President Trump’s lawyers were allowed to view a preliminary draft of Jack Smith’s report from the documents case in Florida, under strict rules. After a review, the lawyers wrote to the DOJ demanding the political lawfare report not be released [PDF HERE].
Obviously, the report is a political hit job intended to target the transition process.
Because there are still two codefendants in the case, Judge Aileen Cannon has issued an injunction blocking the release of the report until after an appellate court can hear arguments.
FLORIDA – […] Cannon’s order, issued at the request of two Trump allies who were co-defendants in the classified documents case, bars the Justice Department from releasing the report or any portion of it until three days after a federal appeals court rules on the issue.
The order bars Garland, the Justice Department, Smith and “all of their officers, agents, and employees, and all persons acting in active concert or participation with such individuals” from “releasing, sharing, or transmitting the Final Report or any drafts of such Report outside the Department of Justice.”
Cannon’s order does not apply to Trump or his co-defendants, even though Smith contends they inappropriately revealed aspects of the report — which they have reviewed in recent days — in a Monday court filing. In that filing, Trump revealed Smith described him as “engaged in an unprecedented criminal effort,” as “the head of the criminal conspiracies” and said he harbored a “criminal design.” (read more)

The Special Counsel report, no doubt, reflects documents and testimony protected by Federal Grand Jury Rule 6e which prohibits the release of evidence until it is publicly admitted and presented to the jury in a criminal trial. Any violation of the Rule 6e is punished as a one year misdemeanor and many federal agents and investigators have been prosecuted for it’s violation even unintended violation.
For some unknown reason federal judges particularly in the Washington DC District Court routinely ignore violations of Rule 6e when it’s perpetrated by the Lawfare Division of the DOJ or Washington DC U. S. Attorney’s Office.
This is yet another reason why President Trump should take action to abolish the Washington DC District Court and fire the Federal Judges that were appointed to it. If there’s no district court in DC there’s no need for any judges! Any cases arising in DC can be assigned to either Northern Virginia or Maryland Courts on a “random” basis!

Amen. There is no justification for the existence of a DC District court or Circuit court of appeals. It should all go to surrounding States or to a random assignment to other federal courts in one of the States.
The District of Columbia is not a State. It has no Senate representation. Therefore the nomination process for DC federal judges is notably unlike the process used for other federal court judges.
Nominees as federal judges for other district and circuit courts go through the “Blue Slip” process, where the Senators from the State where the court is located can recommend or veto nominees. But since DC has no Senators they skip over that step.
There is an Equal Protection case to be made why federal courts in DC (and US territories like Puerto Rico, Guam, etc.) have a different and easier approval process from most of the federal bench.
Disestablish the DC Circuit and stand up a new circuit on the west coast by splitting the overly-huge existing 9th Circuit into two circuits.

Judge Cannon’s ruling is just the beginning of Jack Smith’s legal woes. Judicial Watch announced today that Georgia’s Fulton County Superior Court has ordered Fani Willis to pay them over twenty one thousand dollars in legal fees and court costs related to her refusal to provide them with all communications between her and Jack Smith, (and the January 6 Committee as well). Willis was, and is, required by law under the Georgia Open Records Act (ORA) to comply with the Judicial Watch request. JW further testified that Willis’ office at first denied that any such records exist, then admitted they do exist but still refused to supply them, thus violating ORA.
As I read JW’s announcement, this fine is levied against Willis herself and must be paid by her within two weeks of the order.
Since Jack Smith and Fani Willis were pursuing separate cases against President-elect Trump, any communication between their offices and/or members of the Jan 6 Committee is verboten!

This is what I can tell you. Four days ago that same Fulton County Superior Court found Willis in default of JW’s lawful request and ordered her to produce those records in five business days. So paying the fine doesn’t exempt her from turning over the documents. How it ends, I can’t say but it isn’t going to go away.
