With the explosion over the years of the huge federal bureaucracy, with umpteen departments, agencies, divisions, and “officials”, the common understanding of the Senate’s “advice and consent” has got out of hand. It’s unwieldy. It’s time-consuming. It’s wasteful and ridiculous. And importantly, as to many, many appointments, it’s arguably an unconstitutional encroachment on and micromanaging of the President’s authority.
This was never what was envisioned by those who drafted the Constitution. It’s time that some of this was reined in, ruled on by the Supreme Court, so that it’s clear what is and what is not within the Senate’s (and Congress’s) purview.
Because right now, the President can appoint “czars”, and the First Lady can have all kinds of taxpayer-paid useless “staff” (for what?) But an investigative division under the DOJ, i.e. the FBI, not an agency even established by Congress, and whose director reports to the Attorney General, somehow requires Senate approval because Congress decreed such.
