful directive is not good behavior.

The high threshold for completing a judicial impeachment was put in place back when there was an implicit assumption that congress would be objective. In an era where these decisions on the left are 100% political and voting is lock step, the threshold is too high. A republic relies on good faith of its elected officials, but we no longer have that.

I think the question is going to be can the Congress specify in law conditions that constitute a firing offense for Executive branch officers confirmed by the Senate. In this case the fired SC is challenging Trump as the law says the removal of the OSC Special Counsel is by “inefficiency, neglect of duty, or malfeasance in office”.
The Constitution vs the special counsel law?
Yes, that’s what the law says, but the enabling statute for the CFPB also said the same thing as far as firing the head of the agency – “malfeasance, inefficiency or neglect of duty.”
In 2020, SCOTUS said that President Trump could fire the head of the CFPB anyway. Seila Law LLC v. CFPB.
I look forward to the fired head of the Special Counsel’s office talking his way around this precedent.

“In the last five years, this Court has twice held that restrictions on the President’s authority to remove principal officers who serve as the soleheads of executive agencies violate Article II—in those cases, the single heads of the Consumer Financial Protection Bureau and the Federal Housing Finance Agency. See Seila Law LLC v. CFPB , 591 U.S. 197 (2020);Collins v. Yellen, 594 U.S. 220 (2021). Whatever the agency, for the President to discharge his constitutional duty to supervise those who exercise executive power on his behalf, the President can “remove the head of an agency with a single top officer” at will. Collins 594 U.S. at 256. On that basis, President Biden in 2021 fired the single head of the Social Security Administration without cause.
There are only four single agency heads upon whom Congress has sought to confer tenure protection: the Directors of the Consumer Financial Protection Bureau (CFPB) and Federal Housing Finance Agency (FHFA), the Commissioner of Social Security, and the Special Counsel here. The former three are undisputedly subject to at-will removal under Article II. This Court’s precedents foreclose any special exception for the Special Counsel.”
It’s clear that Congress has no say in the firing of an Executive Dept. official that reports to the President.

He told me he’d dig a big hole with the bobcat, way back in our yard, just in case he dies first.
No. First off, when a person dies in hospital and a cause of death certificate is issued – (don’t know about if they die at home and not reported) it is required to get xx copies of death certificate and make reports to Social Security being the number One agency, the bank (for authority to close or keep account open if there are members of family as joint owners.
Social Security will not deposit any more monthly payments (which aren’t inheritance funds) to the one specifically stipulated bank account used for all monthly payments. The dead person’s account is effectively closed for monies from Social Security. Frauds stem from the use of the dead person’s card either by family, was stolen, used or sold to fraudulent fake id enterprises and even religious, charitable organizational personnel.
My MIL died a few years ago. A couple of days before her death she received her SS deposit. She dies on Saturday. By COB Tuesday the funds had been taken back from her account. No questions asked. Just in and out in a matter of days.
If a 369 year old is receiving SS payments I’d hazard a guess there’s some kind of scamming going on…

The final payment of my late husband’s social security (11 years ago) was taken back (automatically) by SS within a couple weeks after his death. Just SWOOSH!!! and it’s back out o there.

I remember a time when both DH and I were not getting salaries. I had been laid off by the airplane manufacturer in St. Louis January 1991, didn’t find employment for 8 months. We survived it, but didn’t have children to take care of.

It sure looks like there are going to be a lot of things we can do to cut down on the costs of the “entitlement programs” without threatening social security. Huge waste, fraud, and abuse especially in Medicare and medicaid, as well as private contractors such as the big insurance companies and pharma.

Now we didn’t see now many of those eligible accounts are taking disbursements. If these extra IDs are people that simply don’t exist, what percent are cashing the checks?
About 72 million received some SSA benefit in 2023. Applying the same ratio to payouts, 71.6 / 1.14 = 62.5 million real recipients, and 9.1 million extra accounts could be taking benefits? That’s a lot of unaudited payouts. Surely someone in SSA must know.

(1) The enormous calculation and processing costs in time, money, and human resources (and how to handle, e.g. now-dead taxpayers, and defunct companies’ contributions, and how far back does one go, and let’s just tie up Congress for the huge and messy legislation necessary to do this, not to mention recalculating stuff like social security and other entitlements, and multiple tax returns), all with little overall benefit to the country versus cleaning up the debt.
It’s silly and it’s unworkable.
