Judge Eileen Cannon’s dismissal of the classified documents case is back on the propaganda menu. Jack Smith appealled that dismissal order and The Circuit Court of Appeals (11th) has issed a briefing schedule. Pundits are already hectoring that Judge Cannon has ignored the U.S. Constitution, longstanding precedent and federal law in her dismissal order.
The essential issue presented by the appeal is whether A.G. Garland had the authority to appoint Jack Smith, a private citizen, as a special counsel or “Officer” with the powers described in the appointment document.
The country has a long history with the proliferation of officers and harrassment as perpetrated by Smith.
“He [King George III] has erected a Multitude of new Offices, and sent hither Swarms of Officers to harass our People and eat out their Substance. “ The foregoing is among the “long Train of Abuses and Usurpations” cataloged in The Declaration of Independence.
Accordingly, the “Founding Fathers” established Constitutional limits on appointments which are found in Article II Section 2 of the U.S. Constitution. That section lists the official positions the President may appoint with the advice and consent of the Senate. Importantly, it also states that “Congress may by Law vest the Appointment of such inferior Officers as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.”
At times in our history Congress has provided a “Special Counsel Law.” The most recent version of the applicable Law expired in 1999 by operation of “sunset” provisions. No such statutory / “by law” existed in 2022 when Smith was appointed. Merrick Garland cited four specific sections from The U.S. Code, Title 28. Judge Cannon did, indeed, followed conventional legal statutory interpretation rules and determined that none of those four applied and that no other laws which would support Jack Smith’s appointment could be found.
The issue is not whether Garland could have tasked an existing U. S. Attorney to investigate and prosecute President Trump. He certainly could have done so, but he wanted a shameless, partisan fanatic such as private citizen Jack Smith. The infamous Hillary Clinton “At this point what difference does it make!” reponse is not sound Constitutional analysis.
Do not expect the MSM to address the 24 million – and counting – dollars Smith has cost the taxpayers which is also Unconstitutional.

Since Garland legally COULD have tasked this case to any of 50+ Federal Prosecutors,…WHY DIDN’T HE?
Especially if these two cases taken by Smith were supposed to be the Stake in the heart, the silver bullet that was “finally going to spell the end, for “Trump”,….
then WHYCin the HELL would he set the thing up, fron day one, to FAIL?
Like the many anaomolies at Butler, this simply can not be dismissed as incompetence, Garland had a whole Justice Dept. full of lawyers he could assign to make sure all i’s were dotted, and all T’s crossed, in order to insure this attack to destroy PDJT was succesful.
Occams razor,…Garland never intended for these cases to get to the point of an actual conviction.
They were only intended to tear down PDJT’s support, EVEN AS they pushed out RDS as “Trump without indictments” and Garland, by assigning Smith, was effectively stamping these cases with a “Best buy” date, so they could be quietly folded up when they served their purpose, and before they could be adjudicated to a ruling confirning PDJT’s absolute right to possesing those documents.
It may be that Garland was not concerned with careful attention to detail and wanted someone who would unhesitatingly use dirty tricks and questionable methods. Jack Smith was to Merrick Garland as Douglas Neidermeyer was to Dean Wormer of fictional Faber College, the setting for Animal House.
Merrick’s orders were to get a conviction before the 2024 election “season” but not so early as to allow sufficient time for appellate review by SCOTUS as you suggest. He had the radical leftist / partisan D.C. District and Court of Appeals along with the 90% Democrat jury pool.
That plan would have worked had SCOTUS not accepted interlocutary review of the immunity issue in the D.C. “insurrection” case.
The Florida documents case was necessary to justiy the raid on Trump’s home which was seeking to seize materials and records incriminating to the deep state which Trump lawfully possessed. (Presumably he still retains those documents.) The plan went sideways for Garland and Jack Smith when the case was assigned randomly to a Judge who upheld her oath.
Jack Smith is now the turd in the lawfare punchbowl an he cannot be removed.

Old adage of “conventional political wisdom” is that “the VP can’t help a ticket (win) can only hurt it, because people vote for the Top of the ticket.”

And, theres some legitimate reason to question if it was ever viable. Surely I am not the only one who voted for Sarah Palin, overlooking her running mate?

I will say I’m glad all of the personal stuff is coming out now and not 2 weeks before the election. I’m hopeful that it will be exhausted by the time of the first debate, and I’m hopeful that Trump will mop the floor with Kamala. And if Mark Kelly is the Democrat VP choice, considering that he’s almost as new to the Senate as JD is, JD should do well. I hope JD has already started preparations.

My take.
1, Why would Crooks’s father a Democrat, and counselor, who knew his son was on drugs, and unstable, buy an AR15? Show me how many Dems own one.
2, The first shot hitting Trumps ear came from the window behind Crooks, and is why it sounds different. I believe it was the cue for Crooks to start shooting.
I believe the man who shot Trump was SS dressed in camo with a full right arm tattooed sleeve. He was the man seen at that window, and later standing over the body of crooks.
Have you worked out whether it’s even possible for someone standing at that window (which was not behind crooks but to the side) could even have shot Trump’s right ear but not hit his head as well? I honestly don’t think it’s possible, based on this diagram (and similar):
On second thought, let me take back what I said. I was assuming that Trump was facing Crooks while he (Trump) was looking at the big screen. But maybe Trump wasn’t facing Crooks, maybe he was facing the 2nd floor window at the time he was shot, because he would have still been able to see the big screen by shifting his eyes, in which case it WOULD be possible from the window to hit his ear but not his head.

Just started Fall Planting per calendar for my zip conde from the Seed to Spoon app. I began 2 weeks early because we are having a cool, wet period according to Weather Underground for the next 2 weeks.
This is the 4th year of learning to garden + building up supplies for it + a large pantry — after I decided in Jan 2020 — the Davos Crew was 100% dedicated to going for their 2030/40/50 Goals + had crossed the Rubicon by using a bioweapon + extreme hype leading to a Global Lockdown to begin what they eventually told us was named: The Great Reset.
I cancelled a contract to go back overseas + began preparing for likely hard times to come soon.
I also began preaching here + at Gateway Pundit – there was no way they’d allow Trump a 2nd Term + there would be No Limits to what they’d do to stop it. That datapoints seemed to confirm – all the Institutions capable of blocking the approaching POTUS Theft were brought on board to do nothing but support it.

Our experiences and outlook are similar.
Childe Roland, I went down the prepper rabbit hole when the national debt hit 5 trillion dollars. I was convinced that there would be an economic collapse. I planted fruit trees, gardens, a DIY backup solar power system, bought books on first aid, took classes, bought a lot more canning supplies, had a bugout plan and much more. About the same time I learned that the chemicals they inject into beef I bought from the store gave me violent dreams, once I made the connection I decided to get closer to the source of the food I eat. I started to raise my own chickens, turkeys and Kune Kune pigs. I rarely eat store bought beef anymore and I don’t have the violent dreams anymore.
I got burned out on the prepper mind set but I did enjoy learning the life skills that help to make one self-reliant and so I stayed with learning what I call “Homestead skill sets” and I still stay as close to my food source as I can.
The times we are going thru are much different than when I was a prepper but having gone down that rabbit hole once, I’m reluctant to go there again. I’m not ill prepared for hard times, I’m just not prepping for them, I’m living my best life.
I have a nice garden growing right now and I recently planted some fall crops. Our cherry trees were full this year as is out plum, fig, pear and apple trees. A few weeks ago I butchered 31 cornish cross chickens. I have some in my freezer, some of it I canned, some of it I made sausage with, some of it I made soup with that I canned. I bartered a few of them for some beef from a friend that raised it and I canned up a lot of that beef. I do this stuff not out of fear but because it brings me enjoyment and the fulfillment of being self-reliant.

That’s more than 2 per year. A lot of the plants are in places where the displaced workers cannot easily find similar employment. It’s a disaster.

Well its always wise to be constantly comparing search engines and browsers. However as this article shows, turn off suggestions and if you cannot, stick with what you typed in. Also turn off voice recognition, siri, leo and anything else but text. For that matter turn off microphone and camera at OS level and deny browser access to both.

I had just posted elsewhere a timeline of FBI actions prior to the 2016 election, to try to take Trump out that year. Per the OIG report, the FBI had started the process of getting a FISA warrant on Carter Page on August 15 2016 but they had trouble putting enough legit-appearing evidence to support the request. They finally submitted an expedited request on October 20, just a few weeks before the election. They must have been crying in their beers. And in the end it didn’t work. 🙂

Article in todays Louisville courier journal touting beshear as a great v p pic with acknowledgment he won’t get the nod because he’s not good for electoral votes.he was all over the editorial page. I noticed 3 times one day this week and then again today when I saw a Gannet paper: they are using “Attack” in headlines about our President as in three times he attacked Kamala …. Today it read the GOP attacks. No where did I read a headline about her attacking anyone. They might say differing in opinion but never that loaded word. Check you papers for the headlines the mockingbird media is using as subtle brain washing technique. A writer needs to note this in a column.
