There is no good news if there’s a guilty verdict. An appeal most likely won’t happen before the election.
The point is to get a guilty verdict; that takes Trump off the campaign trail. The judge can place Trump in jail without bail until sentencing. Or a condition of bail is he does not leave NYC.
The ultimate goal is if Trump does get reelected, the NYC conviction can be used as the reason for impeachment.

Yeah, the 55 pages create confusion. I asked for a dictionary during deliberations once. The judge called us back and reread the instructions, and said nothing else would be forthcoming. 1/3 of a jury is unfit, in my experience. I spend my time explaining the evidence, which they can’t process, thus my ask for the dictionary to break through. Probably a good call by the judge though, and his instructions were short.
It’ll be a zoo in there if the judge has tricked it out so. Lawfare may want that, hard to tell.
I think the judge wants a hung jury … he knows he’ll be crushed in the Appeals court … a hung jury saves his behind …

yes, i heard that at least one juror was taking notes during the testimony. i wonder if those notes are allowed, but just not notes on the jury instructions? my understanding is the judge would not allow them to take notes during his instructions. so maybe, both are true – that they can bring their own notes in, but those would not include the jury instructions, because he didn’t let them take notes on that.
However, in neither case can they rely on their notes as evidence, so note taking seems to have little value. You can’t use them yourself as proof of what you heard, and you can’t try to convince another jury member using those notes as evidence.
And their notes may not be shared with other jurors or used as proof of what he said,

There are a lot of lawyers in lawfare, the congress and the senate. I hold no hope on these 2 lawyers and I would be greatly surprised if the lawyers on the jury do the right thing. I believe they were put on the jury to direct the jury to convict.

Usually lawyers are some of the first people struck, precisely because they will often lead the rest of the jury in directions counsel can’t predict.
As for the corporate lawyer- if he’s been working for a white shoe firm, his client list is an almost inherent conflict of interest, and any lawyer working at, say, Cadwallader, would be sacrificing his career, his friends, and probably his family being the hold out on conviction.

I’m sorry but I am FED UP with people from other countries running our country. We don’t have enough patriots from our own country? Occasionally an immigrant comes to America legally who loves our country and makes it honestly to a high position – but that is rare. Most illegals come here to get the goodies handed out freely and without thought by the powers that be. Only in recent years have people from other countries come here and got themselves into high positions in our government. Before that, we managed to have only people born and raised in this country in government. Do any other countries allow this? Could I move to Russia or China and get a high government job? I have seen up close in CA the many people coming from Mexico or wherever flying the flag of their real home country. They are not grateful people – they are entitled people and have no qualms about flying the flag of their REAL country of origin in our country. Those flags should be ripped out of their hands and they should be deported back to the country they really love.

Retired Magistrate here: What I would like to see happen is for the foreperson of the jury to come out and state that the jury instructions are so convoluted that the members of the jury are unable to render a verdict, which would result in a mistrial.
Of course I would like to see an acquittal; however, given the fact that it is a New York City jury, in my opinion, a mistrial is the best realistic outcome for this sham case.
Another thing to keep in mind that if the jury would acquit, I envision this judge overturning the verdict of the jury and substituting his own. I believe he is a retired judge, so there really isn’t anything that is going to happen to him no matter how outrageous his conduct is.

Retired Magistrate here: Yes, given the right circumstances. A Judge can issue a judgment notwithstanding the verdict (JNOV) if the Judge can explain the reason for his/her decision.

Retired Magistrate here: I keep trying to tell people that judges have so much power that even if a particular judge knows what he is doing is unconstitutional, it is up to the wronged party to take it up on appeal if that party has the funds to do so.
The law is what the judge says it is on any particular day in any particular courtroom; that is the way it is whether we like it or not.
The only way our judicial system works is if we have moral individuals on the bench who actually uphold the Constitution. Rogue judges used to be somewhat of a rarity; not anymore.
Most attorneys don’t want to file a complaint with the State Supreme Court (at least that is how it is done here in Ohio) regarding judicial misconduct, because if they are unsuccessful and have to appear before that Judge again, in all probability, the case will not end well for that attorney.
Once a judge is elected/appointed to the bench, it is very difficult to get the judge removed.

I believe this topic was discussed and resolved during the Kyle Rittenhouse trial a few years ago. In state court systems, it’s likely the specifics vary from state to state.
As things worked out, the acquittal stood. Folks likely have forgotten much about that trial and what a spectacle it was. I’m glad Kyle went largely dark after a short stint of publicity after it.
I would posit such a move, even if allowed, would result in an immediate appeal, and likely a successful one.
I’m not a criminal law person. Wouldn’t a JNOV in a felony trial be a direct violation of the constitutional right to a jury trial?

I just filed an official misconduct complaint with the New York State Unified Court System related to the “random” assignment of Acting Manhattan Justice Juan Merchan, a Biden donor whose daughter is fundraising millions off his unprecedented work, to criminal cases against President Donald J. Trump, his companies, and his allies.

Members of the Commission, and Madam Inspector General,
I am writing to alert you to potential misconduct by Justices and employees of the Supreme Court, Criminal Term, New York County.
The potential misconduct pertains to the repeated assignment of Acting Justice Juan Merchan, a Democrat Party donor, to criminal cases related to President Donald J. Trump and his allies. Acting Justice Merchan currently presides over the criminal case against President Trump brought by Manhattan District Attorney Alvin Bragg.
Acting Justice Merchan also presided over the criminal trial against the Trump Organization and will be presiding over the criminal trial of Steve Bannon, a senior advisor in President Trump’s White House and a prominent advocate for President Trump.1
The website for the Supreme Court, Criminal Term, New York County does not provide a comprehensive list of every justice and acting justice sitting in the courthouse, but based on the courtroom directory there are at least 24 sitting justices on the court.2 Acting Justice Merchan is not even listed among them, one assumes, because of his status as an acting justice.
Section 200.11(c) of the Uniform Rules for New York State Trial Courts requires that criminal actions be assigned to a judge “pursuant to a method of random selection authorized by the Chief Administrator.” If justices were indeed being randomly assigned in the Criminal Term, the probability of two specific criminal cases being assigned to the same justice is quite low, and the probability of three specific criminal cases being assigned to the same justice is infinitesimally small. And yet, we see Acting Justice Merchan on all three cases.
This is the same Acting Justice Merchan who, in violation of New York State Code of Judicial Conduct 100.5(h), donated to President Biden’s 2020 campaign, along with the Progressive Turnout Project and its “Stop Republicans” subsidiary.3 It’s also the same Acting Justice whose daughter is a political consultant working for prominent Democrats, whose firm stands to profit greatly if Donald Trump is convicted.4
One cannot help but suspect that the “random selection” at work in the assignment of Acting Justice Merchan, a Democrat Party donor, to these cases involving prominent Republicans, is in fact not random at all. The simple answer to why Acting Justice Merchan has been assigned to these cases would seem to be that whoever made the assignment intentionally selected Acting Justice Merchan to handle them to increasethe chance that Donald Trump, the Trump Organization, and Steven Bannon would ultimately be convicted.
I request that both the Commission and the Inspector General investigate this anomaly to determine whether the required random selection process was in fact followed in the assignment of these criminal cases to Acting Justice Merchan. If Acting Justice Merchan or any other Justices of the Court are found to have violated these rules, I would hope that the Commission would subject them to the required discipline. And if any non-judicial employees of the Court are involved in such a scheme, I would hope that the Inspector General subject them to the appropriate sanction.

Two bad choices with a common thread to them.. They had both worked in government most of their lives.
I simply hope and pray that the Jury realizes how “they are being used.” No one (specifically including the Judge) who is giving “instructions” to them is intending to use them for anything more than a tool. For entirely-political ends. I hope that the Jury realizes their own singular power to address that.
A thought – to prayers for PDJT, we can add praying for the jurors to gain the courage – and it will take exactly that – to stand up to do their duty for actual truth and justice – probably knowing that doing so could result in doxxing at the very least.
It seems like there should be a way to keep jurors anonymous. That way, they can truly vote their conscience. Is this is against the constitution?
I also think that most people believe PDJT is a good person and is innocent in this trial. Surely, at least a few of the 12 NY jurors would agree that PDJT is innocent.
Since the Judge didn’t sequester them, I’m sure the jurors got to see a lot of the news shows, even CNN, who said the prosecution didn’t prove the case. So, I think that was a good thing that they had that week off.
A couple days ago, I watched a news interview with a Cuban Congresswoman. The Fox news person tried to steer the conversation to ‘tit for tat’, meaning that if PDJT wins re-election, he will do lawfare to Democrats. The Congresswoman responded ‘No, we don’t expect that’, and she explained how that is what is wrong with the situation, and that an honest administration would absolutely not do this.
However, I do believe that these lawfare people should be investigated, and if it can be proven that they are doing illegal things (like is happening to Dr. Fauci now), then they should be charged with crimes and/or fired from their govt jobs. This would be totally different from ‘lawfare’, which is being waged against PJDT, because they are creating phony charges, ignoring exculpatory evidence, witness-tampering and other illegalities, while what I suggest is actually going after criminals.
They would have been warned not to watch television, read news or listen to radio news/commentary. I served on a jury last month with those instructions, and I truly believe the jurors complied.

In an interview well b4 2020 election (CNN) Barr was adament re: the danger of mail-in ballots. I was shocked when he did NOT investigate election fraud… and he did not.
Everything he said at Notre Dame tells me he would not be a traitor (as he does appear) to his country AND to God (fundamental Christian principles and values that ARE the foundation of our country) …. b/c his SOUL- heaven or hell- depends on him doing the right, just and honest thing.
And… Trump praised Barr BUT called him WEAK. Weak IMO meant that Barr was not willing to go through the Hell in 2020 election. Barr knows how dangerously corrupt the DOJ and FBI and CIA, etc. Are. Trump also said Barr was weak b/c he feared being impeached. That is ridiculous. Barr would not fear impeachment. He is not THAT weak. He FEARED being a target of the evil deep state IC- having his life and fortune (and family) destroyed. THAT is worth fearing. Impeachment is BS. The senate was controlled by RS anyway. Trump was not convicted in the Senate.

I think things are much more complicated than that, and I’m not about to label almost any of the top 70 “players” a hero.
I think you have a few different categories:
– MAGA sleepers (Adm Rogers for example)
– People who held key positions that either refused a deal or were so foul that they weren’t offered one, or the position needed to be absolutely controlled, so they were swapped out (Biden, Harris, Fetterman, and a number of others whose faces and features noticeably changed and often continue to change)
– People who could be counted on to do the things they were going to do, and were left alone to do it while they were watched so the entire network could be traced (the Eisen crew, Bragg, Fawny, the Soros DA’s, many, many, many others)
– People who were not necessarily evil but who were in the system with no way out, and who took a deal, with or without protection (Redfield)
– Whistleblowers who were just waiting for hope to appear (Seraphim and many, many others)
President Trump is giving Barr an out, just calling him weak, instead of calling him a traitor. Barr’s history is very dark. I do not see him as a 40 year plus sleeper agent. His face doesn’t seem to have changed. I think that’s still him.

The Secret Service has a sworn duty to protect the President from any and all threats. This protection includes the use of deadly force if necessary. After reading the Judge’s instructions, that’s what it all boils down to. The instructions amount to a directed guilty verdict. But is the jury obligated to follow the judge’s instructions to the letter? Or even to follow his instructions at all?
Having served on two juries, one a civil litigation case, one a criminal case, we had copies of the judge’s instructions for reference. But we didn’t spend a lot of time looking at these instructions because we didn’t need to.
The nature of the dispute in the civil litigation case was clear. The applicability of civil contract law to the dispute was equally clear. That a dispute of the kind we were looking at could arise in the normal course of legally-conducted business contracts had a number of clear historical precedents.
In the criminal case, there was a clear violation of state criminal law. The application of state law to the case was equally clear. The evidence against the defendant was clear and overwhelming. Why the defendant chose to go to trial rather than take a plea bargain was unknown to us, but that is what the defendant had chosen to do.
In both trials, we jumped right in to the substance of the arguments and the evidence. Each jury had leaders and followers, but every member of each jury was conscientious about their responsibilities. Fair and appropriate verdicts were rendered in both trials.
What about the two lawyers sitting as members of the NYC jury?
Do these two lawyers have a sense of the gravity of the choices which now face them as members of the legal profession? Will the two lawyers be either leaders or followers as the jury deliberations move forward? Will the two lawyers tell the jury that they as members of the jury have a higher moral and ethical obligation to the American system of justice which goes beyond the words of the judge’s instructions?
The two lawyers have to know exactly what is going on here in this sham trial.
As lawyers, they have to know that the legal construct of the charges is completely novel and has no historical precedent in the application of New York state law. They have to know that the judge’s instructions reference federal law over which the State of New York has no jurisdiction. They also have to know that non-disclosure agreements negotiated by lawyers are identified on the accounting books as legal expenses.
They have to know that the judge’s instructions restate and embody the prosecution’s case and for all practical purposes make the judge the defacto jury foreman and the prosecutor his assistant foreman.
If other members of the jury reference the judge’s instructions in arguing for a guilty verdict, will the two lawyers follow a higher ethical and moral obligation and inform the jury that the prosecutors have not made their case either in a basis of law or in a basis of evidence, and that the judge has stepped in to make the prosecutor’s case for him?
The two lawyers also have to know that a guilty verdict will be reversed on appeal. Will these two lawyers vote for a guilty verdict in the belief they have no accountability for knowingly participating in this unprecedented assault on the American justice system?
A directed guilty verdict, how un-Constitutional is that? But, it’s NYC Stalinists.
