In a 6-page filing [AVAILABLE HERE] Jack Smith says, “Justice Department policy prohibits him from continuing the case.” Smith is using the election as the justification to save face.

The case was never about the merits of unlawful conduct targeting President Donald Trump. The case was always about Main Justice, via Lisa Monaco and the crew of lawfare ideologues, trying to influence the election outcome of 2024. The dismissal of the case was a foregone predetermined conclusion that was always going to surface after the election.
The reality behind this non-pretending perspective is exactly why the DOJ insiders were very nervous about Matt Gaetz.

The real reason Smith dropped the case: it didn’t derail the Trump train before his reelection which was its raison d’etre to begin with. None of the Lawfare (read “election interference”) cases brought against Trump did, thank God, Judge Cannon, and the American people.
Instead of soft-talk about “changing the culture” Pam Bondo better prosecute this fraud (and many, many others).

Malicious prosecution is a real thing. Law enforcement who arrest and prosecutors who prosecute individuals when there is no probable cause for doing so. Last time I checked, it is not clear if malicious prosecution is actionable under 42 USC Sec. 1983 for the violation of civil rights even though such a prosecution would be a clear violation of due process. And I’m pretty sure that the jurisdiction for bringing such a cause of action is the prosecuting jurisdiction. If President-elect Trump decides to file such a cause of action in the DC District Court, you can be sure that each and every one of those judges would be hostile to his claim to the point of finding probable cause to prosecute. And without a US Supreme Court decision stating the Special Prosecutor Smith had to be confirmed by the Senate, even the US Supreme Court would be unlikely to permit such a claim to go forward.
That being said, since Smith has represented to each court that he has authority under the Attorney General/DOJ, every bit of his work product is subject to the AG/DOJ of the incoming Trump Administration, all of which can be shared with President-elect Trump’s co-defendant’s, particularly in Atlanta for purposes of suing Fani Willis et al for malicious prosecution under Georgia state law, and the incoming President can waive any federal prosecutorial immunity Smith and company may have to permit them to be prosecuted under state law. And President Biden cannot pardon Smith and company from anything other than federal law exposure, so if they assisted in the brining of a politically motivated state prosecution, they would appear to be criminally liable as well. And waiving executive privilege now cuts two ways, so Biden White House counsel may be exposed as well.
President-elect Trump can let his numerous co-defendants in Atlanta do the heavy lifting, then go after Bragg and company in New York on the same basis, but may even be able to drag Bragg down to Georgia on a conspiracy charge because the number 3 in the Biden DOJ resigned and took a job with Bragg the very same day that Fani’s side piece was at the White House talking about the Atlanta prosecutions. Lots of attorney’s fees for the bastards and, again, Biden can’t do a thing about the state law causes of action.
