My question is, if this was based on a Federal Election law, isn’t it possible to appeal to a Federal Court immediately?
It was based on Orange Man Bad and nothing else.
There are so many things wrong with this case it would take a book to detail them all. You can’t try cases that involve alleged violations of federal law in state courts, but they did it anyway. There is also the question of a state inferior court prosecuting a former President, a former Federal officer, not a state officer, with a federal crime.
And there is also the question of the precedent this sets. Are all former Presidents now to be subject to political prosecution by their adversaries, in any courtroom in the country? These questions alone lead me to think that this should be appealable to a federal court, if not the Supreme Court, immediately. But the Supreme Court is ultimately going to have to provide clarity here, because this case has created judicial anarchy.
