On Jan 6th President Trump was still President and he was until the 20th of Jan and he still had immunity to anything that this dirt bag wants to throw at him, but should the SC decide he does not deserve to keep it then look out joe biden when he leaves office He and many other people are

He didn’t need immunity. He rightly wanted the cheated vote to be proven accurate or straightened out. Immunity for such for the chief law enforcement officer in the land is ludicrous. He needed to be arresting people.
Although I am diehard MEGA MAGA, I am still bitter (though understand his hands were tied literally and figuratively) about the hundreds of times PDJT pointed out that he knew the election was stolen followed by “…and we’re not going to let them get away with it…” I cried as I watched him fly off, out of Washington but at the same time was confused, angry and hurt that he had essentially, let them get away with it. I do understand the swamp is deep and he found they were also cunning and thorough in the blocking of his options and avenues to contest. I’ve reconciled but still yearn to see him get his just revenge!!!
Article 2, Section 3 gave him a mandate to “take Care that the Laws be faithfully executed.” This means that when you realize (or, yourself, believe) that the Federal crime of “election fraud” has occurred – and, whether or not you are a contestant – you must “take Care.” You must speak, and you must act. You must not keep silent.
The one-man Executive Branch cannot “commit a crime” by carrying out his Oath of Office as he alone sees fit. Likewise, as a Branch, his sovereign and plenary powers are not subject to review nor intervention by either of the other two.
And, the SCOTUS has already ruled in favor of Article 2 many times. This is well-settled law, some of it more than two hundred years old.
As corrupt as Roberts has proven himself to be, past rulings by SCOTUS and well established case law are not a sure thing when it comes to the persecution of PDT

And, the answer is YES, of COARSE a former President CAN be prosecuted for crimes he committed while in office.
But FIRST, the House must IMPEACH him, AND the Senate must CONVICT him, this effectively removes his Presidential immunity.
They TRIED to impeach PDJT AFTER he left office, FOR J6, and were unsuccessful; THIS IS WHY.
And Smith is now asking the SCOTUS to allow him to do an end run around the Constitition, and this requirement.
This is WHY SCOTUS was absolutely correct to take up on an expidited basis, and why I suspect they will slap Smith down.
Such a slapdown would pretty much destroy Smiths DC case, the Fla. case, and I think even the Ga case, and just leave the rediculous NY “fraud” case as the only one pending.

As Dutchman points out, in Biden’s case we are talking about “a life of crime” before he was appointed President. He can be convicted for any of those. But, he won’t be.
I think you make your own point – he will never be convicted in a Senate impeachment proceeding ( on whatever the charges are ) and he certainly will never be indicted for his supposed alleged “crimes” before his Presidency, after he leaves . I sincerely believe that this all goes back to the Mafia “Code of Omertà.” In other words, and no matter what, “The Family™ protects its own.” To this end, it is implicitly understood that everyone is in the game: the police, the judges (at various levels), even the [terrified …] owners of businesses.

How can someone who is not President be impeached?
Furthermore, this question as stated contains a “loaded” comment to the effect that the President did “commit a crime while in office.” I’m sure that this will not escape notice by the Justices.
It is quite purposeful that the Constitution provided only “impeachment” as a Congressional response to “high crimes and misdemeanors.” It is quite purposeful that they said, “high.” But it is also purposeful that they expressly stated that impeachment was not a criminal indictment. The now-evicted President would face the same system of courts and justice that anyone else would.
Smith unfortunately is trying to make the case that Trump’s official actions while in office constituted “a crime.” But anyone can readily hear and see exactly what he said and did. And there is no crime.
I think you are correct and your comment is well-reasoned.
Nevertheless, I think they are going to rule against President Trump. I base this opinion on Chief Justice John Roberts’ contrived reasoning in other politically-sensitive cases. He always buckles to pressure from the left and when he does he makes no sense.
Then the SCOTUS will have started the next Revolutionary War.
More people now than ever have read the Constitution and know what it means for our Republic to survive.

Having had plenty of time to think about it, PDJT (who is a master at figuring out ways over, under around or thru “roadblocks” has figured out a way to overcome getting Senate Confirmation for his Cabinet appointments.
The primary problem was there was/is in place an alternative operating government that most world leaders recognize as the real power. President Trump, in spite of this still managed to do run arounds in areas they were not prepared for and brought the country back economically which was first step in wrestling control back into the legit government, to the elected president, Him and WTPOTUS. He also built allies and we found who in world is for us and who is actually not only against us, but part of the operating usurping government. This was obvious when Kerry was in meetings with world leaders while President Trump new in office. Same with Obama being overseas in talks.

Right in the middle of the covid farce, my wife had an emergency surgery at at large acute care hospital. There were times I had nothing to do so I walked as many floors of this hospital as I could. What I found was several floors and as many half floors were closed and not in use. The floors that I saw which were in use had many nursing types crammed into nurses stations basically just B.S.ing. For an interesting little sidebar, people here should read through the comments attached to the “Zero Hedge” article that “Black Knight” referred to and I just posted. I read at least 100 comments and I didn’t see ONE that was anything but over the top, wildly anti Semitic. I am not familiar with “Zero Hedge” enough to give an opinion of whether the site itself is anti Semitic but the commenters generally seemed very comfortable in their surroundings and with each other’s anti Semitic BS. Thoughts on President Trump going after New Jersey:
1) Good on paper – playing defense gets you killed. Going on offense, even if you don’t win the state may force the enemy to look here, not there, on other states that Trump may now win thanks to resources and time being forced elsewhere.
2) That also works in reverse, with the enemy potentially benefitting from going after fool’s gold when he should be pursuing winnable targets that would be in the bag if current polls represent reality (which they do, and probably understate).
3) NJ has automatic voter registration and you will see the damage done by that in the linked video in this post.
4) I have NJ as just a Biden +5.5% state in a real 2020 race, the second pro-Trump trend in a row and likely putting NJ on the toss-up map in 2024.
5) DJT probably has polling showing exactly what my numbers show. My brain tells me that NJ is fool’s gold thanks to the automatic voter registration, the NYC cheat machine that will be active in the north of the state – and that it probably won’t produce DJT electors in 2024 (almost certainly).
