Why Donald Trump Cannot Get a Top-Tier Lawyer

There are disturbing suggestions that among the reasons lawyers are declining the case is because they fear legal and career reprisals.
There is a nefarious group that calls itself The 65 Project that has as its goal to intimidate lawyers into not representing Trump or anyone associated with him. They have threatened to file bar charges against any such lawyers.
I wrote an op-ed offering to defend pro bono any lawyers that The 65 Project goes after. So The 65 Project immediately went after me, and contrived a charge based on a case in which I was a constitutional consultant, but designed to send a message to potential Trump lawyers: If you defend Trump or anyone associated with him, we will target you and find something to charge you with. The lawyers to whom I spoke are fully aware of this threat — and they are taking it seriously…. It may even be worse today….
Good lawyers… generally welcome challenges, especially in high-profile cases. This case is different: the threats to the lawyers are greater than at any time since McCarthyism. Nor is the comparison to McCarthyism a stretch. I recall during the 1950s how civil liberties lawyers, many of whom despised communism, were cancelled, and attacked if they dared to represent people accused of being communists.
Our system of justice is based on the John Adams standard: he too was attacked for defending the British soldiers accused of the Boston Massacre, but his representation of these accused killers now serves as a symbol of the 6th Amendment right to counsel. That symbol has now been endangered….
Trump’s lawyers have now alleged that one of the prosecutors has suggested to Stanley Woodward, the lawyer for Waltine Nauta, Trump’s co-defendant, that his application for judgeship may be negatively affected if he persists in defending Nauta vigorously rather than encouraging him to cooperate against Trump. If that is true – and I have not seen the evidence to support it – then it represents a direct attack on the 6th Amendment.
Whatever one may think of Trump or the charges against him, all Americans must stand united against efforts to intimidate lawyers and chill them from defending unpopular clients pursuant to the 6th Amendment. Bar associations must look into the threats and actions of The 65 Project and of prosecutors who try… to influence the representation of clients by threats to their careers or other means.
Hard cases may make bad law but partisan cases endanger constitutional rights. We must do everything to assure that all defendants, including Donald Trump, get the zealous representation to which the Constitution entitled all Americans.

As always, I learn a lot from your posts and sometimes find that what I thought was an original idea, others have, too.
I FULLY expect the DOJ to play games in giving clearances to President Trump’s lawyers.
To include outright denying the clearances, slow walking the clearances, and “suggesting” other “approved” lawyers President Trump can use who already have clearances.

that is correct…it was one of the MANY reasons (after sidney got involved) that prosecutors withdrew all of the charges except the making false statement charge, which did not require a classification discovery to litigate.
in this case…and it’s one of the reasons why I keep pounding the table…it IS VERY MUCH ABOUT CLASSIFIED DOCUMENTS. The legal charges selected by the prosecutors filed in court may want to persuade SOME that this is a defense nation security argument…but at the core of it, is a classified material predicate.

noting: the flynn case is not similar here wrt to authority of POTUS…it’s different in that respect. But prosecutors were nervous when Sidney filed various motions to gain access to some of the exculpatory evidence that was not shown to grand jury and was not shown to Flynn’s former defense attorneys. They withdrew all charges to prevent that discovery and the judge allowed it…So it’s very different here.
the only thing that IS similar is that in order to properly defend President Trump, his defense team will need classmat clearance…I think this is an important development and was predicted, since the prosecutor argued against a special master earlier with the argument that DOJ satisfies what is marked classified or not…whether marked or not…whether closely held or not..and the distinctions legally between nat defense violations and classmat mishandling violations…those will play out in court. The DOJ has effectively moved the access to make discovery contingent upon whether the DOJ will or will not give proper clearance to Trumps’ team. In a fair play world, they will, but we know how we are dealing with here. I suspect if cannon forces their hand, it’s entirely possible DOJ withdraws some of the charges than risk discovery.
remember: DOJ has STILL not revealed what they were looking FOR, compared to what they stole.
so it’s going to be an interesting case…but unlike the Flynn case they will not have the benefit of an insider like sullivan….yet. As soon as things begin to look desperate, no doubt DOJ prosecutor will motion some fabrication to move to a different venue and judge.

What many here fail to realize is DJT was larger than life here in the metro area for decades and it was not uncommon for him to be among us commoners. He didn’t just morph into a people person when he came down the escalator.

One would expect since this case is very novel, i.e., never before attempted to indict a former president, that the bar would be set very high and pretty much be procedurally perfect, which is is far from. I hope President Trump’s attorneys make this point regarding legal standard expectations and also raise the unconstitutional points in this article. This case needs to be dismissed quickly for the good of the country and to make it clear going forward that former presidents do not get indicted on junk charges.

I wonder how a certain demographic celebrating Juneteenth this weekend takes that their celebration is overshadowed by an entire month celebrating an in fact much smaller group than them.

On June 4/5 the Ukrainian military launched its long announced counteroffensive in southeast Ukraine. Ten days later there is no significant progress.
This is not the outcome the war propagandists expected:

Back in reality the lead elements of the Ukrainian attack got slaughtered. They ‘culminated’, i.e. lost their ability for further attacks, in less than a day:

They would pay a heavy price.

A 30-year-old soldier known as Lumberjack saw two of the men in his vehicle bleeding heavily; one lost an arm as he cried out for his family. Lumberjack crawled into a crater, but the shrapnel from a mortar went through the soil and pierced his shoulder.
“We were left there in the field, without tanks or heavy armor,” said Lumberjack, who spoke to The Washington Post on the condition that he be identified only by his call sign. We were shelled with mortars from three sides. We couldn’t do anything.”

Interesting the FBI brought a redacted F1023 Form to Congress which hid mention of the tape recordings. The FBI didn’t know that Senator Grassley had a copy of the unredacted F1023 Form from the whistleblower which mentioned the 17 recordings of Joe and Hunter Biden asking for bribes!!! The FBI must be taken down and completely dismantled, the culture of corruption in the FBI can’t be reformed!!!!
A tall order.
I believe the FBI currently runs the country as the deep state in conjunction with Obama. They control most/all politicians via blackmail. Remember Comey tried to do this with President Trump on day one with the Russia pee pee allegation? Controlling also the elections, they will be difficult to defeat. Notice they did nothing to investigate widespread election fraud.

There was a time in this country when an immigrant had to have a sponsor and proof that they would not become a financial burden. We need to return to our history.
When my in-laws came here after WWII, not only did they have to have a sponsor but my FIL had to show that he was financially stable enough to support a family, which required him to work for three years before he could even apply to bring his wife and two young children to the US to join him! And my MIL, who was 38 years old at that time had to learn enough English to get a Driver’s License (no translators offered – she studied like crazy and passed the test within six months of arriving).
On the bottom of EVERY document sent by medicaid it clearly states they do not discriminate due to “national origin.”

note: what this PSA does not mention is that Louisiana inspectors have no idea what was stolen and whether this data will be sold to thieves. Assume, out of an abundance of caution, that is exactly what has happened.
so with that, some basic security recommendations are in order:
watch out for any suspicious activity to your online accounts…(it is trivial to hack passwords once you have enough PII, particularly ssn and email name and address)
it would be a good idea to do two things:
change your passwords…all of them. Make them deep entropy (long, mixed case and alphanumeric…I do NOT recommend allowing password generators to do this for you. Just grab a book, any book, or magazine…and randomly write down every other letter or character from every other page. Flip a coin with each letter to determine if its upper case or lower case. Flip a coin to change a letter to a number, flip a coin to change a number to a punctuation character.. 24 total characters long .
AND then use a two factor authentication method…I would strong NOT recommend SMS as your 2 factor…(but it’s better than nothing if the website or service only allows that one).
These are the sorts of cyber hacks (dmv) that have the highest potential of follow on identity theft.
I am generally not persuaded to use any of the two major credit reporting orgs, because they themselves have been subject to hacking…and in one agency, they do not adequately secure two factor auth…boggles the mind.
Most banks have active surveillance for suspicious activity…but these same consumer reporting methods for suspicious activities is a known social engineering vector for common hacking. “we noticed something suspicious, reads the email, or text, please change you password to your bank account by clicking here”…please do not do that. CALL YOUR BANK…And talk with a bank manager….do not rely on emails you receive for bank phone numbers…many of them will pop up over the next several days weeks and months on your text msg and email pretending to be your bank. If you receive paperless or paper bank statements..that is the best way to find the CORRECT bank phone numbers. Some banks have apps also that allow chat features and these are generally secure and reliable and so far have not been a hacker vector (yet). But I always call. It’s still the safest way to avoid problems.

so when we discuss why manufacturing in the US cannot compete with and cost of entry for new businesses are cost prohibitive, we have to include that it is regulation…this gives nation states, namely CHINA AND MEXICO an extreme advantage.
