While the Raskin-Elias effort to invoke the 14th Amend Section 3 is wildly making its rounds on MSM and opinion pages, the long held interpretation of Section 3 was passed as a part of the Civil War Reconstruction laws – even though there was great effort to unity the country scholars and legal authorities crafted Section 3 to prevent members of the Confederacy from resuming power after the Civil War ended. It’s dangerous in that in today’s environment of NO Scalia and NO originalist textualists on SCOTUS to defend the position Section 3 is exclusive to the Reconstruction Era. It’s a crap shoot expecting this SCOTUS to step in on the insurrection issue. But coupled with the House Majority Leader (Jeffries – if Dems take the House) opens the floor to anyone wishing to enter a Resolution at which point Raskin jumps to his feet and invokes Section 3. They refuse Trump’s Electors on Jan 6 2025 and “install” Kamela. Supposed the Dem Majority is only 1 seat and there’s potential of a Dem/Ind joining Republicans to defeat the Resolution and there’s a tie vote – Kamela as VP is Pres of Senate and can only break the tie votes in a deadlocked Senate. She has no authorities/privileges in the House. So will Raskin require a Jt Congressional vote so that Kamela can be the tie breaker?
But my question is how does Raskin-Elias label Trump an insurrectionist? He was never charged and never convicted of insurrection.
Section 3 of the U.S. Constitution’s Fourteenth Amendment states:
“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability.”

It’s the answer that the entire applicability of section 3 hinges upon. No and as you say, POTUS was never charged or found to be engaged in an “insurrection”. Possibly even more salient or at least supportive of the misapplication of the article 3 provision is that POTUS is none of those things.
He’s not the “elector of President” He’s not a “Senator” nor “Congressman”.
The “Chief Executive” to my understanding as separate and distinct, has not been decided or adjudicated to date as to whether they are indeed an “officer” or not and I believe the default position legally has been “no”. So if POTUS is not an “officer”, nor any of the other persons listed. Then he can not be disqualified from being certified using Section Three of the Fourteenth as a predicate to deny.

Down ballot elections are crucial to President Trump getting the biggest bang out of his 4-Year Trem buck …. I agree 100% … HOWEVER ….
First, the CURRENT sitting HOUSE Ratifies the election, not the newly elected House. Plus, the democrats would have to rewrite their very own Election Act Law, passed in 2022 that requires rubber stamping of results at the joint certifying session of congress, to decertify anything.
Second, the only way President Trump can have his own trusted Executive Branch leadership APPOINTED is for a MAGA Favorable Senate to be seated. It is the senate that counts most for this election.
I know Steve Bannon and mos of his guests mean well or have agendas that align with MAGA but I prefer some accuracy and dialogue with REAL elements to it vs shrill pronouncements.
The certification of the Electoral College vote for POTUS and VPOTUS takes place on January 6th, the New Congress is seated on JANUARY 3RD.
