But, in the end, it really does come down to Navy v. Eagan. The Presidency is privileged, deriving its power and prerogatives directly from Article 2. Specifically with regard to “national defense information,” the President (alone …) plays by no rules because he is “the rules.” Our original system of classification was created by President Truman, but the President himself is not subject to it. As the Executive Branch, he has the right to exercise his Oath of Office as he sees fit, and no employee of his branch or any other Branch can interfere or tell him, “no.”
Furthermore, Former Presidents retain the highest level of security clearance forever. Whether or not he declassified them, which he could do by his words or actions, he retained the right to possess and examine them – and to choose what, if anything, would be given to the National Archives and under what security classification.
This is exactly like a second lieutenant trying to court-martial his commanding officer, on his own imagined “authority” as a second lieutenant, because said officer made decisions or gave orders that he didn’t agree with. “You, sir, are not The President.”

When pundits try to defend President Trump by saying well the reason the case is unfair is they didn’t go after Hillary or Biden, they entirely miss the point. These are not equivalent at all.
Act II of the Constitution gives a president as you say, unique power. As the only elected officer of the Executive Branch, the Constitution grants him sole authority over national security.
A president can shred documents, share them around or even as President Clinton did stuff them in his sock drawer….and no one can tell him not to do so. No law can be written to interere with a president’s Article II power and no court can interfere (separation of powers).
Hillary and Biden and Pence were not president at the time they were taking classified material. Anyone who is not a president by law goes to prison for a long time for taking or mishandling documents.
Robert Barnes in a recent podcast said if the DOJ wins this case then Article II of the Constitution no longer exists.
Barnes says this case is a power grab by unelected bureaucrats and the intelligence community who under the Constitution have zero power except what they derive from their boss, the elected President. If they win, then the unelected Deep State will have gained more authority than the Presidency. And Article II would be dead.

Trump’s father was an authoritarian and critical parent. He made his boys spend their free time working for him doing menial physical labor from the time they were little. Trump’s older brother did not fare well emotionally and received harsher treatment as the originally-intended business heir. (He rebelled, became an alcoholic, and died prematurely, which Donald has never got over.) Donald had a different personality which served him better, but was a jokester, which Fred apparently didn’t like either, so sent him off to boarding school at NY Military Academy.
Trump’s childhood experience was lived, not “around” but as one of those “working people”.

I have listened to former staff & classmates discuss Trump’s tenure at the military academy. According to them, he adapted like a duck to water. He was athletic and easily assumed a leadership role with his peers. He was unafraid of work, was kind to others, and was well thought of by both students and staff.
This mirrors what countless employees and friends have said about him. He is a perfectionist, hard-working and generous. Also, he has always LOVED his country.

Calling a channel a “news channel” is somewhat oxymoronic since we really don’t get factual news aside perhaps things like weather reports. I would say all of the political news is propaganda to some degree meaning some more than others. I can’t think of even one good reason to watch a TV News channel including fox.
If your viewing of FOX News doesn’t lead to higher Nielson ratings (Are they still in business?) or money paid to them via a cable/satellite connection, than I can’t see where watching FOX is detrimental to our side? If FOX has a record of your viewing which they can tout to advertisers to claim higher ad rates than I guess that would be bad?

Joe Concha wrote an opinion piece that I read through yesterday titled “The Rematch Nobody Wants”
The main focus of his opinion is the polls don’t want either Biden or Trump to run again. Biden is old, has diminished health, incompetent and is dishonest. Trump is a Traveling Circus with legal problems calling it Trumps “Court TV” . And, they both mishandled Classified Information.
The polls show the people don’t want either. Of course, Joe didn’t say that Trumps legal issues are because the DOJ and others are obsessed with finding a crime and keeping him from running in 2024. A little fact ole Joe left out. He also left out it has been more than Trump and Biden that may have mishandled Classified documents. Several other Presidents and others have shown problems handling Classified documents. With over a billion out there, how could they not.
The main thing that ole Joe’s Opinion Piece didn’t cover, IMO, is who between Biden or Trump or anyone else can fix the problems we have in our country. Besides the economy and our problems around the world, our government institutions are corrupt as hell. It is going to take a special person that is highly motivated, willing, and able to tackle cleaning up the mess that is Washington DC.
If you have a corporation that is failing miserably I think you would look for a CEO that has the capability and intestinal fortitude to be tough enough to tackle the problem. You are not looking for a choirboy.

Interesting article on the Trump case over at American Thinker. Basically it says the Grand Jury should have been in Florida and not DC as the “crime” happened there and is grounds to throw it out. Along with all the other errors. Who has power of over the voters? Executive branch — via federal LEO certainly, but primarily via the IRS which the voters enabled by ratifying the 16th amendment.
In order to recover the power of the people, we must remove the power of the federal government to tax individuals directly. Taxes can be levied against the states, and its up to each state how to raise the funds and pay the taxes.
Then follow that up with eliminating the ability of federal law enforcement to directly interact with the public. We probably need some law enforcement that can investigate across state lines. But any investigation, arrests, etc must be done through the state police.

A President has an unqualified right to possess any classified information they have after they leave office. This is logical; said person already has it, has already seen it, and thus they are gaining nothing they don’t already have. The risk from same, such as it might be, already exists.
Thus mere possession cannot be successfully prosecuted. It is nearly-certain that portion of the indictment will fail as that has already been tested. Indeed Barack Obama has a crap ton of “records material” in storage that he has access to and he is no longer President. The last I heard it is in storage in Hoffman Estates near Chicago. He can’t be indicted for that; he had access to it, obviously, during his term and lawfully-so. All modern Presidents have a crap-ton of this material, usually in their libraries — Jimmy Carter’s library is an example of that.
However, the right of disclosure expires with your holding the office and since you had a right of access in the first place the obligation to not disclose attaches and never goes away until and unless the item in question is declassified or previously publicly disclosed and thus no longer a secret. If you work on a classified project until and unless you’re formally notified the material is declassified or you see in print somewhere (e.g. in the NY Times) the obligation to keep your mouth shut continues and if you violate that you’re breaking the law — and its not a trivial violation either. You can and might go to prison for a very long time.
Thus some of the material in Carter’s library is publicly available — and vetted to not be classified. Ditto for other modern Presidents. (Obama has yet to do that and there’s some dispute as to whether his “library” will be one in the sense of all of his predecessors; thus all the material in Hoffman Estates.)
But what is alleged in this specific case is that Trump is on tape disclosing said material and he knows its classified because he brags about how he could have declassified it — but didn’t. That is, he not only is disclosing classified material he’s doing it intentionally. Whether out of pure ego or other motivation doesn’t matter, nor does it matter what the classified material is and how damaging that disclosure might be. Both of those are immaterial to the act of willful disclosure.

My understanding is that he said like highly confidential and a secret which has a very different connotation then highly confidential and secret.
At the least this shows an intent to sway the public via false statements from the prosecutor, but it may suggest that the doc that was shown was not even confidential.
If on the odd chance the doc was confidential then it remains to be seen if President
Trump allowed them to read it or perhaps just waved it in front of them.

Seems like it’s sort of splitting hairs to protect President Trump. I’m not assuming the worst, obviously, about what he actually said in that situation, but it seems a bit like saying that if a teenager calls his aunt a “ho” it’s a more acceptable than if he called her a whore.
If President Trump spoke either of the versions, he was opening a door for accusation. I don’t feel compelled to maintain that he is utterly perfect and infinitely wise in every utterance he makes. It’s not necessary. Those who hate what he stands for react in chaotic hatred when he simply enters the room. Those who grieve over the condition of our former Constitutional Republic respond with rising courage and joy when he enters the room.
Trying to impose a perception of perfection on his every utterance is an unnecessary proposition that can easily backfire.

Did the person PTrump was talking to actually get to look at the supposed classified stuff? What did the reporter or whoever it was actually see? Trump holding a paper and saying this was kept classified? If the person never actually saw any of the supposedly classified material, then what is the problem? Just because PTrump talked about it being a classified doc? The recording is of him taking about it, but did he actually allow a ‘non security cleared’ person see it and read it? I would think that has some bearing on the whole incident. Did anyone see classified material that wasn’t supposed to see it?
We’ve probably all waved a piece of paper around to make a point at some time or another, without actually showing it to someone or them actually picking it up and looking at it.
This sounds so close to that bogus story when he first took office, about him giving away military secrets to Russia through boasting.

The people of the right have been used and abused for so long that they latch onto anyone that speaks in their tongue and then places them onto some kind of pedestal, only to be disappointed time and again.
For the most part I have become calloused, skeptical and unimpressed. President Trump is one of the absolute few that I have learned to give my respect to, he has earned it. A good point about what is or isn’t a human right, but when governments prevent you from housing yourself as you can afford, they then have a responsibility to see that you can obtain shelter.
Government is also a large part of the reason that higher education became so unaffordable. Colleges could not stay in business by selling a product only a few people could afford, without the government’s involvement.
Governments have also made the affordable state alternative to private colleges beyond the means of many.
