In a 6-page filing [AVAILABLE HERE] Jack Smith says, “Justice Department policy prohibits him from continuing the case.” Smith is using the election as the justification to save face.

The case was never about the merits of unlawful conduct targeting President Donald Trump. The case was always about Main Justice, via Lisa Monaco and the crew of lawfare ideologues, trying to influence the election outcome of 2024. The dismissal of the case was a foregone predetermined conclusion that was always going to surface after the election.
The reality behind this non-pretending perspective is exactly why the DOJ insiders were very nervous about Matt Gaetz.
One interesting aspect of this abandoned appeal, is that Judge Aileen Cannon’s ruling on Smith’s appointment won’t become precedential. The 11th Circuit could have agreed with Cannon’s reasoning that the appointment violated the Constitution, which would have limited future special-counsel appointments. Not true. By dismissing his appeal, Judge Cannon’s opinion becomes final precedential authority for her Florida district and persuasive authority for other courts just like President Clinton’s sock drawer case from the DC District court. The only way this does not happen is if the 11th Circuit not only dismisses the appeal, but vacates her judgment and opinion, which I’m not even sure they have the authority to so.
Key point. President Trump has the right to appeal any judgment that he believes is in error, so he can appeal Judge Chutkan’s dismissal order on the grounds it should be with prejudice. First to the DC Circuit, then by certiorari to the Supremes. And who’s going to defend Chutkan? It will have to be President Trump’s DOJ and I guarantee the DOJ is going to agree with President Trump’s private attorneys that dismissal without prejudice is against public interest given the Sword of Damocles that will remain. If the DC Circuit doesn’t reverse Chutkan, the Supremes will to tell the Left to cut this sh*t out.
Oh course, the Trump Administration could float dissolving the DC Curcuit as a bit of incentive.

Garland appointed Jack Smith unlawfully and paid him with funds not appropriated by Congress for such activity. Those payments had reached 22 million dollars before Judge Cannon’s order in the Florida case that his appointment and compensation was unconstitutional. It occurs to me that misuse of government funds is unlawful. Moreover, Smith should not be permitted to retain those funds. It is probably 30 million by now.

If the cases are dismissed without prejudice, what happens with the Statute of Limitations? That question, which would be argued if the cases are re-filed, may never be resolved.
Special Counsel Smith has forced Trump’s hand, requiring he pardon himself to spare the potential of prosecutions in 2029. There is no guarantee the Government would restart the cases after Trump’s term – Trump would be 82 years old, and he wouldn’t be the political threat that he was when these cases were filed – but you never know.
Better that Trump pardons himself and saves the trouble.
Once Trump is sworn in, his lawyers should move to have the dismissal with prejudice. His DOJ won’t object.
Note that Smith files this without prejudice, which allows him to refile after Trump’s presidency is over.
While Trump’s attorneys may request the dismissal with prejudice, so that it cannot be refilled, Trump of course, has the ultimate solution. He pardons himself.

Back when I was in high school — back in the days when a kid was lucky to get a used Brontosaurus to joyride around on — every so often our very strict principal would come on the yard after lunch and let out an ear-splitting whistle.
We all froze in motion, praying fervently that our name was not called. Girls prayed, too, because they had equal rights to getting sent to the principal’s office.
This was a man who knew how to swing a 1×4 and make you wish you’d never been born. That doesn’t factor in the note home to Mom and Dad, who made you wish it all over again.
Anyway, several times a year one or several young men would hear their name and see the principal’s long finger like a giant beacon summoning them across the yard. Nobody laughed, because a guy tried that once, and he got swept up into the painful dragnet.
It was all timed just perfectly so that afterwards we all saw the young men waddling down the hall with puffy faces from having just cried harder than they’d cried in a long time. I know this is true, because it was me one — no — two times.
It was amazing how well-behaved everybody was for a good long period of time after that very public example.
Those were small charges, and getting a good whuppin’ was justified and appropriate for the infractions.
Just imagine how impressive it would be to see the punishments fitting the current crimes.
