In the 2016 Election, all 50 States counted votes on time on Nov 8, 2016 allowing Hillary Clinton to decide to concede on Nov 9.
The 2020 Election Fraud was Biden winning on Nov 7.
On Page 195, (Chapter 1, Jan 6 Report), At 02:21 am, Nov 4,2020, Trump spoke declaring victory:
“Neither of President Trump’s claims were true. He had no basis for claiming victory or that fraud was taking place. Millions of votes still had not been counted. The States were simply tabulating the ballots cast by American people. Trump’s own advisors told him to wait–that it was far too early to declare victory.”
There were not “Millions of votes still had not be counted”, there were thousands of mail-in ballots to be counted in 5 States All 50 States faced the 2020 Covid pandemic, 45 States counted their votes on time on Nov 3, 2020, 5 States (Arizona, Georgia, Michigan, Pennsylvania and Wisconsin) delayed counting their votes. Why couldn’t the 21st Century State of Art computers count the mail-in ballots whether millions or thousands on time on Nov 3?

The AZ audit in 2020 proved that they counted votes for ten days after election day and then Governor Douchebag certified the results and then a few days later 140,000 more votes were counted after the certification to come up with the results previously certified. IIRC, not having to worry about getting your absentee ballot in the mail in time for it to get there by election day, was the rationale for allowing college students to vote from their temporary address at school.
If you can get your vote counted even if it shows up after election day, shouldn’t students go back to voting from their home address?

In short, counting ballots is one of the various post-election “administrative actions” that can and do occur after Election Day (cite elided) Receipt of the last ballot, by contrast, constitutes consummation of the election and it must occur on Election Day.”
If your state permits ballot receipt after the close of the polls on Election Day it is at risk of its certificate of electors being ruled void.
Now this is one Circuit but it does not carry an injunction but rather is an immediate remand, so absent an appeal directly to the Supreme Court (1) it stands and (2) it only binds the 5th Circuit States, at least in theory.
However, it now presents an extreme risk for states outside that circuit who might choose to permit ballot receipt beyond the close of the polls on the 5th of November.
I expect one or more of them to try to run this up the pole to the Supremes, but it is quite-clear and cites plenty of precedent including both the Constitution and long-standing Federal Statute, neither of which has been amended.
